Dear Sirs:
On November 20, 1984, I inspected portions of your property known
as 1137 Wisconsin Street with Capt. Robert Vajgrt following a complaint
that the third floor apartments had only one exit.
During the inspection I noted the following violations of the min-
imum housing code and Wisconsin Administrative Code, Section IND 160:
A. Third Floor
1. There is no second exit for the two apartments located on
this floor. Second exits are required in all three or more unit apart-
ment buildings and have been since and before 1914 when housing codes
were first established. Therefore a second exit shall be ins~alled so
that the two apartments have two means of egress from the dwelling.
2. The bathroom sink trap in an improper repair. This trap
shall be replaced.
3. There is a large hole in the South wall of the hqllway.
This hole shall be properly repaired.
4. There are holes in the plaster of the walls of the stair-
well to the second floor. These holes shall be properly repa~red.
5. There.are no handrails on any of the stairs from the third
- to the first floor. Handrails shall be installed at a height of 32 in-
ches above the nose of the treads.
6. There is no proper lighting supplied for this stCl-irs to
the first floor. Lighting equivalent to 2.5 footcandles shal~ be sup-
plied.
B. Second Floor
7. The flooring in the kitchen is in poor condition and shall
be replaced.
8. There is a broken pane in the rear stairwell fro~ this
floor. The pane shall be replaced.
C. First Floor
9. The ceiling in the front vestibule is in poor condition
with chipped and peeling paint. This ceiling area shall be repaired. .

10. A doorway has been closed off to create the first floor
apartment. The unfinished drywall used to close this door shall be
properly finished and painted.
D. Basement
11. The area around the sewer cleanout has been dug out and
this area is full of sewage. This shall be corrected by a licensed
plumber.
.12. There is"a gas valve in the North basement laundry area
that is not being used. This valve shall be properly plugged~
13. There are some areas of illegal w1r1ng in the basement.
This wiring shall be removed or replaced by a licensed contractor.
14. There is no rated furnace room or auto closing fire door.
The rated furnace room and self closing door have been required in all
apartment buildings with three or more units since and before 1914
when housing codes were first established. Therefore a rated furnace
room with self closing fire rated door shall be installed to meet all
current codes. The codes were in fact stricter, but have bee~ relaxed
since. Therefore you would only have to meet the less strict code.
Due to the amount of work required to bring this dwelling up to
code, I will await contact from you before I set any inspection dates
for compliance.

Dear Sirs:
On January 23, 1985, I reinspected portions of your property known as
1137 Wisconsin Street to ascertain whether or not there had be~n any pro-
gress in the correction of the minimum housing code violations listed in
my letter to you dated November 29, 1984.
During my inspection I noted that not one of the listed code viola-
tions in my letter had been corrected nor had any of the fire code viola-
tions listed in Capt. Robert Vajgrt I sletter dated November 21" 1984. It
also appears that none of the plumbing code violations listed py the Plumb-
ing Inspector have been corrected either.
Therefore, I will reinspect the property on February 13, 1985 to as-
sure that progress is being made in the correction of the list~d violations.
particular emphasis will be placed on those violations that are detrimental
to the health and safety of the t~nants. If at this time, no corrections
have been made and there has been no contact with this office poncerning
these violations and their correction dates, I will refer the matter to the
City Attorney's Office for possible prosecution.

Dear Sirs:
As of 1/23/85, a re-inspection was made of your property
at 1137 Wisconsin Street, Oshkosh. A,s of that date therre have been no
corrections made on any of the vi'olations found on 11/20/84.
At that time you were given 30 days to comply to code. On about
the first or second we~k of December I talked with Mr. ~hilBird
on the phone for an extent ion of time which he requested at that
time. I agreed to extend item #4 for 30 days to 1/21/8~; item 6
until April 6, 1985; and item #11 until June 21, 1985.
Since there has been no;: effort on your part to comply to any
of the violations, I am now giving you 14 days to comply to all
violations or be subject to a citation and fines of $55.25 per
day, per violation from the first day of the violations, that being
11/20/84. .

It has come to the attention of this office that your building
known as 1137 Wisconsin Street is a multiple occupancy
dwelling with 5 separate living units.
Through inspection, we have determined that proper second exits
do not exist from one or more of the dwelling units and that there
are no fire-rated enclosures surrounding the heating plant (s) 'and
hot water heater(s) .
Second exits and fire-rated enclosures, with a few excep~ions,
have been required~n buildings with three (3) or more dwelling units
~ince 1914 by L~e Wisconsin Department of Industry, Labor and Human
Relations Ind 57 and before 1914 by Ind 164, Existing Buildings.
Therefore, you are requested to contact the B~lding Inspector's
Office within 15 days to discuss plans for bringing your building
into compliance.

On April 22, 1985, I reinspected your property known as
1137 Wisconsin Street to ascertain whether or not progress has
been made in the correction of the minimum housing code violations
noted in my letter to you and Energy Efficient Apartments dated
, November 29, 1984.
During the inspection, I noted that none of the violations
have been corrected since my last reinspection on February 14, 1985,
at which time only (3) violations had been corrected. .
Therefore, I will again reinspect the property on May 22, 1985
at which time I will expect ALL the violations noted in my or~ginal
letter to be completed. If at this time, none of the violations
have been corrected, I will refer the matter to the City Attorney's
Qffice for prosecution and the issuance of citations.
Also during this inspection, I noted the following violations
which shall also be corrected. However, the completion date above
will not apply to these. A reasonable amount of time will be al-
lowed for correction.
~5. There is a sofa in the front of the house unprotected from
the weather. This sofa shall be removed.
16. There is a torn screen in the front storm door. Th~s screen
shall be replaced.
17. There is water damage to the 2nd floor bath ceiling around the
stack. This water leak shall be stopped and the damage repaired.
18. The floor covering in the rear entry is in very poor condition.
This material shall be repaired, replaced or removed.
19. There is a broken pane of glass in the West window of the '"rd
floor hall/stairwell. This pane shall be replaced.

On gune 6, 1985, I reinspected portions of your property known
as 622 Ceape Avenue to assure compliance in the correction of the
minimum'housing code violations therein.
During the inspection, I noted that a few violations still re-
main. In a telephone conversation with you concerning these viola-
tions, you indicated to me that you would be correcting them some-
time in the next week. Please notify me as soon as these violations
have been corrected so that I can clear my books on this property.
I also made an inspection of your property known as 1137 Wiscon-
sin Street to ascertain whether or not progress was being made on the
installation of the fire-rated enclosure around the furnace and water
heaters. During this time, I noted that work had begun but was pro-
gressing at a slow rate.
I would also suggest that you submit plans to the Code Enforce-
ment Office and obtain permits for the reconstruction of the third
floor apartments into one unit. The vacate notices will be e~forced
on these two third floor units if progress is not made in the cor-
rection of this violation. It will also be expected that all ~ork
to bring this dwelling up to ILHR codes will be completed before the
next heating season begins. Failure to comply at this time could
result in having to hring the dwelling up to today's codes whi;ch do
not allow the use of third floor frame, unprotected, dwellings for
apartments.

You are hereby notified that three (3) of the fiv.e (5)
dwelling units located in your building known as 1137'Wisconsin
Street, Oshkosh, WI., shall be vacated within 28 days of this

cated and the remaining unit to be vacated will be your choice.
This action is being taken due to the fact that the building
has been under orders for ILHR Code violations since Nov. 29,1984
and the required corrections have not been completed.
Specifically, the violations are as follows:
I. There are no propersecend exits from the dwelling units
on the t~ird floor.
ILHR 57.03 Number and location of Exits. (1) Number of Exits.
There shall be at least two (2) directions of travel from each
living unit door by means of exits to grade, stairways, interior
enclosed stairways, ramps, fire escapes or horizontal exits.
24 There is no fire7rated enclosure surrounding the furnace
and water heaters.

shall be isolated from the rest of the building by a one (I) hour
fire resistive rated enclosure.
On September 11,1985, we will reinspect the building to as-
sure compl iance with these orders and POST the dwelling units in
question as "Unfit for Human Habitationll. If the dweJ'Jing units
indicated have not been vacated at this time, the matter will be
referred to the City Attorney's Office and citations fssued. Up-
on being vacated, the dwelling units shall not be rented or ad-
vertized for rental until such time that all ILHR Code violations
have been corrected and approved by the Code Enforcement Office,
per AG 134.09 (I) of the Wisconsin State Code.

unit apartment dwelling as far back as 1961. If you can provide .cer-
tification of its use as such at an earlier date, we will be willing to
allow you to bring the building up to code for that date. If not, then
we would require the building be brought up to the code in effect in 1961.
I notified you in writing on June 7, 1985 to submit plans and obtain
permits for the modification of the third floor into one apartment. I
indicated that failure to do so would result in the enforcement of the
first set of vacate notice~ issued. My letter also states that all
ILHR Code vi<;>lations would have to be corrected by the upcoming heating
season.
So far eight (8) letters from this office, the Fire Inspector, and two
from the Plumbing 'Inspector have been mailed concerning this property
since Nov. 9, 1984. A number of the piumbing violations have been
completed, but very few of the Minimum Housing Code and Fire Code violations
have been corrected to date.
Therefore, in reference to the "vacate notices" issued Aug. 14, 1985; If
all the ILHR Code' violations have been corrected and approved, and a letter
with completion dates for the remaining code violations is received, the
present orders to "vacate" will be rescinded.

is protected by a single fuse.

Tenant shall not assign this lease nor sublet the premises or any part thereof without the prior written consent of
Landlord. If Landlord permits an assignment or a sublease, such permission shall in no way relieve Tenant of
Tenant's liability under this lease.

If the person holding the security deposit is a licensed real estate broker, acting as agent, it shall be held in the
broker's trust account. The deposit, less any amounts withheld, will be returned in person or mailed to Tenant's last

will provide an accompanying itemized statement specifically describing any damages and accounting for any amount
withheld. Failure to return the deposit or provide a written accounting within 21 days will result in the waiver of
any claim against the deposit. The reasonable cost of repairing any damages caused by Tenant, normal wear and
tear excepted, will be deducted from the security deposit. Tenant has 7 days after the beginning of the lease term to
notify Landlord in writing of damages or defects in the premises; no deduction from Tenant's security deposit
shall be made for any damages or defects of which notification is given. Landlord will give Tenant a written
description of any physical damages charged to the previous tenant's security deposit as soon as such description is

Tenant agrees to vacate the premises at the end of the lease term or the extended lease term, and promptly deliver
the keys to Landlord.
Landlord may enter the premises at reasonable times and with 12 hours advance notice, with or without Tenant's
permission to inspect the premises, make repairs, show the premises to prospective tenants or purchasers, or to com-
ply with any applicable law or re~lati.on. L~ndlord may en~r with less than 12 hours advance notice upon. specific
consent of Tenant. No advance notIce IS requIred for entry m a health or safety emergency or where entry IS neces-
sary to preserve and protect the premises from damage in Tenant's absence.
If Tenant shall abandon the premises before the expiration of the lease term, Landlord shall make reasonable efforts
to re-lease premises and shall apply any rent received, less costs of re-leasing, to the rent due or to become due on this

Staff report concerning the dwelling at 1137 Wisconsin St.
The owners of the property, Phi 1 and Luann Bird, are appeal ing
Section 16-31 of the Minimum Housing code after their building was
posted as "Unfit for Human Habitation."
This office received a call from the tenants on April 15, 1993
complaining that the roof was leading badly. The owners were aware
and had not repaired it, according to the tenan~s, from the time of
the call to the time of my arrival, at the property, a large
portion of the ceiling in the front entry stairwell had fallen.
Pieces of the ce i 1 ing were 1 arge enough to have caused seri ous
injury to anyone hit by them.
An inspection of the building, which was being illegally used as a
rooming house with all twelve persons on one lease, revealed
numerous violations of the Minimum Housing Code, Property
Maint~nance Code and Wisconsin State Administrative Code. A total
of 73 obvious violations were noted. The inspection was made with
John Sullivan, the Building Inspector, who was summoned after my
arrival because of the conditions I was observing. Attached is a
copy of orders issued.
Due to the immediate danger of falling plaster and the fact that
the bui lding did not meet the occupancy fire separation
requirements of ILHR 50-64, the building was posted as unfit and a
placard was taped to the front door.
Written notice was issued to the owners and to the tenants through
the mail the day the building was posted.
The owners have appealed Section 16-31 per section 16-25 of the
Minimum Housing Code, however, their appeal was not received in
this office until April 30, 1993, fifteen days after the building
was posted unfit. Section 16-25 requires that the appeal be made
within five (5) days of the order.
Safety is the main issue in posting this building unfit. In the
opinion of both the Building and Housing Inspectors, the building
is not safe and should not be used for human habitation, occupancy
or: use until such time it is brought into compliance with all
applicable codes for this type of building use.
