Comments/Conditions
1. NOTE: Property is located in the Universal Business Park (UBP), which has additional restrictions
and covenants.
2. NOTE: Conditional Use Permit approved by Resolution 07-137B. .
3. NOTE: Dumpster enclosure must be relocated 5' to the west as it is currently infringing on the 20'
buildingsetback standard. Re-submission shows alteration and is approved.
4. CONDITION: Revised landscaping plan is conditionally approved. The proposed blue
spruce trees around the perimeter of the playground however need to be 4' MINIMUM at
planting (not 2.5" as shown on plan).
5. NOTE: Exterior building material is approved, however, the colors must be submitted and
approved, as they have not been supplied to date. Re-submission shows colors and are approved as
ill ustrated.
6. NOTE: Lighting specs provided but no photometric plan. Therefore, no exterior lighting shall be
installed prior to a photometric plan being provided and approved.
7. NOTE: Signage is not included in review, as it has not been supplied. No signage shall be
installed until proper permit has been applied for and approved.
8. CONDITION: The fence shall be removed if the day care use of the property discontinues.
9. CONDITION: A variance is granted to the UBP covenants to permit construction of a 4 ft. high
black chain link fence to enclose the proposed playground.

PURPOSE:
PLAN COMMISSION RECOMMENDATION: Found consistent with Standards set forth
in Section 30-11 (D) of the Zoning Ordinance and approved w/conditions as noted
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any,. and the Planned District Overlay and final development plans, per the
attached exhibits, are hereby approved.
(B) State Road 91, West of 4041 Sate Road 91; BCG Properties, petitioner
A conditional use permit for a day care center, per the attached "Exhibit C", with the
following conditions:
1) A landscape plan be prepared by a registered landscape architect or designer
and approved by the Dept. of Community Development. Landscaping plan shall
mitigate the impact of the fence on the area through use of berms and plantings
to reduce the visibility of the fence by 50% at plant maturity.
2) The fence shall be removed if the day care use of the property discontinues.
3) A variance is granted to the Universal Business Park Covenants to permit
construction of a 4 ft. high black chain link fence to enclose the proposed
playground.
4) The site plan be modified to reposition the building from the east property line to
the west property line with final approval by the Department of Community
Development.
5) Final exterior building material and colors to be approved by the Department of
Community Development.

I will go down the checklist and address each point:
1. Proposed use of property is for the construction of
a new.childcare facility.
2. Currently the pr6petty is a vacant lot
3. Number of employees approx. 22, number of children
atrtending approx. 110.
4. Approx. .7500 sq. foot building positioned on NE side
of property, which is approx. 1.53 acres. Outdoor
fenced playground of approx. 2500 sq. ft which will be
attached to south end of building. 30 parking spaces
with lot located both on north, and west side of
property. (see plans)
5. There will be no adverse affects on any adjoining
property, which as of now is also vacant. Hours of
operation will be 5:30am to 6:00pm.
6. Surrounding land includes industrial, residential,
and small. business.
7. A childcare center at this location will prove
advantageous to surrounding homes and businesses.
There are several large companies in the area; with
many employees who will require child care. Also,
residential development continues to grow to the West
and Southwest of town.
8. Traffic will woik perfectly at this site, being at
the intersections of hwys. 44 and 91, and also Oakwood
road. Traffic wil.l be able to flow smoothl.y.
9. We have been in business at our current location for
almost 5 years, and have been quite successful.
However, success has developed a need for a larger
facilli ty, thus the new location and building . The new
location will be an asset for the. City, and its
residents, a.s our current location has been for 5
years. We are a proud member of the chamber of
commerce, we provide employment for 15-17 employees,
and look forward to continuing service to our current
families and future families in a brand new purpose
built child care facility.

from our contractor; Fluor Bros. Construction, and our
architect Bill Aubrey.
