YOU ARE HEREBY NOTIFIED that the two-story wood frame house situated on the
following described property, to wit:
That Part of Lot Sixteen (16) of Block Thirty-two (32) in ANDREAE'S SUBDIVISION

otherwise unfit for human habitation, occupancy or use; is in danger of structural
collapse; and is in a condition making it unreasonable to repair the same.

THEREFORE, you are hereby ordered to raze and remove this building within thirty (30)
days from the date of service of this order upon you.
YOU ARE FURTHER NOTIFIED that this order is served upon you pursuant to the
terms and provisions of Section 66.0413 VVisconsin State Statutes and in such case made
and provided. If you shall fail or refuse to comply within the time prescribed in this
notice, said building shall be razed and removed by the City of Oshkosh; and the cost of
such razing and removal shall be charged against the property, shall be a lien thereon, and
shall be assessed and collected as a special tax.
YOU ARE FURTHER ORDERED AND NOTIFIED that should you fail to comply with
this order to remove any personal property or fixtures in the above described structure(s)
in accordance with Sec. 66.0413(1)(i) and 66.0413(1)0), VVis. State Stats., within 30 days
from the date of service of this order upon you the City of Oshkosh may store the same,
or may sell it, or if it has no appreciable value may destroy the same. In case the property
is stored and the amount paid for storage shall be a lien against such property and against
the real estate and shall be assessed and collected as a special tax against the real estate if
the real estate is owned by the owner of the personal property and fixtures. If the
property is stored and not claimed by the owner it may be sold at the expiration of 6
months after it has been stored.

Subject: Schedule of Repairs and Compliance
53 Eveline s1.
Mr. Dannhoff, J and D construction will be complete with the repairs to the north
side of the home by next week. I will have the home completely primed and painted by
the 31 st of July. I have got all the windows measured and should be receiving a figure on
the cost of replacement on Monday the 2nd of July. I will be replacing the windows on
the first floor and hope to replace all the windows. Due to the large number of windows
if any are not going to be replaced they will be sealed and painted by the 31 st of July.
The replacement windows and porch will be complete by the 31 st of August. All work
will be complete no later than that date. I will be completing the work myself with help
from family and friends. I have already been in contact with my loan officer from
Associated bank and have been pre-approved for an amount that will allow me to pay for
repairs and replace windows. If you have any questions or comments please contact me

Associated Bank is in receipt of you're May 5, 2007 correspondence concerning violations of
codes and/or ordinances in the City of Oshkosh. We have forwarded a copy of your
correspondence directly on to the current owner, Keith J. Nadjowski and requested him to advise
Associated Bank of his intentions to correct these violations. As you are aware, Associated Bank
is only the mortgage holder of this property and has no rights of possession to the property at this
time. However, if these violations continue and the property continues to have waste committed
against it, Associated Bank would appreciate continuing to be advised of there circumstances.
Again, I should advise you that Associated Bank does not possess or control the property at this
point and any violations should be directed to Keith J Nadjowski as the owner. Also be advised

Brief history review:
Repair orders extend back to 2004, when this office issued a Correction Notice based on
neighborhood complaints to a previous owner to repair the front porch, paint the house and
repair/replace windows. This Correction Notice was issued based on conditions visible from the
street. (This is a significant point as a future inspections will reveal substantial termite damage.)
Citations were issued to the previous owner.
The owner failed to make an effort toward repairs so this office issued an Abatement Order.
After the Abatement Order was issued, the owner came to the recognition that she was not
financially able to make the repairs. She worked with her financial institution to sell the house as
IS.
The present owner, Mr. Nadjowski purchased the house in the spring of2005 after contacting
this office and giving assurances the house would be repaired by August 31, 2005. Toward the
end of August, Mr. Nadjowski requested an extension to November 30,2005 which was
approved. On 12/1/05 another extension was requested and approved to allow until 6/30/06 to
complete the repairs.
An inspection toward the end of June to assess progress revealed significant deterioration to the
North and East sides ofthe house. This inspection revealed termite traps that had been installed
along the north side of the house and it was evident that significant damage had occurred before
the termites were brought under control.
At this time we began communications with the present owner to determine the extent of the
damage to determine if the house could be repaired. After communication by this office and our
attorney (John Blaze1), Mr. Nadjowski made contact with this office to open up the north wall to
assess the extent of damage. There is damage to other areas of the home that need to be
assessed/addressed, but the greatest damage observed is to the North Wall.
This was done in phases so as to try to minimize the extent of dismantling of the wall.
Ultimately it was found the first floor wall studs and sill plate/beam are damaged to the extent
that replacement is necessary. Further dismantling of the wall will need to take place to
determine if the second floor joists and studs are damaged and to what extent if they are
damaged.
Conversations with Mr. Najdowski have pointed him to seek legal advice to determine ifhe has
some recourse with the sale. Ifhe has pursued this, it does not appear it is successful as he has
not indicated such. Discussing the purchase process with him, it was indicated a home
inspection was done, but he has not been clear as to whether the home inspection pointed out the
termite damage. This office has been taking a slower approach on this case due to concerns the
present owner may not have been made aware of the termite damage. This was to offer him an
opportunity to determine ifhe has options to reverse the sale.
To date Mr. Najdowski has not advised this office of any steps being taken to reverse the sale.
Additionally, he has not contacted this office with plans and costs to repair the termite damagein
addition to the original violations that need to be repaired.
It is suspected the costs to repair will prove to be disproportionate with the Fair Market Value of
the house. At this time we should issue a Raze Order. As always, if he can demonstrate the
house is capable of being repaired and he has the ability to make the repairs (vs. dragging this out
for an extended period) we would work with a reasonable schedule.

Met Keith today. He opened up a good portion of the North wall where we found 'severe (this word does not do justice to
what is present) termite damage. Attached are photos. I told him we will need to expose more of the north wall to see
how much of it is compromised (all that is open is damaged.) At this time, with the extreme cold weather approaching, I
told him to get some insulation and Tyvek and close it up for now to wait out the extremely cold weather. I advised him I
expect to hear from him by 2/15 to establish a time frame to expose more.
At this time, it would seem the entire north wall will need to be reframed. There is damage visible in the basement to the
first floor subfloor as well as some floor joist and the basement beams. I told him in addition to determining the extent of
damage to the North Wall, I want to determine if there is damage to the second floor joists.
We have experienced a site with damage similar to this, where the damage started in the basement and we found termite
damage all the way into the attic.
If you have advice to offer, please contact me. Otherwise at this time we are still trying to determine the extent of damage.
I again reiterated that he should be in touch with an attorney about this. He says he had both a home inspection and an
inspection from an exterminator review the house prior to purchase. Neither expressed concern about significant termite
damage. I also advised him it is appearing the house will be a lost cause.

I am representing the City of Oshkosh in the above referenced case. As you are aware, the City
had taken action to'require the prior owner of your property to take certain actions to bring the
property into compliance with the City Code. That Order is still in effect and continues to affect
the property even though it has been transferred to your ownership. It is my understanding that
you have not complied with the Order and have run into additional difficulties in your attempts
do so. The City understands the difficult position that you are in; however, it is imperative that
something be done to move this forward. The City has the option to enforce the existing Order
by scheduling a hearing to ask the court to take certain actions to require compliance with the
Order. The second alternative would be to begin a new action to raze the structure if repairs
were not made.
The City is willing to take such actions but would prefer to work with you. Therefore, please
contact me within the next seven days so we can set up a time to discuss this matter with Allyn

If you recall, this started as a Nuisance Abatement Order/case (painting, window repairs, porch repairs) and Mr. Nadjowski
purchased the property with promise to repair. In following up on the repair efforts earlier this year it was discovered this
house had been subject to severe (very severe) termite damage. Quite frankly, it is my opinion that had the termite
damage been known when the initial order was issued, this office would have issued a Raze Order. However,given the
effort Mr. Nadjowski has put into the property, we have been trying to determine the full extent of damage and determine
what the costs would be to repair the building before rendering such a decision at this time.
I last met with Mr. Najdowski on 11/1 and found significant termite damage. We had a discussion and agreement that he
would open up more of the North wall as well as opening up portions of the east wall to try to determine the extent of
damage.
To date this has not been arranged.
At this time I think we need to pursue additional action to force compliance. Mr. Nadjowski has been slow to respond and
this is further supported by the fact that he did not make all of the repairs by his initial agreement (August, 2005.) Had the
repairs been made, this office may not have become aware of the termite damage. However, it is probably to his benefit
that he did not complete the repairs because I believe it will be found that the costs to repair will prove unreasonable to
merit going forth.
Let me know how you think we should proceed: Raze Order or pursue the Abatement Order that we developed this case
on??

In a recent inspection to determine progress being made with complying with the Abatement of Public
Nuisance Order, significant decay/deterioration caused by a termite infestation was found along the north
wall of the house. While it does not appear there is a present termite infestation, the following areas of
decay/deterioration were observed:
1. Beneath the trim board that covers the box sill area of the floor framing. This was readily observed
on the north face of the house and is suspected on the east face ofthe house since this trim board has
been replaced.
2. The trim board and first course of siding above this trim boardon the north wall were noted as
bowing out, suggesting the weight of the house may be causing the box sill area to collapse.
3. There are many areas of siding where that are decayed/deteriorated or have areas that have been
eaten away by insects. This suggests the termite may have infested the wall stud cavities.
4. There are areas of the floor system (beams, floor joists and subfloor that have been deteriorated by
termite/insect infestation.
Additionally, this inspection revealed you had not made significant or acceptable progress with all of the
repairs and improvements that prompted the issuance ofthe Abatement of Public Nuisance Order
initially. The inspection noted:
1. Many areas were not yet painted (walls, soffit, facia, windows.)
2. The front landing and stairs have not yet been brought into compliance with code requirements.
3. Many screens are in deteriorated condition. It is questionable whether many of the screens can be
restored.
Given the significant insect decay/deterioration that must be repaired, it is probably fortunate that you
did not finish the repairs that prompted the issuance of the Abatement Notice. At this time I must advise
you not to make any other repairs until an assessment can be made to determine the full extent of
damage. It must be determined if the termite damage is limited to the areas noted or if there is termite
damage hidden beneath the siding or in the attic. You must make arrangements to remove areas of
siding in a progression upward from the box sill until it can be seen there is no further termite damage.
An inspection of the attic must also be made to ensure termites did not reach or affect the attic. If
evidence of termite infestation is found in the side walls at the second floor level, then a review of the
second floor framing system must be provided. In short, starting with where termite damage is evident,
you must provide access for inspection in a progressive manner to reasonably determine the extent of
termite damage. Please call me to set up a meeting to discuss how this is to be accomplished.
Once this assessment is done, this office must review the extent of damage and make a determination on
how to proceed with this case. Ultimately we must determine if it appears it would be reasonable to
repair the structure.

I would like to request an extension on the painting and pouches for my home at
53 Eveline s1. I had originally planned to have the jobs completed by the 31 st of August,
but would like to request an extension until the 30th of November 2005. I was slowed
because all the doors where in need of repair to assure the home would be secure. Also
the ease crofts had to be repaired to prevent further damage to the siding of the home. I
have begun to scrape the house and will be trying to complete the job as soon as possible.
The paint on the outside does contain a lead based paint so extra precautions must be
taken not to create dust from the scraping. I can be contacted at the number above and I

The above-entitled matter, having been reviewed by the above court by Honorable Scott C.
Woldt, Circuit Court Judge, presiding, receiving no answer or objections from any of the
defendants, and that all other defendants are in default and the court having reviewed the
documents on file herein and being fully advised in the premises, therefore makes and files the
following findings of fact and conclusions oflaw constituting its decision in this action.
FINDINGS OF FACT
1. That the allegations of the Petition are proven and true.
2. That the premises is located at 53 Eveline Street the City of Oshkosh, which is more
particularly described as follows:
That part of Lot S,ixteen (16) of Block Thitty-two (32) in ANDREAE'S SUBDIVISION
OF BLOCK 32, ill'the Eighth Ward, City of Oshkosh, Winnebago County, Wisconsin,
per Leach's Map of 1894, described as follows, viz:-
Commencing on the Westerly line of Eveline Street at the Southeasterly comer of Lot 44
of said Block 32; thence Southerly, along the Westerly line of said Street, to a point that
is 48 feet Northerly of the Southeasterly corner of said Lot 16; thence Westerly, parallel
with the Southerly line of said Lot 16; 150 feet; thence Northerly, parallel with the
Westerly line of said Street, to the Southwesterly comer of said Lot 44; thence Easterly,
along the Southerly line of said Lot 44, to the place of beginning.
3. Due notice of the pendency of this action was duly filed, after the filing of the
Petition, on November 2, 2004 and more than 20 days prior to the trial of this action, in the
office of the Register of Deeds for Winnebago County, Wisconsin, in the manner and form
required by law.
CONCLUSIONS OF LAW
1. That the premises at 53 Eveline Street in the City of Oshkosh as more particularly
described in the Findings of Fact, constitutes a public nuisance pursuant to Chapter 823, Stats.
2. That the Amended Summons and Petition in the above-entitled action was duly and
personally served on Donna S. King. That Winnebago County Employees Credit Union n/k/a
Winnebago Community Credit Union, Mercy Medical Center of Oshkosh, Inc., Wisconsin
Public Service Corporation, and Winnebago County duly admitted service of the amended
Summons and Petition; That Steven D. Reilly, M.D., S.C. and Remley & Sensenbrenner, S.C.
have been dismissed from this action. That the time for answering said Petition has expired.
3. That the current owner and any subsequent owners ofthe property shall remedy the
conditions that create the public nuisance and make such repairs and alterations as are necessary
in order to eliminate the public nuisance.
4. That the owner of the premises shall have 30 days by which the defect shall be
rcmcdied and the repairs and alterations completed.

5. That if the nuisance is not abated within 30 days, the City of Oshkosh Building
Inspector will be authorized to take such actions as are necessary to abate the nuisance.
. NOW, ON MOTION OF JOHN M. BLAZEL, ATTORNEY FOR THE PLAINTIFF it is
ordered, that an order be entered requiring the nuisance to be abated pursuant to the demand in
the Petition and in accordance with the above findings and conclusions.
JUDGMENT FOR ABATEMENT OF PUBLIC NUISANCE
The court having issued its findings of fact and conclusions of law, enters the following
ordered and adjudged:

1. It is hereby ordered that the owner of the premises at 53 Eveline Street in the City of
Oshkosh, abate the public nuisance on that premises pursuant to Chapter 823, Stats.
2. It is further ordered that the public nuisance be abated within 30 days.
3. If the nuisance is not abated within 30 days, the City of Oshkosh Building Inspector
will be authorized to take such actions as are necessary to abate the nuisance.
4. It is further ordered that the City shall have execution in the common form for the
City's damages and costs incurred in abating the nuisance and the City shall be entitled to a
warrant to the Oshkosh Building Inspector requiring the Building Inspector to abate and remove
the nuisance at the expense of the defendant Nicholson.
5. The expense of abating the nuisance pursuant to the warrant shall be collected by the
Building Inspector in the same manner as damages and costs are collected upon execution or
may be collected by finding the defendant King personally liable for the expenses, as provided in
Section 74.53, Stats. The Building Inspector may sell any items abated or removed as a nuisance
in the manner that personal property is sold upon execution and may apply the proceeds to pay
the expenses of the abatement, paying the residue, ifany, to the defendaht.
6. That the City be awarded court costslrecording costs in the amount of$253.00,
recording of certified Lis Pendens of $14.00, title work in the amount of $50.00, service fees in
the amount of$119.58, together with statutory attorney's fees of$100.00, for a total of$536.58.

He advises me a For Sale sign just went up this past weekend and that two men moved in some time ago. Apparently they are
parking a school bus in the driveway ( I will refer that to Matt in Planning.)
Have you had contact with anyone regarding this property? Is there an update? Does not appear any progress is being made.

Dear Allyn:
The VVinnebago County Employees Credit Union is working with Donna King in an
attempt to find a purchaser for her property. I believe that King may be in default of her
mortgage and the credit union is attempting to resolve the matter without having to begin a
foreclosure.
The credit union representative indicated that the credit union was in contact with two
individuals who purchase homes and remodel them for resale. She further told me that if neither
ofthose parties wished to purchase the property, it would be listed for sale. King has already
had a realtor view the home for a possible listing.
I tQld the credit union representative that we would proceed with this matter but she
should stay in touch with me because, if she found someone to purchase the property, the City
would likely be happy to give that person time to address the matter.

It was my understanding per a previous conversation we would pursue action under ss. 66.0413(2), which seems to be abatement
action related. Meaning we have to get a court order to order the corrections and if the corrections are not made, then the court
would authorize the city to raze. You are correct, I do not want to be in the business of making repairs (the city is not a home
improvement contractor.)
Does this help clarify the route I anticipated taking?

successful with a raze action. (In addition, I noticed that one of the judgment holders was not sent a notice of the defects.
We would have to send a notice to that party to proceed.) Therefore, we shou.ld proceed with an abatement action only.
However, I want to make sure that is what you want to do. Once you indicated that you did not want to be in the business
of hiring contractors to make repairs to property. According to the pictures, this property needs paint and front steps. That
makes it and unlikely candidate for a raze action and a good candidate for a contractor to fix. Can I assume that citations
have not had any effect?

and return it to the Inspection Services Division by the Compliance Date of 6f1/04 CITATIONS ISSUED
