BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached
Amendment No. 1 for engineering design services with MSA Professional Services of
Madison, Wisconsin for the North Main Street (Algoma Boulevard to Irving Avenue) project
is hereby approved and the proper City officials are hereby authorized to execute and
deliver the agreement in substantially the same form as attached hereto, any changes in
the execution copy being deemed approved by their respective signatures, and said City
officials are authorized and directed to take those steps necessary to implement the terms
and conditions of the Agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

This is an amendment to the Agreement dated and does acknowledge that
MSA Professional Services, Inc. (MSA) is authorized to begin work on the following project
amendment:
Project Name: North Main Street (Algoma Blvd. to Irving Ave)
The project scope has changed due to: The North Main Street Historical District is listed on
the National Register of Historical Places and is located within the project limits.
The scope of the work authorized is: Section II.B.2 is added as follows to Section A.2.0
of Exhibit A -Basic Services and Related Matters}
The ENGINEER shall follow the procedures set forth in the Wisconsin Department of
Transportation Facilities Development Manual for the Section 106 Process, Step 4, Assess
Effects, to determine the effect the PROJECT will have on all properties listed or eligible for
listing on the National Register of Historical Places.
The schedule to perform the work is:
Approximate Start: 7/1/07
Approximate Completion: 8/1/07
The lump sum fee for the work is:
$6,550.77
Authorization for the work described above shall amend the Agreement between MSA and
OWNER. Any attachments or exhibits referenced in this Amendment are made part of the
Agreement. Payment for these services will be on a lump sum basis.
Approval: MSA shall commence work on this project in accordance with your written
authorization. This authorization is acknowledged by signature of the authorized
representatives of the parties to this Amendment. A copy of this Amendment signed by the
authorized representatives shall be returned for our files. If a signed copy of this Authorization
is not received by MSA within seven days from the date of issuance, MSA may stop work on the
project.

Dear Jason,
This letter constitutes HRL's proposal for completing the Assessment of Effects (AOE) document
for the captioned project.
We have established that the Area of Potential Effect includes the National Register-listed North
. Main Street Historic District. No other National Register-listed or eligible resources are in the
project area. It should also be noted, however, that the Historic District extends between two projects
(the referenced city endeavour and WisDOT ill #4110-16-00), 91.2% of which is within the
parameters ofthe captioned city project.
Accordingly, HRL proposes to complete for the relevant 91.2% of the District the Determination of
No Adverse Effect, or Conditional Detennination of No Adverse Effect, or Determination of
Adverse Effect/Documentation for ConsultationlMemorandum of Agreement-whichever is appro-
priate-for a fee of $5,406.00. A breakdown of this figure can be fomid in Attachment AlPage 2 of
this communica-tion. HRL is well experienced with such documents and is prepared to embark upon
the endeavor once the survey report and DOEs are submitted. It is our present thought, based on our
understanding of the project, that a Detennination of No Adverse Effect is the most likely of the
alternatives to be pursued for this project. This, of course, is subject to change as plans evolve.

Assumptions: One Historic District is situated along the project and will need to be addressed in the
Assessment of Effects document. With the district included, a public meeting (either
individually scheduled or piggy-backed with a Public Information Meeting) will likely
be needed. One additional trip to Oshkosh is also assumed for the purposes of consulta-
tion and additional photography. It should be noted that 91.2% of the District is located
within this North Main Street project. Thus this proposal represents 91.2% of the total
that will be incurred (the remaining 8.8% will be associated with WisDOT Project ID
#4110-16-00).
