Project No. 2006 Dear Allyn: I have received the air balance report on the new pizza hood and reviewed. 1. The hood is exha,usting 1570 CFM which is .047% over the design CFM. 2. I've discussed the report with Rich Bond of Badger Balancing. The building has a slight positive pressure (.005"). This indicates that the kitchen area is slightly negative. Air is flowing :from the dining area to kitchen. Therefore, to best of my knowledge and belief the installation of the new pizza hood and fan have been installed as per the approved documents for this project. IMC 508.1 Makeup air. Makeup air shall be supplied during the operation of commercial kitchen exhaust systems that are provided for commercial food heat-processing appliances. The amount of makeup air supplied shall be approximately equal to the amount of exhaust air. The makeup air shall not reduce the effectiveness of the exhaust system. Makeup air shall be provided by gravity or mechanical means or both. For mechanical makeup air systems, the exhaust and makeup air systems shall be electrically interlocked to insure that makeup air is provided whenever the exhaust system is in operation. The information included in the balancing report dated October 2(/h, 2006 lists many deficiencies with the existing HV AC equipment, while providing little information as to how these will be corrected. This plan approval is based on the amount ofmake-up air specified in these plans being provided. Plans provided do not detail how exhaust and make-up air will be interlocked - verifY that these systems are properly interlocked as required by code. The pizza oven exhaust hood needs to be interlocked with the make-up air source. . Corum 61.31(4) Revisions to approved plans. All proposed revisions and modifications which involve rules under this code and which are made to construction documents that have previously been granted approval by the department or its authorized representative, shall be submitted to the office that granted the approval. All revisions and modifications to plans shall be approved in writing by the department or its authorized representative prior to the work involved in the revision or modification being carried out. Unlike a grill where the distance between a hood and cooking surface if reduced can allow for a decrease in airflow while still meeting capture and containment requirements. This concept has been jilrther reinforced in conversation with State Plan Examiners as well as in the 2006 IMC in which the formulas provided in this section have been replaced by CFM per linear foot of hood. In this case the requirement of the 2006 code is 200 cfm per linear foot, which is r.oughly equal to the current formula of Q=50A. In your most recent submittal YOll indicated that only 876 cfm was being provided. This would indicate that based on the formula there is only enough air flow for a 4ft long hood not the 5ft long hood being installed. This will result in the dimensions of the hood having to be increased, there-by requiring additional exhaust. Keep in mind that the exhaust system is not only for the removal of heat produced by the oven, it also serves the function of venting the combustion products produced by the oven. One CFM of natural gas burned with the proper amount of combustion air, produces 11 CFM of combustion products. It is essential that both the exaust and make-up air systems be properly sized and functional for the equipment being installed to properly function. IMC 508.1 Makeup air. Makeup air shall be supplied during the operation of commercial kitchen exhaust systems that are provided for commercial food heat-processing appliances. The amount of makeup air supplied shall be approximately equal to the amount of exhaust air. The makeup air shall not reduce the effectiveness of the exhaust system Makeup air shall be provided by gravity or mechanical means or both. For mechanical makeup air systems, the exhaust and makeup air systems shall be electrically interlocked to insure that makeup air is provided whenever the exhaust system is in operation. The information included in the balancing report reveals the existing HVAC equipment is not balanced/adjusted to operate per the 1976 Stamped State Approved Plan (when the building was converted to a Restaurant) and provides little information as to how this will be corrected. There are essentially two option that exist for showing that the new hood will function in a compliant manner. Option 1- Submit plans demonstrating how the proposed Pizza Oven Hood will function in relation to the original approved HVAC design (when the building was converted to a restaurant in 1976.) Specifically, how will additional Make Up Air be provided, knowing that the requirements of the original HVAC System must be maintained. The air flow rates used in your first submittal dated September 21st appear to match those used in the original design from when the building Was converted to a restaurant in 1976. However, the air flow rates shown in the submittal dated October 1 Kh, appear to use air flow values obtained in the balancing report that is dated October 2(/h. Please note the air flow rates in the balancing report are not compliant with the air flow rates shown in the original design without regard as to how this maintains compliance with the original HVAC approvaL The existing HVAC system must maintain compliance with the code in effect at the time of design/installation. The addition of the Type II Pizza Oven Hood must comply with present day exhaust and Make Up Air code requirements. Option 2 - Submit plans demonstrating how the entire HVAC system ( existing and proposed Type II Pizza Oven Hood) can be altered/installed to meet current HVAC code requirements. Specifically the State adopted the International Building, Mechanical, Fuel Gas, Energy Efficiency and Fire Codes in 2002. Prior to this, the State of Wisconsin Commercial Building and HV AC Code did not require exhaust hoods over baking equipment used exclusively for non-greasy vapor or smoke producing foods. As you are aware this included such equipment used for baking pizzas. However, the present code (International Mechanical Code) requires a minimum of a Type II exhaust hood over any commercial food heat processing equipment that produces heat, steam, fumes or odors. Discussing this issue with Richard Wollangk, City Manager and Jackson Kinney, Director of Community Development, we felt it would be reasonable to temporarily allow use of this oven for the purposes of cooking non-greasy vapor producing foods to allow you time to comply with the kitchen exhaust hood requirements. This temporary approval is valid through June 30th, 2006 at which time you must provide compliance with the kitchen exhaust hood requirements. Compliance must be provided by end of this office's work day on June 30th. If compliance is not provided by this date, your Restaurant License and Liquor License renewals will be withheld until compliance is provided. As discussed, HV AC plans for the Kitchen Exhaust Hood must be prepared and submitted for review and approval by a Wisconsin Registered Architect, Engineer or HV AC Designer. As you will see prior to issuing Citations, this office afforded Mr. Sosnoski a generous amount oftime and cooperation toward achieving compliance. Even after citations were issued, this office has still kept the door open to dismiss the citations if compliance is provided prior to a July court date. Please also note, that prior to issuance ofthe citations, calls were made to his architect to determine if progress was being that was not forwarded to this office. Fall 2005 Owner purchases building and commences modifications to building to relocate his Pizza/Restaurant operations into this building. The building, previously used as a restaurant, was not a Pizzaria and did not previously have a Pizza Oven prior to new ownership (confirmed by City Health Services Division.) The owner or owner's representative did contact this office about placing a Pizza Oven under an existing Exhaust Hood and was told as long as it fit under the existing hood, that would be acceptable. 1/10/06 Correction Notice issued requiring an Exhaust Hood to be installed over a Pizza Oven as the oven was not installed under an existing hood (oven is too deep to fit under existing hood.) This notice also required Plans to be submitted for review and approval and a HV AC permit to be secured prior to installing a hood. 1/12/06 After consultation with City Manager and Director of Community Development, letter was sent giving the owner until June 30, 2006 for compliance as this was a code issue the owner was not aware of and needed time to comply. 6/13/06 Letter sent to remind the owner of the June 30, 2006 deadline. 6/26/06 Owner requested an extension to October 15, 2006 for compliance. 6/28/06 After consultation with City Manager and Director of Community Development a letter was sent approving extending the compliance deadline to October 2, 2006. 9/06/06 Letter sent to remind owner of the October 2, 2006 deadline. 9/28/06 A Plan Review of plans submitted reveal significant deficiency in the proposed Exhaust Hood Design and its effect on Balancing ofthe Building's HV AC System. It should also be noted, that there is evidence at this point the owner has installed some form of exhaust as there is a new exhaust vent termination penetrating the South Wall where the Pizza Oven is installed. 11/2/06 A Plan Review of revised plans submitted continue to reveal significant deficiency in the proposed Exhaust Hood Design and its effect on Balancing of the Building's HV AC System. 1/16/07 Ron Hansche, Architect, who submitted the previous 2 plans for review advises Mr. Sosnoski has not yet given direction on how to proceed despite requests to do so. He indicated Mr. Sosnoski is supposed to get in touch with him today to give some direction. 1/23/07 Ron Hansche, advises that Mr. Sosnoski has not given him direction yet. 2/05/07 Ron Hansche confirms in phone conversation that Mr. Sosnoski has not followed through to advise him how to proceed with making modifications to the Plan Submittal to gain approval. As a result three citations were issued for 30 days each. Per the Municipal Code, the citations could have been issued for a greater number of days as each day represents a separate offense. That is not the intent ofthe citations. This office would rather see the money spent toward compliance. However the amount does need to be of a size to encourage compliance. While Mr. Sosnoski has complained about the amount of the citations ($6525 each,) part of the decision process involves assessing whether a lower amount would encourage compliance. (I.e. would the same citations issued for a one-day violation of217.50 each be incentive enough to promote compliance.) April 11, 2007 At the pre-trial on April 11 , Mr. Sosnoski's brother indicated they were again working with their architect to modify the plans previously submitted to show how compliance with the exhaust hood and HV AC System Balance requirements would be accomplished. Recognizing there seemed to be an understanding or recognition that compliance must be provided, I asked our Attorney to adjourn the matter to July to offer an opportunity to gain compliance. I advised Mr. Sosnoski that if compliance were obtained prior to the July court date I would have our Attorney file a motion to Dismiss without Prejudice. April 23, 2007 Mr. Sosnoski's architect forwarded an e-mail sketching out the exhaust and make up air requirements he determined would satisfy the balancing requirements. This was forwarded to our Code Consultant/Plan Examiner for review. As I was out of town at a conference on April 25th - 27th, I was not able to attend to this that week. April 30, 2007 We called Mr. Hansche to discuss and confirm the numbers in this e-mail. These numbers were found to be acceptable. Mr. Hansche then advised he would modify his plans and forward for review/approval. May 1,2007 The modified plans were received late afternoon. May 2, 2007 Mr. Sosnoski called and left a message inquiring of the status. I was not able to return this call due to other pressing obligations. Additionally, our Plan Examiner was absent this day, so I wanted to get an assessment from him as to his projection when he would review the submittal. May 3, 2007 On Thursday morning, Mr. Sosnoski came to the office during permit issuance hours. I was not able to immediately respond to him at the counter as I was in conference with an inspector regarding another project. Mr. Sosnoski was attended to in about 10minutes:} advised him that our Plan Examiner had a couple of reviews that were being wrapped up and his would be next. I advised him we would have his results of the plan review in the mail no later than Tuesday, May 8th. He then put on quite a performance about his opinions of me and this office and all but demanded that I drop everything I was doing and complete the review myself. I tried to explain to him that I have other duty commitments that needed to be addressed and that I would not be able to conduct the review any quicker than our Plan Examiner. May 4,2007 A review of Mr. Hansche's resubmittal revealed he had changed the values previously sent bye-mail showing how the HV AC System would balance. Additionally the plans still continued to show non-compliance with the configuration of the hood in relation to the adjoining walls and the pizza oven. The Plan Examiner and I then called Mr. Hansche about this and we were unable to communicate to him over the phone what needed to be done to design the system to gain compliance. At this time, I then asked Mr. Hansche to meet me on site so that I could physically show him how the hood has to be configured to meet code compliance. We set an appointment for 3:30 p.m. that afternoon. I met Mr. Hansche for the aforementioned appointment. During this inspection I pointed out to Mr. Hansche the clearance the oven must have to the rear and side walls as well as the physical size of the hood and exhaust rate that must be provided to meet the code design requirements. It became evident Mr. Hansche was trying to avoid a design that would require the owner to relocate existing gas lines and modification of a counter/table to the side of the oven. I explained to Mr. Hansche, while that is understandable, we are required to review for and obtain compliance for the exhaust hood code requirements, even if it does result in additional work for the owner. Mr. Hansche advised he would have the revised plan and HV AC calculations (exhaust and make- up air values) early Monday morning. I told him we would make this review a priority so the owner can get working on this ASAP. May 7, 2007 Mr. Hansche delivered the revised plans and HV AC System Balance Calculations. The revised plans and calculations have been Conditionally Approved and the Review Letter has been prepared and mailed. fu addition, the letter has also been faxed to Mr. Hansche. t i~ Summary Please note the plan and calculations that have been approved will require a significant amount of effort and work on the owner's part.
