The properties (#s 12-0068-0000 & 12-0180-0000) is currently zoned R-1 C: Single entral Residence
District that allows, with conditional use approval, an art center. Resolution 91-399: Conditional Use
Permit allows the art center use and accessory uses customarily incidental and accessory to that use. Please
See Section 30-18 in the City of Oshkosh Municipal Code (website www.cLoshkosh.wLus)forfulllist of uses
permitted and conditional within the R-!C District.
The "arts-based educational program" is anticipated to be managed in collaboration with Arts for Kids and
includes instruction and education of a limited number of children within the existing Paine Art Center campus.

Dear David:
I am writing to inform you about a new educational program at the Paine Art Center and Gardens
and to request your assurance that the program is acceptable in relation to the organization's
Conditional Use Permit to operate as an Arts Center.

In August of2007, the Paine will launch a new arts-based educational program for 4-year-old
children. The program will be operated in our facility at 1313 Elmwood. This building has an
existing large parking lot and an existing 2,000 sq. ft. educational center to readily accommodate
the program. The Paine does not intend to make any changes to the exterior of the building or
surrounding property to accommodate the program. The program will serve a maximum of
twenty (20) children per two-and-a-halfhour session with a maximum of two (2) sessions per
weekday; for a maximum of five (5) hours of instruction and forty (40) children served per day.
The program is incidental to and consistent with the purpose of the Paine Art Center and Gardens
as established by founders Nathan and Jessie Paine in 1946. The Paine's Deed of Gift states that
the organization operate "as a charitable foundation of the highest educational and cultural value
for the benefit not only of the people ofthe City of Oshkosh, Wisconsin and its educational
institutions - but also for all interested persons and educational institutions." This program is also
consistent with the organization's incorporation in 1946 as 501(c)(3) non-profit educational
institution.
The Paine seeks to maximize its distinctive combination of resources to inspire a wide range of
innovative educational programs creating multiple opportunities for exploration and learning.
This program will serve 4-year-old children and engage them in educational activities related to
the art, architecture, and gardens of the Paine. The program will be operated by Arts for Kids, a
specialty child care center with expertise in arts instruction for preschool age children. Funding is
provided by the State of Wisconsin and administered by the Oshkosh Area School District.
Importantly, this collaboration enables the Paine to offer this high-quality arts educational
experience to four-year-old children for free. The children will not have to pay any fees to
participate.
The Paine Art Center and Gardens believes this program is consistent with the organization's
Conditional Use Permit from the City of Oshkosh to operate as an Arts Center. As the Paine's
building at 1313 Elmwood has already existed as an educational center and the size of the facility
and amenities can easily accommodate this program, we believe that the operation of this program
will not significantly change our activity and impact with the neighborhood.
