HomeMy WebLinkAbout07-111 MARCH 27,2007 FIRST READING APRIL 10, 2007 SECOND READING 07 -1 00 07 -111 ORDINANCE (CARRIED 6-0 LOST AS AMENDED LAID OVER WITHDRAWN PURPOSE: AMEND ROOM TAX I SET ALLOCATION AMOUNTS INITIATED BY: CITY ADMINISTRATION - Upon Recommendation by the OSHKOSH CONVENTION AND VISITORS BUREAU THE COMMON COUNCIL OF THE CITY OF OSHKOSH DO ORDAINS AS FOLLOWS: SECTION 1. That Section 8-1.1 (B) of the Oshkosh Municipal Code pertaining to HOELlMOTEL ROOM TAX is repealed and recreated to read as follows: (B) Pursuant to Section 66.0615 of the Wisconsin Statutes, a tax is hereby imposed on the privilege and service of furnishing, at retail, of rooms or lodging to transients by hotel keepers, motel operators and other persons furnishing accommodations that are available to the public, irrespective of whether membership is required for the use of the accommodations. Such tax shall be at the rate of ten percent (10%) of the gross receipts from such retail furnishing of rooms or lodging. Such tax shall not be subject to the selective sales tax imposed by Section 77.52(2) of the Wisconsin Statutes. The proceeds of such tax shall be remitted monthly to the City Treasurer. (1) Subject to any superior obligation for debt service and operations related to the Oshkosh Centre not otherwise met by the following allocations, the treasurer shall distribute the receipts on a monthly basis, as follows: a. the City shall retain the first two percent (2%), and the full amount of all receipts attributable to 1 N. Main S1. b. the Oshkosh Convention and Visitors Bureau, hereby designated as a tourism entity as that term is defined in Sec. 66.0615, Wis. Stats., shall receive the next one percent (1 %), except that portion of this one percent (1 %) attributable to 1 N. Main S1. c. the remaining seven percent (7%) exclusive of receipts attributable to 1 N. Main S1. which the City shall retain, shall be divided as follows: i. 19% to the Grand Opera House Foundation ii. 80% to the Convention and Visitors Bureau iii. 1 % to the City of Oshkosh for Centre Operations MARCH 27,2007 FIRST READING APRIL 10, 2007 SECOND READING 07 -1 00 07 -111 ORDINANCE CONT'D d. Provisions related to City retention of the receipts attributable to 1 N. Main S1. shall automatically be repealed upon City repayment of the current indebtedness on the Centre. SECTION 2. Provisions within any agreements between the City of Oshkosh and the Oshkosh Convention and Visitors Bureau, and the Grand Opera Foundation, which have a different allocation formula or payment schedule, are terminated. SECTION 3. This ordinance shall be effective upon passage and publication as provided by law, for all receipts on or after 12:01 a.m. on May 1, 2007. Upon final repayment of the convention center debt as of the date of passage of this ordinance provisions related to the additional 2% increase are repealed and the room tax is reestablished at 8%. **Bold & Italics indicates amendment.
