Hildebrand Subject: 842 W. 11th Ave. To: City of Oshkosh Inspection Division I received a Correction Notice in February for my rental property at 842 W. 11 th Ave. in Oshkosh. There were four separate items listed in the notice. The first two items (MUN-17-36B's) have been resolved. However, due to various reasons the other two items have not been resolved. Item #3, MUN l7-36A indicates that my siding needs replacement, all my widow trim needs to be maintained, and the garage door needs to be replaced and/or repaired. In regards to item #3, I fully agree that the windows need to be painted or wrapped. I was planning on installing new windows and having the exterior window trim wrapped or painted. At this time I am waiting for estimates to have the widows and trim work done. I am planning on having this work completed by the end of the summer or at worse case before the winter. It just depends on when my contractors can get at it. As for the siding on the house, there is no way I can afford to have the siding replaced this year. I was planning on having the house resided sometime in the next couple of years. I have pictures from when I bought the house 16 years ago, and to be quite honest, it doesn't look much different than it did then. The most deteriorated area is on the front porch, which has looked like that since I bought the house. With that said, I will repair the area around the porch this summer, and hopefully have the funds available next year to side the whole house. l[tem #4, MUN 7-8 indicates that the steps which I had repaired by a former tenant are not to code, and need to be redone and brought up to code. As for item #4, I will admit that I had the old steps repaired by a former tenant of mine in exchange for rent. He is a carpenter, and ultimately ended up replacing most of the steps instead of repairing the old ones. I did not obtain a permit do to the fact that we were planning on repairing only, and no structural changes were being made. Apparently if the steps are redone, there needs to be a landing of at least 3' X 3'. Also, it states that I need to bury post in the ground 48", and have compliant hand rails and guard rails. I have no problem bring the steps up to "code", however, both of the steps are on either concrete or asphalt. I am wondering why ifthey are on solid surfaces, and being attached to the house do they need to have post drilled threw concrete of asphalt? Again, do to money and time restraints, I will not be able to get this done in the immediate future. I do however plan to get them up to "code" in a timely manner. Again, it may be the end of summer or fall. In closing, I am hoping that you will not have any problems in issuing me extensions on these items. I want to :assure you that these items will be taken care .of as time and money permit. It is not that I don't want to have my rentals all looking brand new and being updated, but it takes a lot of money to do these things, and the rental market has been a bit tough for the past 5+ years. My expenses such as taxes and utilities keep going up and up, and rental income hasn't changed! Please let me know your decisions on these matters, and get back to me with an answer. The City of Oshkosh Municipal Code requires a permit for any construction related activity including the repair/replacement of steps and installation of siding. Unfortunately, it would appear that the tenant/contractor that you had repair the steps was not aware of the code requirements that would apply to the repairs. When the steps are rebuilt and/or replaced they need to meet current code requirements such as the 3'x3' landing and 48" of frost protection. The landing is to be provided at the top of the stairway (see the pictures attached to this e-mail) and the frost protection means that the landing requires footings with a depth of 48" below grade. In addition to these requirements the handrails/guardrails are required to be compliant which means that the Old/existing handrails may not be able to be used since the steps were rebuilt. In addition the rear jump platform over the porch is non-compliant due to the deck that was installed on the roof. This roof was not designed for floor loading from occupants at the time the roof was constructed. The City of Oshkosh does not want tenants/occupant~ using this area as a deck unless the roof was properly constructed to meet the required loading requirements. In saying this a building permit is required for the installation of the new front and side steps in addition to the rear porch area. The required repairs to the decks will need to be done in a timely manner due to the exits being a life and safety violation in addition to a liability for you as a landlord. As for the siding, the City of Oshkosh Municipal code requires the exterior of every structure to be maintained by the owner in good repair. Any deteriorated siding requires replacement. Once asphalt siding starts to deteriorate there is no other option than to replace the siding. In the past we have extended the timeframes for compliance up to a year from the date of the original correction notice. However, in saying that we also will issue citations if compliance is not achieve by the extended compliance date. Although it is my understanding that you would like to re-roof the house in addition to wrapping the windows this will not eliminate the need to replace the siding. As a landlord in the City of Oshkosh you are required to have your property meet the Minimum Housing and Property Maintenance Codes. Even if you bought the property in it's current state that doesn't guarantee that the property is meeting the code requirements. I would advise you to ask for a free Minimum Housing and Property Maintenance code when you come into our office to obtain the required building permits. I did receive your phone call, but was unable to call you back before you left. I will need to go over these "violations" with you in person so I have a better understanding of what needs to be done at my property, but I have a few questions/comments to make in this e-mail. As I stated in my phone message, I fully agree with your concern about the mess around the property. I haven't been past the property for the past month or so, so I was not aware of the couch on the deck, the papers and cardboard around the house, nor the truck topper in the back yard. I have left messages with the tenant to clean the place up. If they don't take care of things, I will take care of them. In regards to the steps, and the siding, I am a bit confused. I will admit, that I had the steps repaired in the last five years or so, but that work was done by a former tenant who was a builder, and no alterations were made. The old steps were getting warn and rotten I asked him to make the proper repairs. I was not aware that I needed a permit to repair the stairs, nor did I think that repairing warn out steps would be a violation! The house is 80 years old, and some things get warn out. I am aware that any structural changes need a permit, but I did not think that any type of general maintenance required me to acquire a permit. As you can see in your photos, the steps were repaired, but the original railings were not altered. Indicating that the original step design was not altered! As for the siding, you said the house has to be resided! I have pictures from when I bought the house in 1989, and there have been no major aesthetic changes to the siding or trim since then! Unless painting the trim brown instead of salmon color is a problem. I will admit, the house isn't the prettiest house on the block, but asphalt siding never was designed to win any "pretty" awards. I have been planing on siding the house in the near future, but wanted to put on a new roof, and have the windows updated, and wrapped before doing so. It sounds to me that I have to side the house before doing those other things. As I said, I want to side the house, but that is not usually done until after the rood and windows are done. I am not really sure why I have to side the house, seeing as it has looked virtually the same for the past 18 + years. I know some of'the window trim needs to be painted, and I had that scheduled to be done this spring! Actually I want to have the windows wrapped I am not sure about the 3 X 3 landing, or the 48" of frost protection you are talking about! If it is regards to the back entry area, I don't understand where you are coming from. That area has been there since the house was converted into a Duplex (Tri-plex) originally). Again, the asphalt roof/deck on the upper balcony/entry area was starting to 2 -- deteriorate, so I have the tenant who was a builder repair the area. He suggested that I put a wood decking on instead of the asphalt because it would drain off better, and wouldn't ware as easily. So that is what was done. No structural changes were made. They only thing that was changed was the additJon of legal size railing around the area. The existing railing was less than 3" high, so it was replaced. Again, no structural changes were made! As far as 48" of frost protection, I am thinking you are talking about some type of overhang or roof. None of the areas in question have been altered! They are exactly the same as when I purchase the property! So I am not exactly sure what area you are referring to. I don't mean to sound like a complainer, but money doesn't grow on trees! Being a landlord isn't a "GET RICH" business! I try to do the best I can as a landlord, and try to get good tenants, and have them keep things orderly around the property. But let me tell you, it isn't getting any easier! MOST renters are renting for a reason! If they were model citizens with great credit, and lots of money, they would most likely buy their own homes. I try to help people out, and give them a chance, and unfortunately I usually get burned! I have more and more payments, and get less and less rent! You guys raise my taxes, the utilities are skyrocketing, yet rent is going down! If I had the money to put on new siding, a new roof, new stairs, and new windows, I would have done it. BUT when I get a 40% increase in my property taxes and utilities, and get 20% less rent, updates get put on the back burner!
