HomeMy WebLinkAbout07-173 JUNE 26, 2007 07 -173 RESOLUTION (CARRIED 6-1 P LOST LAID OVER WITHDRAWN PURPOSE: AMEND CONDITIONAL USE PERMIT; APPROVE REVISED PLANNED DEVELOPMENT - HAZEL STREET/OAK STREET/ PARKWAY AVENUE - 1120 EAST PARKWAY AVENUE INITIATED BY: COMMUNITY RETIREMENT LIVING, PETITIONER GITCHI-GUMEE LLC, OWNER PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, the Common Council previously granted a conditional use permit for a planned mixed commercial/residential development for the rehabilitation of a portion of the former Mercy Medical Center complex on Hazel Street and Oak Street; and WHEREAS, the owner and petitioner have prepared a certified survey map, attached, to separate the vacant former hospital structure from the developed market rate apartments and create an additional lot for future development along Grove Street, which proposal requires base standard modifications due to a proposed lot line with no setbacks and cross parking/access easements. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the planned commercial/residential development of the former Mercy Medical Center complex on Hazel Street/Oak Street/Parkway Avenue is hereby revised to create 3 lots, per the attached survey map, with the following conditions: 1) Recording a sidewalk easement along Parkway Avenue per the Department of Public Works. 2) Cross parking/cross access agreement, to be approved by the Department of Community Development and recorded with the Register of Deeds. Agreements to include access to the trash enclosure area for the apartments. 3) Encroachment agreement for the canopy area in the Hazel Street right-of-way to be approved by the Department of Public Works and recorded with the Register of Deeds. 4) Approval by Inspection Services for a common building property line between Lots 1 and 2 and all necessary easements as required. BE IT FURTHER RESOLVED that the Common Council of the City of Oshkosh hereby approves of the Planned District Overlay and revised development plan per the attached.
