Home My WebLink About07-168 JUNE 12, 2007 07-168 RESOLUTION (CARRIED 5-2P LOST LAID OVER WITHDRAWN PURPOSE: GRANT EASEMENT / WEST SIDE 400 BLOCK NORTH MAIN INITIATED BY: NORTHERN TELEPHONE & DATA PLAN COMMISSION RECOMMENDATION: Approved w/conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant an easement to Northern Telephone and Data (NTD) within the parking lot on the west side of the 400 Block of North Main Street for the installation of underground cable facilities, per the attached, with the following conditions: 1) The facilities are installed in a manner that is approved by the Department of Public Works with no modifications or changes in construction procedure without prior approval by the Department of Public Works. 2) If no longer needed the facilities be properly abandoned and removed in accordance with City standards and under the direction of the Department of Public Works. 3) Any problem that may arise as a result of the placement of the facilities be the responsibility of the petitioner/owner to correct in coordination with the Dept. of Public Works. 4) All appropriate permits be obtained prior to the start of placement of the facilities. 5) The facilities be modified or removed immediately upon the request of the City. 6) The petitioner/owner secures and submits to the City Clerk a separate insurance policy which names the City as an additional insured with a minimum coverage of $200,000 per person and $500,000 in general aggregate. 7) It is the responsibility of the petitioner/owner to file in a timely manner a new insurance certificate with the City Clerk upon expiration of an existing certificate. Failure to do so will result in the revocation of the easement within 10 days of notice. 8) The petitioner/owner execute a hold harmless agreement with the City. Box 1130 Oshkosh, WI 54903-1130 December 11,2006 Subject: Follow-up Information for City Easement Application - NTD Dear Steve: This letter is a follow-up to our meeting on 10/31/06 regarding Northern Telephone & Data Corporation (NTD) and its plan to install underground cable facilities to better serve Main Street businesses and apartments in the block between Algoma Boulevard and Church Avenue in downtown Oshkosh. This addition is necessary to improve service quality and provide advanced services for NTD customers who are presently served via older SBC cable facilities. Per your request, a comprehensive field survey was conducted to document the existing underground facilities along the proposed NTD cable route. The field survey work was carried out on November 13-14th after allowing time for all utility locate requests to clear through Diggers Hotline. Enclosed are tvvo copies of an updated plan sheet showing the proposed underground NTD facilities in relation to the existing facilities. Only minor adjustments were made on the proposed NTD facility routmg compared with our previous plan submitted on 10/11/06. A couple of comments are in order: 1. Other than crossing laterally above the water main and storm sewer main at the south end of the parking area, the proposed NTD facility generally parallels the water and storm mains with a separation of 10 feet or more to address your concerns regarding water & sewer maintenance and future City upgrades. 2. As requested, we have laid outthe proposed NTD cable facilities to maintain a minimum horizontal separation of 4 feet from the City lighting electric conduit/cable. There are a couple of minor exceptions at the Kitz & Pfeil loading dock area due to constraints imposed by other existing facilities. 3. All lateral crossings of existing storm sewer, water, gas, WPS electrical conduit system, etc. will qe made with a minimum vertical separation of 1 foot. These crossings will typically be made by physically exposing the existing utility then boring past either above or below as required. OF PUBUC WORKS OSHKOSH WISCONSIN Dear Steve: This is a follow-up my 12/11/06 letter (copy enclosed) and our subsequent telephone conversations over the winter regarding Northern Telephone & Data Corporation (NTD) and its need to construct under- ground cable facilities to better serve its business customers and apartments along Main Street in the city block between Algoma Boulevard and Church A venue. At your request, we have made the following changes to our previous plans submitted last November and December: 1. Adjusted the NTD facility along the south end of the City parking area to parallel the WPS conduit system rather than crossing as previously depicted on our 12/8/06 plan. 2. Adjusted the NTD faCility along the north end of the project to run parallel and lie within the public alley corridor for approx 64 feet where cable terminates at address 465 Main Street. 3. Added clarification note regarding the vertical datum being referenced to Benchmark # I as called out on the City Parking Lot Plans rev 9/29/97 that you provided to us at our meeting on 10/31/06. 4. Revised and updated the Legal Description for the requested City easement to account for the above proposed NTD facility adjustments. Any areas beyond the city property will be handled individually with the respective property owners. 5. I checked with Kathy Sylvester ofDNR (920) 424-0399 on 11/10/06 regarding the reported site contamination in this area. She stated this was a "closed case" as of 2/6/2004 and referred me to Tom Verstegan of Wis. Dept. of Commerce PECF A prograIn - phone (920) 424-0025. Tom was contacted on 11/13/06 and he informed us that the reported oil contamination was minor and confined to an area along Division Street near the Kitz & Pfeil service shop buildings and would not be impacted by the NTD buried cable project. I hope this additional information adequately addresses your previous questions and concerns as it would relate to the City of Oshkosh granting an easement and construction approval for this project.
