At present there are no such desigrtations. Anothe~ condition of the variance was that the Zoning Officer was to have been in- formed of any change in the written parking aggreement which provided the four (4) offsite spa~es. This also has not been done. ' Therefore parking stalls atl06Wiscons~n St. shall be designated/marked with paint for four (4) visitor stalls and four (4) tenant stalls and four (4)'offsite parking stalls shall be designated by written aggreement.at another site. 'Marked stalls to be legal' parking. Garbage and rubbishshal 1 be stored ,to the rear of the building but easily accessible to the c9llectors. The dumpsters which are being stored next tb the City side- walk shall be removed to the rear of th~ building. Kinne ~ Director of Co ity D May 25, 1988 FROM: DATE: RE: Delta Sigma I reviewed the situation per 555 Algoma Blvd. and 306 Wisconsin st. with our Housing Inspector, Bruce Luedtke, and it would appear that the City has handled this situation in a reasonabl~ manner, and I would certainly not recommend that any Ordinance amendments be considered in regard to their complaint. ' Relative to the points which were raised by Mr. K~eger, it should be noted that: , The "fraternity house" at 555 Algoma Blvd.' has apparently been rented by the "fraternity" and/or individuals associated with the fraternity, only in the last few years, and is not a legal multi-family structure under the ZQning Ordinance. Apparently, the City found in approximately 1984 that the structure was being illegally converted from a two-family structure to a three family structure, and orders were written. As a result, the structure was:required to be maintained as a two family structure -- whicn is its present zoning status. Due to its status as a two family structure, eacq dwelling unit cannot, therefore, include occupancy by more than four (4) persons that are not related. The Housing Inspector believes there may be more than four persons living in each unit, and this would constitute a violation of the Zoning Ordinance. Hqwever, no orders have been written in this regard. An impo~tant point here family structure with fraternity i I In regard to the question on the driveway, ~t should be seen that this two family structure has a drivew~y off Wisconsin st. that leads to a rear garage. The arealc; off Wisconsin to the building, however, is part of the pro~erty's required front yard, and that portion not in the exis~ing driveway use cannot be put into additional parking (Section 30-30(B) (5) Off-Street Parking Regulations prohibitspa~king in required setbacks). Obviously, we'd be creating' an undesirable community-wide condition if we were to amend,our Ordinance to deal with a specific problem relative tb a two family structure that is probably in violation; of our Zoning Ordinance per its current use. A driveway is that area. reasonably required to move vehicles from th~street into the property, and it cannot be additional parking areas, such as the yard areas where gravel has obviously been placed for additional parking. I would note, however, that the graveled area to the rear of the building could be u~ed for parking, since that falls outside the required setback. : I In regard to the question of citationsjwarpings, it would appear that the City has been more than fair: relative to both 555 Algoma Blvd. and 306 Wisconsin st. Pet 555 Algoma, Mr. Luedtke issued four written warnings in 1987 and none in 1988, and no citations. He has also given: verbal warnings relative to the illegal parking. Per 306 W~sconsin st., our records show that 26 written warnings have been issued, four to five second warnings, and four citations issued, of which three were dismissed. I would certainly question Mr. Krueger's statement that "The recent rash of parking tickets comes as a shock to us as there were no warninas (his emphasis) issued in addition to the 'abnormally high ticket penalties." ! I I The property at 306 Wisconsin is apparen~ly the primary trouble spot relative to the parking probl~m, and I have attached a copy of the Board of Zoning Appeals minutes and staff report per action that was taken in 19~3. In summary, I believe the actions taken by staff haVe been more than fair (considering the number of warnings issued versus the single citation that was not dismissed), and it would appear that the I problem associated with the properties is self creaied. I Mr. Goldthwaite stated that he has a 2-car garage with a on~ and one- half garage door. He inquired if the door was big enough for two cars. Mr. Selmer repl ied that he believed it was 161, which is standard. ! Motion by Dan Goldthwaite to approve the variance. Motion s;econded by Anne Hintz. Motion approved 5-0. Mr. Rosenquist informed Mr. Selmer that the Building Inspector had indi- cated that when he obtained his permit, he would have to indicate the small shed that is on the lot, on his site plan and get a pdrmit for it. Mr. King stated that the appellant is requesting the Board to waive the requirements for 411. The area in question, does contain many two car garages. The granting of this appeal does not grant speci~l privileges to the appellant that others in the neighborhood do not alrdady enjoy. The granting of the variance will have no effect on light or air and if not granted, the appellant would have had to knock down s,ome trees. Mr. King stated that the appeal seemed reasonable. ' Mr. Goldthwaite felt that perhaps the appellant should have :requested another foot. He was concerned that the appellant might en~ounter some prob I ems. II. Appeal of James Larson, owner of 306 Wisconsin Street:, proposes to install four additional dwelling units in an exist:ing bui Iding. I Mr. Larson replied that all parking stalls exist at this tim~ and the area is presently graveled. He stated that it is his intention to rectify 'I the garbage situation and block off the area. Mrs. Hintz inquired as to access to the property. Mr. Larson responded that the entrance is by the front bay window and they will exit out the back. Mr. Hiller stated that he has driven past the area a number of times and I has seen the parking. He inquired as to how long Mr. Larson has owned the building. Mr. Larson believed it has been about 2 1/2 years. Hr. Miller inquired of Mr. Larson is he was aware of the paiking, cleanup and everything that should have been taken care of when the ~ance studio I was proposed. ' Mr. Larson stated that he will probably be blacktopping the ~rea because new plumbing will need to be installed for the units. Mr. Miller inquired as to Mr. Larson1s plans. Mr. Larson stated that there is not quite 2,800 square feet ,inside. Each un it wi 11 have four bedrooms. He stated that other improverrientswould need to be done inside, but he did not want to sacrifice the exterior of the I ' . bui 1ding. I i Mr. larson replied that he agreed, but with the additional pa~king, it did meet the code. Mr. Goldthwaite stated that restaurants come and go in Oshkosh. What happens when Mars goes. Mr. Larson stated that he did not know. He stated that his agreement is with the present owner. Mr. Larson felt that perhaps a more ~egal document will need to be drafted. Mr. Goldthwaite felt that there should be or it could cause trouble for the apartment in the future. ! Mr. larson stated that in the past he has checked into other parking areas in the vacinity, but no one cared to make an agreement at the'time. Mr. Rosenauist stated that alot of the stores in the area are zoned C-3 and do not have off-street parking that is required. Mars me~ts their parking requirements and those of other businesses in the are~. i Mr. King inquired of Mr. Rosenquist if the lease meets the pa~king require- ments for the City. Mr. Rosenquist replied that it does at this point. Mr. King inquired of Mr. Larson if he would object to.a condition attached to the appeal that he notify the City of any changes: in the parking requirements. Mr. larson felt that it was a good idea and has no objection, 'as long as it was fine with theneighbors. Problems with parking include blocking driveways of some of the neighbors. Most of these problems have been c~eated by the dup 1 ex on the corner. I I Ms. Franci sRatzburg, 549 Al goma Boulevard, stated that her property is adjacent to Mr. larson's and she is concernedwith ,the parking problem. Because of the location of her garage and businesses il}the a~~<:i' she usually has Justenough room to get out of her driveway. Mr. Rosenquist was not sure of what parking arrangements there presently are at the house and it could possibly be a legal non-conformini use. Appeal of Garry Decker, owner of Lot 13 in Wentzel's Subdivision, proposes to construct a duplex on a 5,555 square foot lot, whereas 6,000 squate feet of lot area is required. Mr. Rosenquist stated the lot size, as corrected by Mr. Dec~er, is 50.5' x lID', thereby having 5,555 square feet. The appellant is Iproposing to construct a duplex, but 6,000 square feet of lot area is required. t , Mr. Garry Decker, 1113 Oregon Street, stated that because o~ the error on the original agenda, he hoped that there were no negativd effects on the appeal. Mr. Decker stated that the lot is 445 square feet Short of the 6,000 square feet required for a duplex. He stated that ab~ut one year ago he came before the Board and was denied his variance. The area is industrial and commercial except behind the lot is zoned single-family.' To the east of the Jot is zoned R-2 and beyond that is M-I; the closer io Ohio Street you get, it I s zoned M-l. Mr. Decker stated that there is no b~ffer between the residential and industrial area and he felt that it is a:n eye sore. Mr. Decker felt that he has an economic hardship. He stated: that he could have a single-family home, but due to the area, it is not a~ appropriate place for a single-family home. Mr. Decker felt that the d:uplexwould increase the tax base for the lot and perhaps put a few peoplle back to work. Mr. Decker submitted a photographed copy of the what the prdposed duplex would look like. He stated that there would be a two car ga1rage and that it wou I d be detached and beh i nd the p r i nci pa I bu i 1 ding. . Mr. King inquired if any conditions of the neighborhood have; changed from one year ago. I I Mr. Decker repl ied that there is a new bui lding to the east ~or the Oi 1 Company. The commercial area has increased but there are no residenti~l buildings. I Mrs. Hintz felt that no one wU 1 build a single-fami ly home iin this area.
