ACCEPTANCE OF PROPOSAL AND TERMS & CONDITIONS ON THE REVERSE SaDE
The above prices, specifications and conditions are satisfactory and are hereby accepted. I have read the terms and conditions on the reverse side of this
proposal; and you are hereby authorized to do this work as specified. Financing available upon request. If financing is desired; pre-approval must be
obtained before any work is started. This proposal may be withdrawn by us if not accepted within 30 days.

A service charge of 2% per month (24% annum) to be applied on accounts past due.
ADDITIONAL TERMS & CONDITIONS OF SALE
Fox Valley Asphalt agrees to carry Workman's Compensation and Public Liability Insurance. A certificate
of Insurance to verify this insurance will be available upon request. Owner to carry fire, toma.do, and other
necessary insurance upon above work. All agreements are contingent upon strikes, accidents or delays
beyond our control. Fox Valley Asphalt will not be responsible for damage to any private underground
utilities or other hidden conditions if the owner/contractor.fails to give Fox Valley Asphalt advance notice of
their existence and location. Fox Valley Asphalt is not responsible for concrete damage when necessary to
drive over to complete work. Owner/contractor agrees to indemnify and hold Fox Valley Asphalt harmles~
for any loss, expense, or damage resulting from, arising out of or in any way related to such conditions.
Any claim for property damage is conclusively waived unless presented to contractor in writing within 7
days of the occurrence. The liability of Contractor for malfeasance and nonperformance is limited to the
amounts due hereunder.

No materials will be placed on a wet, unstable o"r frozen subgrade. A suitable subgrade shall be furnished
to the Contractor as a condition precedent to the reguirement of performance of this contract by the
Contractor. Contractor reserves the right to refuse to construct a pavement unless minimum grades of 1 %
are possible for surface drainage. If the owner directs construction with less than a minimum grade of 1%,
it is understood that waterponding may occur and that no warranty attaches to the work as to satisfactory
surface drainage. When resurfacing concrete, brick or asphalt pavements the Contractor is not responsible
for the reproduction of cracks or expansion joints which may occur. Waterponding of 1/8" or less is within
industry standard and is not guaranteed.
"AS REQUIRED BY THE WISCONSIN CONSTRUCTION LIEN LAW, BUILDER (CONTRACTOR)
HEREBY NOTIFIES OWNER THAT PERSONS OR COMPANIES FURNISHING LABOR OR
MATERIALS FOR THE CONSTRUCTION ON OWNER'S lAND MAY HAVE LIEN RIGHTS ON
OWNER'S lAND AND BUilDINGS IF NOT PAID. THOSE ENTITLED TO LIEN RIGHTS, IN ADDITION
TO THE UNDERSIGNED BUilDER, ARE THOSE WHO CONTRACT DIRECTLY WITH THE OWNER OR
THOSE WHO GIVE THE OWNER NOrlCE WITHIN 60 DAYS AFTER THEY FIRST FURNISH lABOR OR "
MATERIALS FOR THE CONSTRUCTION. ACCORDINGLY, OWNER PROBABLY Will RECEIVE
NOTICES FROM THOSE WHO FURNISH lABOR OR MATERIALS FOR THE CONSTRUCTION, AND
SHOULD GIVE A COPY OF EACH NOTICE RECEIVED TO HIS MORTAGE lENDER, IF ANY, BUilDER
AGREES TO COOPERATE WITH THE OWNER AND HIS lENDER, IF ANY, TO SEE THAT All
POTENTIAL LIEN CLAIMANTS ARE DULY PAID."
In the event Contractor seeks legal collection in order to collect restitution of this contract, any and all fees
incurred by the Contractor, including all attorney fees, will be assumed and paid by persons or companies
entering into this contract with this Contractor.
Any alteration or deviation from specifications involving additional material or labor, will become an extra
charge over the sum mentioned in this contract. Fox Valley Asphalt reserves the right to adjust the price of
such alterations, as it deems proper, except when the parties to the contract, by a separate writing or
written amendment to this contract, agree to the extent and price of such alterations.
Our workmanship and materials are guaranteed tor 1 (one) year; unless specifically stated differently on
the reverse side. All labor and material is conclusively accepted as satisfactory unless excepted to in
writing within 7 days of performance. Failure to pay any amounts due and owing within specified time shall
completely and fully void any and all guarantees, express or implied. Contractor is not responsible for
cracks due to frost or soil movement.
