Attached are copies of the approved Abatement Requests for these properties. Each file is
covered with a summary report.
552 Pleasant 8t is the site of the murder/suicide that occurred earlier this year. The relatives of
the former owners have moved out of state and the mortgage holder indicates they cannot
respond until Foreclosure Action is completed (several months per conversation with the
Mortgage Holder. In the meantime this property is attracting vandalism and is part of the City's
Near East program.
834 Franklin 8t involves some site conditions the owner has failed to correct. Citations have
been issued and have produced little result.
Please pursue Abatement action on this case. If you need assistance from this office, please
advise.

ProblemNiolation of: 17-36B, 30-36A(4), &7-8; Failure to maintain the property/allowing
unsightly conditions to exist, non-designated parking and working with an
expired permit.
Brief history review: A recent inspection, following several complaints, revealed that this
property is in need of significant maintenance. This property has been an eyesore and a problem
for the surrounding neighborhood for the past two years.
There have been numerous Correction Notices and citations issued for failure to maintain this
property in the past (April 2004 to present). A copy ofthe Correction Notices, citations, and
court appearance summaries are enclosed. Mr. Longsine currently owes the Court $1,344.18.
Also included are several letters from the surrounding neighbors asking for action in regards to
this property.
We are requesting an abatement order that would require the following:
1. All junk / debris shall be removed from'the premises.
2. All vehicles, including boats, stored/parked of the premises shall di~lay current /)

Dear Mr. Prickett,
I live directly next door (to the South) of the residence at 834 Franklin St (from here on
out referred to as "neighbors"). I have lived in my house, at 828 Franklin St, for over 30
years and am a proud home owner. For the past several years, however, I have struggled
with enjoying my home due to my neighbor's unsightly yard and their (neighbor's)
obnoxious noise level.
It appears as though the neighbors are running a mechanic shop or salvage yard off of
their property. There are always several (5 or more at any given time) along with 1 or 2
partially disassembled vehicles sitting on their property. These vehicles are in their drive
way and along with 2 rows of vehicles in their side yard. Although this is their property,
I don't believe the neighborhood is zoned as a salvage yard.
The property often has tire ruts of 6" deep or more due to them (neighbors) trying to
move the vehicles when the ground is wet. Making the ruts often propagates loud engine
revving (typically before 6am and after 1 1 pm) and mud slinging. At times, mud has
made its way over the fence littering my driveway, and inevitably, the mud is carried
from their tires down the new street. My tax dollars and hard earned paychecks have
helped build our new street. As a resident of this neighborhood, I feel that it is unjust,
without an exception, for mysel1tothers in the neighborhood, to have to look at and drive
down a street strewn with chunks of mud.

In regard to the above captioned property, I,and other close neighbors,
have put up with the dismal disarray of the yard for a long time. There
are many times alot of cars and trucks are squeezed in the yard amid other
clutter, so that it looks like a used car and junk lot. To add to this,
since the paving of the street last year, cars and trucks on the lawn going
in and out in wet weather especially, have rutted up the lawn into muddy
ruts, and have tracted this mud onto the sidewalk and new street--hardly
conducive to the nice new street appearance.
Also, this unsightly situation, I believe, could be a distinct deterrent
to the value and sale of property for those wishing to sell in the immediate
area. Most of the homeowners here try to keep up their property as much as
possible for the neighborhood, and I believe this owner should do likewise,
if not for themselves, as seems to be the case, then for the consideration
of" homeowners around them.
Inasmuch as we neighbors have put up with this blight for so long, it is
hoped that the city will be able to resolve this matter as soon as possible.

I am writing to voice some concerns that I have with the property at 834 Franklin St. I live just a few houses south of this
property and have noticed that since I moved into the neighborhood in July of 2002 (and probably well before that) this
property has had the appearance of being a junk and auto salvage yard. It constantly has a minimum of at least 4-6
vehicles in the driveway as well as all over the front yard. This is above and beyond what is stored in the overcrowded
garage. I was able to ignore it for the first few years that I lived in this neighborhood because due to the condition of the
street at the time I never used to go that way to avoid extra driving on the herendous road that was here. Now that the
street has been repaired I do frequently drive past this property and it is a tremendous eyesore. From what I understand
the owner was instructed to create a new driveway due to the relocation of their driveway apron. They have failed to do so
in what my opinion is a timely fashion. The rain has cause the comings and goings of the vehicles stored there to track
mud all over what was a beautiful new street. This one property is managing to drag down what would otherwise be an
attractive neighborhood. Everyone seems to be making an effort to clean up the area and maintain their properties except
834 Franklin. I would appreciate something being done to get these owners to comply with previous orders to get their yard
looking nice. In the past I have known people that have been ordered to remove their vehicle from the front lawn due to
some city regulation and cannot understand how this property seems to get away with it for years on end. If they would like
to run an auto salvage yard maybe they should be required to live in an area zoned as such.

Respondents.
The above-entitled matter, having been reviewed by the above court by Honorable Barbara H.
Key, Circuit Court Judge, presiding, and the parties having stipulated to judgment and the court
having reviewed the documents on file herein and being fully advised in the premises, therefore
makes and files the following findings of fact and conclusions of law constituting its decision in
this action.
FINDINGS OF FACT
1. That the defendants have addressed and remedied a number of the issues that were set
forth in the plaintiffs Complaint. The petitioner and respondents have stipulated to the entry'of
a judgment which addresses only the unresolved issues in the petitioner's Complaint.
2. That the premises is located at 834 Franklin Str~et in the City of Oshkosh, which is
more particularly described as follows:
Lot Seventeen (17) in Block 79 in GaTT, READ AND EIGHl\llES ADDITION,
City of Oshkosh, Winnebago County, Wisconsin.
3. That the Longsines have violated Section 17-36(B) of the OshkoshMD.~cI: lYE 0
by allowing the following conditions to exist: r\.I.:yL
a.

removed from the property or placed within a building on the premises

There is junk and debris behind the house which is creating an unsightly

c. There is no lawn established on the premises which is creating an
unsightly condition that tends to depreciate property values in the area.
CONCLUSIONS OF LAW
1. That the premises at 834 Franklin Street in the City of Oshkosh as more particularly
described in the Findings of Fact, constitutes a public nuisance pursuant to Chapter 823, Stats.
2. That the Summons and Complaint in the above-entitled action was duly and
personally served on Danny S. Longsine and was served by substitute service on Ashley Q.
Longsine. The parties have stipulated to entry of judgment.
3. That the" current owner and any subsequent owners of the property shall remedy the
conditions that create the public nuisance and take such actions as are necessary in order to
eliminate the public nuisance.
4. That if the nuisance is not abated according to the judgment, the City of Oshkosh shall
have the option to petition the court for contempt of the court order or for an order authorizing
the City of Oshkosh to take such actions as are necessary to abate the nuisance.
NOW, ON MOTION OF JOHN M. BLAZEL, ATTORNEY FOR THE PETITIONER it
is ordered, that an order be entered requiring the nuisance to be' abated pursuant to the demand in
the Complaint and in accordance with the above findings and conclusions. '
JUDGMENT FOR ORDER FOR ABATEMENT OF PUBLIC NUISANCE
The court having issued its findings of fact and conclusions of law, enters the following
order and judgment:' ,
1. It is hereby ordered that the owner of the premises at 834 Franklin Street in the City of
Oshkosh, abate the public nuisance on that premises pursuant to Chapter 823, Stats.
2. It is further ordered that the public nuisance in paragraph 3 (a) and 3(b) of the Findings
of Fact be abated within 30 days of entry of judgment.
3. It is further ordered that the public nuisance set forth in paragraph 3(c) of the Findings
of Fact be abated by June 30,2007.
4. If the nuisance is not abated as set forth in paragraphs 2 and 3 of the Judgment, then
the City of Oshkosh shall have the option to petition the court for contempt of this abatement
. .

order or for an order authorizing the City of Oshkosh to t8ke such actions. as are necessary to
abate the nuisance.
5. It is further ordered that in the event that the City petitions to abate the nuisance itself,
the City shall have execution in the common form for the City's damages and costs incurred in
abating the nuisance and the City shall be entitled to a warrant to the appropriate Oshkosh
official allowing the City to abate atid remove the nuisance at the expense of the defendants,
Danny S. Longsine and Ashley Q. Longsine.
6. The expense of abating the nuisance pursuant to such warrant shall be collected by the
Building Inspector in the same manner as damages and costs are collected upon execution or
may be collected by rmding the defendants Danny S. Longsine and Ashley Q. Longsine
personally liable for the expenses, as provided in Section 74.53, Stats. The Building Inspector
"may sell any items abated or removed as a nuisance in the manner that personal property is sold
upon execution and may apply the proceeds to pay the expenses of the abatement, paying the
residue, if any, to the respondents. .
7. That the City be awarded court costs/filing costs in the amount of$256.00 and
statutory attorney's fees of$100.00, for a total of$356.00.

Defendants.
Now comes the petitioner, the City of Oshkosh, by its attorney, John M. Blazel of Spoehr, Smits
& Blazel, LLC and states and alleges as follows:
1. That the City of Oshkosh is a Wisconsin Municipal Corporation with its primary
offices at 215 Church Avenue, P.O. Box 1130, Oshkosh, WI 54903.
2. That the defendants, Danny S. Longsine and Ashley Q. Longsine, are adult residents
ofthe State of Wisconsin and upon information and belief reside at 834 Franklin Street, in the
City of Oshkosh, Wisconsin 54901.
3. That the Longsines own the property at 834 Franklin Street, in the City of Oshkosh,
which is more particularly described as follows: .
Lot Seventeen (17) in GOTT, READ AND EIGHMES ADDITION, City of Oshkosh,
Winnebago County, Wisconsin.
4. That the Longsines have received a number or Correction Notices and citations from
the City since 2004 for allowing numerous ordinance violations to exist on their
property.
5. That the Longsines have violated Section 17-36(B) of the Oshkosh Municipal Code by
allowing the following conditions to exist:
a. There is junk and debris scattered about the premises that has created an
unsightly condition that tends to depreciate property values in the area.
b. The yard need to be restored, graded and seeded because it is uneven,
muddy, an eyesore, and creates an unsightly condition that tends to
depreciate property values in the area.

There is excess dirt piled in the yard in the back of the house that has been
present for more than 30 days.
d.
There are inoperable vehicles on the premises that are inoperable by virtue
of the fact that they are unlicensed and/or unregistered.
6. That the Longsines have violated Section 30-36 (A) by allowing the following
conditions to exist:
a. There are vehicles parked on the premises that are not the occupant's
passenger vehicles and that are not passenger vehicles.
b. There are vehicles parked on the premises that are in designated setback
areas or that are parked on the lawn off of designated parking areas on the
driveway.
7. That the conditions of the property have created an eyesore and unsightly conditions
which tend to depreciate property values in the area.
8. The condition of the Longsine's property has generated complaints from neighbors.
9. That the conditions of the property constitute repeated violations of City ordinances.
10. That the repeated violations constitute a public nuisance.
WHEREFORE, the City of Oshkosh requests the following relief:
A. For a determination that the violations constitute a public nuisance pursuant to
Chapter 823, Wis. Stats.
B. For a Judgment that the public nuisance be abated and reoccurrence be enjoined.
C. For a Judgment against the Longsines awarding the City damages, costs, fees and
expenses of abatement as allowed by law.
D. For such other and further relief as may be available under Chapter 823 or as may be
, just and equitable.
