AGREEMENT FOR OCCUPANCY PRIOR TO CLOSING
The undersigned Buyers and SeHer, who are parties to an Offer to Purchase (Hereinafter
referred to as "Offer1') dated October 24,2007, for the sale and purchase of the property
located at 1835 Hickory Lane in the City of Oshkosh, Winnebago County. Wisconsin
(hereinafter referred to as "Property"). do hereby mutually agree that:
1. SeHer hereby permits Buyers to occupy the property prior to the closing of tile
sale. for the sole purpose of installing a fence on the property.
Z. If the sale cannot be consummated, Buyers shall remove the fence and restore
the property to the same condition it was in prior to the installation of the
fence within ten (10) days after receipt of written notice from the Seller of
such fact. Should they fail. to remove the fence and restore the property to the
same condition it was in prior to the installation of the fence, the Buyers shaH
forfeit all the earnest money paid under the Offer as liquidated damages, . This
Agreement shall in no way be considered a substitution of any remedy
available to the parties for breach of the said Offer.
3, Buyers assume all responsibility for damage to the premises occurring on or
after th~ date they commence the construction of the fence and shall hold
SeHer, Coldwell Banker Schwab Realty, Ltd. and any other real estate agent
or broker involved in this t.ransaction harmless against loss by reason of any
claim, demand or action which may be brought against SeHer, Coldwell
Banker Schwab Realty, Ltd. and/or any other real estate agent or broker
involved in this transaction, by any person arising out oftne Buyers
occupancy of the Property for the purpose of installing a fence, .
4. Buyers agree that if Buyers make improvements to Property and Property fails
to close, Buyers waive any claim for reimbursement or any other expense
related to said improvements.
5. Buyers hold SeHer, Coldwell Banker Schwab Realty, Ltd. and lor any other
real estate agent or broker involved in this transaction harmless and waive all
liability against them with respect to installation of allY improvements made
by Buyers.
6. Buyers shaH purchase and maintain an insurance policy or similar insurance
and casualty coverage on Buyer's persona! property or people working on the
property in an amount reasonable to cover any liability and loss related to the
construction of a fence during the occupancy period. Owner shall continue to
hold homeowner's insurance and liability coverage on the Property during the
time Buyers begin work on the property until the date of closing.
THE PARTIES ACKNO\VLDEGE AND AGREE THAT mE TERMS OF THIS ADDENDUM ARE
INCORPORATED A MADE APART OF THE AI\1ENDMENT TO WHICH THfS ADDENDUM
IS ATTACHED. TO AND INCO~;::; HEREIN:
