Code violations existing in your Rooming House located at
508 Union. These violations were to have been corrected
on or before December 31, 1985, or your Rooming House Li-
cense would be reviewed for revocation.

Rooming House License
Having been notified on November 13, 1985 and on
December 1, 1986 that failure to correct cited violations
at 508 Union Avenue would result in revocation of your
rooming house license and having failed to correct those
violations, you are notified that the rooming house license
for the abovementioned address Is revoked effective immed-
iately.
Refer to Section 16-26 and the following Sections of
the Oshkosh Municipal Code for further information.

Dear Mr. Dake:
It has come to my attention that you have requested
a reinstatement of your rooming house license #436 for
508 Union Avenue.
The license was revoked on January 13, 1987, after
determining that violations of the Wisconsin Administra-
tive Code relating to residential occupancies had not been
corrected.
As indicated in my letter to you dated November 8, 1985;
Item #16, the replacement of a bathroom floor in accordance
with ILHR 52.57 was required or the bathroom could be elimi-
nated by a 1 icensed plumber. You will note on the rooming
house license certificate that I al lowed a period of one
year for the correction of the violation.
On January 6, 1987, made a reinspection of 508 Union
Avenue to determine compl iance with Item #16. During the
inspection, I found that the violation still existed.
Therefore, if you wish to have your license reinstated,
you can request a hearing before the Housing Advisory and
Appeals Board as provided in Section 16-26 of the Oshkosh
M u n i c i pal Cod e .

PROCEDURES AND REGULATIONS CITY OF OSHKOSH
HOUSING ADVISORY AND APPEALS BOARD
ARTICLE I
HOW CONSTITUTED
1. This Board was established in accordance and to comply
with the City of Oshkosh Minimum Housing Code.
2. The official title of this Ordinance shall be "City of
Oshkosh Housing Advisory and Appeals Boardll.
ARTICLE II
MEMBERSHIP
I' 1. The Board shall consist of five (5) members appointed by the
City Manager for three (3) years, except that of those first
appointed, one (1) shall serve for one (1) year, two (2) for
two (2) years, and two (2) for three (3) years. The members
shall serve without compensation. One alternate member shall
be appointed by the City Manager for a term of three (3Y years
and shall act only when a regular member is absent or refuses
to vote because of interest.
2. The officers a~d duties of the Board shall be as follows:
a. Chairman shall be designated by a majority vote of
the Board and shall preside ~t all meetings of the
Board; supervise the work of the Secretary; and
decide all points of procedure .unless otherwise
directed by a majority vote of the Board.
b. Vice-Chairman shall be selected by a majority vote of
the Board and shall preside at meetings in the absence
of the Chairman.
3. Ex-officio members of the Board:
a. Secretary shall be the Housing Inspector; and he shall
prepare all correspondence for the Board; receive and
file all 'appeals, applications, papers and records;
prepare, publish and mail all notices required; prepare
and keep all minutes and records of the Board's proceedings.
4. Official Oaths shall be taken by all members' in accordance with
Section 19.0l of the Wisconsin Statutes within ten (10) days of
receiving notice of their appointment.
5. Vacancies shall be filled for the unexpired term in the same
manner as appointments for a full term.

ARTICLE III
MEETINGS
1. Meetings of the Board shall be held on the second Wednesday
of every month and at times as the Board may determine; unless
no appeals are pending. All meetings shall be ~en to the.
public.
2. Quorum for any meeting shall consist of four (4) members, but
a lesser number may meet and adjourn to :'a specified time.
3. Order of Business at meetings shall be substantially as follows

Communications
Unfinished Business
, Hearing Continuances
Hearing of New Appeals and Applications

4. Minutes of the proceedings and record of all actions shall be
kept by the Secretary, showing the vote of each member 'upon
each question, the reasons for the Board's determination and
its' finding of facts. These records shall be immediately
filed in the Department of Community Development and shall be a
public record.; .
ARTICLE. IV
APPEALS AND APPLICATIONS
1. Any person affected by any notice which has been issued in
connection with the enforcement of any provision by this
ordinance, may request and shall be granted a hearing on
the matter before the Housing Advisory and Appeals Board
provided, that the person requesting the hearing shall file a.
written petition requesting such'hearing, specifying the ground:
thereof, with the Board and with the Housing Inspector. Such
petition shall be filed prior to expiration of the time stated
on the order. The petition for hearing shall be filed with
the Board in duplicate, and shall set forth name, address and a
brief statement of grounds for such hearing.
The Housing Inspector shall forthwith, upon the filing of such
petitions, transmit to the Board all of the papers constituting
the record upon which the petition for hearing was taken.
2. The Board must conduct a public hearing on each appeal or appli<
tion received. Notice of hearing to interested parties shall bE
posted in three public locations, and also mailed to the partie~
in interest, said publication and mailing to be made at least
three (3) days prior to the date of hearing. Ten (10) days
notice must be given to the petitioner and to the Housing
Inspector unless waived by the party to whom said notice is
directed. -

3. Notice shall be given toall'abutting property owners
and the occupants of the dwelling in question.
ARTICLE V
HEARINGS
/. ;
1. The Board shall fix a reasonable time for. hearing of the
petition, which shall be not less than ten (10) days nor' more
than thirty (30) days after the date on which the petition
was filed; provided also, that upon written application of the
Petitioner to the Board, it may postpone "the date of the
hearing for a reasonable time beyond such thirty (30) day
period, if in its judgment, the petition has set forth a good
and sufficient reason for such postponement.
2. At the hearing the petitioner shall be given an opportunity
to be heard and to show cause why such notic~ be modified
or withdrawn. The failure of the petitioner or his
representative to appear at this hearing shall be grounds
for dismissal of the petitioner and shall terminate the
right of further appeal.
3. Order of Business at hearings shall be substantially as follows:
Statement of the case by the Secretary
Explanation by the Chief Inspector
Applicant's side of the case
Testimony of interested property owners
4. An applicant may withdraw his appeal or application at any: time
prior to decision thereon.
ARTICLE VI
POWERS OF THE BOARD
Powers of the Board in compliance with Section 4 of the Minimum
Housing Code.
1. Hear appeals.
To hear and decide appeals where it is alleged there is an
error in any order, requirement, decision or determination
made by the Chief Inspector in the enforcement of the
Minimum Housing Code.
2. The Board may modify any order so as to authorize a variance
from the provisions of the Minimum Housing Code when because
of special conditions, a literal enforcement of the~provisions
of the Code will result in unnecessary hardship, provided
that the spirit of this Section is observed, public health and
welfare secured, and substantial justice done.
3. The Board shall have the power to administer oaths and
affirmations in connection with the conduct of any hearing
held in accordance with the provisions of this ordinance.
4. Powers of the Board limited
The Board has no other powers than those above specified.

~ ARTICLE VII
DECISION'
::
1. Decision. The Board shall render its' decision within thirty
(30) days after the final hearing and shall transmit a signed
copy of the Board's decision to the appellant or applica.nt,
and Housing Inspector.
2. Voting. The concurring vote of three (3) members of the Board
shall be necessary to correct an error; grant a variance; make
an interpretation; and permit a utility, temporary, unclassified
or substituted use.
3. Personal Interest.

a. No Board member shall participate in the decision of, or
vote upon, any case in which he shall be interested, directl:
or indirectly; and the Chairman shall direct the alternate
member to act in his stead.
b. Except at public meetings of the Board, its' members shall
not discuss any specific appeals scheduled or likely to
come before the Board with applicants, their representatives
or others with a direct interest. Questions of fact and
clarification concerning these cases are normally addressed
to the Director of Community Development and/or Housing
Inspector.
4 . Conditions .: Condi tions imposed with respect to any permit shall
be stated in the minutes embodying the Board's decision and
shall also be set forth in the permit.
a. Housing Permit
If the Board sustains or modifies such order, the owner,
operator or occupant as the case may require, shall comply
with all provisions of such order within.a reasonable
period of time as determined by said Board. After a
hearing in the case of any notice or order suspending any
permit required by this Ordinance, when such notice order
has been sustained by the Board, the Board shall order
the permit revoked.
5. Amendments. The~e Rules of Procedure may be amended or revoked
by" a maj ori ty vote of the Board at. any meeting, provided all
the members are notified. Suspension of the rules may be
ordered at any meeting by a vote of not less than four (4)
members. .

NOTE: 1. The Rooming House License card must be displayed in a conspicuous
place within the co~~unal areas of the building.
2. The Housing Inspector must be notified within forty-eight hours
after any transfer of legal control of any licensed rooming house.
3. This license may be revoked at any time violations of the Minimum
Housing Code are not corrected by a date specified on a notice
listing the violations.
4. The license must be renewed for continued use of the rooming house.
Application for renewal should be made thirty days prior to
eKpiration date. Application forms for renewal of the license are
available from the Housing Inspector. The payment of a license
fee of Ten Dollars per license must accompa~y the application. No
license will be renewed unless the applicant owner agrees on his
application to such inspection as the Housing Inspector may require
to determine whether the rooming house is in compliance with the
provisions of the Minimum Housing Code.
