The Department of Commerce has received construction plans for review for the subject project, submitted in
accordance with the provisions ofComm 61.32, accompanied by the owner's request to begin construction work on
the Footings and Foundations prior to Departmeutal review and approval.
This letter will serve as the department's permission to the local building officials to allow construction of the
Footings and Foundations, only, for the subject project prior to review and approval by this department
NO REVIEW OF THE SUBMITTED DOCUMENTS HAS BEEN UNDERTAKEN BY THE
DEPARTMENT AT THIS TIME FOR CODE COMPLIANCE.
In accordance with the provisions of the owner's signed request to begin construction prior to departmental review
and approval, the owner will be required to make any changes after the plans have been reviewed, and to remove or
replace non-code complying parts of the foundations and/or footings.
Prior to the start of construction, all applicable building permits shonld be obtained nom the local authorities having
jurisdiction in accordance with local laws and ordinances Nothing in this approval limits the power of municipalities
to make, or enforce, additional or more stringent regulations, providing the regulations do not conflict with this code
or any other rule of the department, or law.
DEPARTMENT CONDITIONS
I, If this project is in an unsewered area, a sanitary permit must be obtained prior to the issuance of a local building
permit
2. This permission is only for footing and foundation work. Construction of the remainder of the building shall not
take place prior to departmental review and conditional approval of the construction plans,

3. If this construction project will disturb 5 or more acres ofland, an Erosion Control Notice oflntent (NOI) shall
be filed with the department. Optionally, you may also file an NOI for projects disturbing I to 5 acres in order
to comply with additioual federal EPA requirements that became effective for such smaller sites effective on
March 10, 2003.
4. This "Permission to Start" does not include pennission to install any underground plumbing, including
sanitary/stonn sewers, or water or mains. All projects needing submittal per Comm Tables 82.20-1&2 must
have complete plumbing plans, application, & fees submitted and approved prior to commencement of any
plumbing work.

Comm 61.30(3) This review does not include heating, ventilating or air conditioning. The owner should be
reminded that HV AC plans, calculations, and appropriate fees are required to be submitted for review and
approval prior to installation. The submitted HV AC plans shall match the approved building plans.
Comm 61.31(2) The additional loads created by HV AC equipment located on the roof were not included in the
structural calculations. Submit structural calculations with HV AC plans indicating consideration for equipment
loadings.
Reminders
Comm 61.30(3) This review does not include lighting. Comm 63.0001 Prior to installation, lighting plans and
calculations shall be prepared in compliance with the code and properly signed and sealed. The plans shall be
available at the job site as requested by the Department representative or local official.

automatic fire sprinkler system (see NFPA 13). This approval does not include a review of the system. The
owner shall have and make available upon request by the department a copy of the reports docmnenting the
acceptability of the completed system (see NFPA 13-1999, sections 10-1 and 10-2).
Comm 61.36(I)(a) & (b) This approval will expire 2 years after the date of this letter if the building shell is not
closed in within those 2 years. Also, this approval will expire 3 years after the date of this letter if the work
covered by this approval is not completed and the building ready for occupancy within those 3 years.
A copy of the approved plans, specifications and this letter shall be on-site during construction and open to
inspection by authorized representatives of the Department, which may include local inspectors. If plan index sheets
were submitted in lieu of additional full plansets, a copy of this approval letter and index sheet shall be attached to
plans that correspond with the copy on file with the Department. All permits required by the state or the local
municipality shall be obtained prior to commencement of construction/installation/operation.
In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should
conditions arise making them necessary for code compliance. As per state stats 101.l2(2),nothing in this review
shall relieve the designer of the responsibility for designing a safe building, structure, or component.

The submittal described above has been reviewed for equivalency to applicable Wisconsin Administrative Codes and
compliance with Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. The owner, as
defmed in section 101.01(10), Wisconsin Statutes, is responsible for compliance with all conditions of this petition
approval and other applicable code requirements. Plan submittal and approval to the department or its agent may be
necessary prior to construction undertaken per this petition.
Your Petition for Variance of code section(s) noted above has been reviewed.
The code sections petitioned required that properly rated fire-resistive walls be provided based on setbacks to
property lines and that no openings be located on property lines.
The variance requested is to allow an existing building extend over a property line without a rated fire separation.
The intent of the code section petitioned is to prevent the spread of fire across property lines and to base regulation
of buildings per individual owner's typical property rights and responsibilities.
The petitioner submitted the SB-9890 application form including four additional page( s) of supporting documents
and/or plans.
Reviewer's Comments:
1. The local fITe department and/or municipal building inspection department recommends approvaL
2. The petitioner's existing building was extended across the property line in question with the construction of an
addition in 1992. Building euforcement officials did not become aware of the property line until recently.
3. When considered as a single building, it meets the requirements of the building code for unlimited area, either
under the current editiou or under the previous building code, Chs. Comm 50-64 for pre-existing portions.
4. The petitioner has been leasing the adjacent property from another owner.
5. The petitioner proposes to record an agreement between the two owners that would require that neither property
could be sold separately of each other as long as the building extends across the property line, unless the new
owner agrees to the terms of the petitioner's existing lease of the adjoining property.

The proposed agreement and the following conditions ensure that uses of, and changes to, the overall building
may be properly regulated per the applicable building code requirements.

Reviewer's Conditions of Approval:
1. Any change to the building shall be analyzed for building code compliance on the basis of it being a single
building, despite the existence of the property line.
2. If either portion of the building is demolished, properly fire-rated exterior walls and openings shall be provided
for the remaining portion. Egress and other building code requirements may cause additional building
modifications to be made.
3. This petition and submitted agreement shall be recorded with both of the properties. Evidence of recordation of
the agreement shall be provided to the Oshkosh Building Inspection Department.
All of the petitioner's statements of fact or intent included on the variance application fonn, any other documents
submitted to the Department, as well as any other conditions of approval listed below, shall be carried out. Any
recommended conditions of approval by the fITe department and/or municipal building inspection department listed
above shall also be carried out unless otherwise stated below. This variance is specific to the subject petition and
cannot be used for any additional modifications.
This decision will become final unless the department within 30 days ITom the date of this letter receives a written
request for a hearing. A request for hearing should be sent to the address shown on this letterhead. A copy of this
letter must be included with the request for a hearing. The request for hearing should state the reasons for objecting
to the department's decision, because a request for hearing may be denied if it does not present a significant question
in fact, law or policy.

Corum 61.36(1)(a) & (b) This approval will expire 2 years after the date of this letter if the building shell is not
closed in within those 2 years. Also, this approval will expire 3 years after the date of this letter if the work
covered by this approval is not completed and the building ready for occupancy within those 3 years.
The submitted structural component materials HA VB NOT BEEN REVIEWED for compliance with all
applicable administrative rules. The department will rely on, and hold responsible, the building design
professional andlor supervising professional of record for compliance with the rules. The department reserves
the right to formally review the plans in the future if the department determines that such a review is warranted,
and to order corrective actions with respect to the outcome of that review. An exact duplicate of the plan we
have on file shall be available for inspection at the job site. When the total building volume exceeds 50,000
cubic feet, the plan shall bear an indication of review which has been signed or iuitialed by the building designer
of record.
This letter supersedes previous approval letter dated February 18, 2005.
A copy of the approved plans, specifications and this letter shall be on-site during construction and open to
inspection by authorized representatives of the Department, which may include local inspectors. If plan index sheets
were submitted in lieu of additional full plansets, a copy of this approval letter and index sheet shall be attached to
plans that correspond with the copy on file with the Department. All permits required by the state or the local
municipality shall be obtained prior to connnencement of construction/installation/operation.
In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should
conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this review
shall relieve the designer of the responsibility for designing a safe building, structure, or component.
