Dear Mr. Mathusek;
Thank you for your response regarding this property. Given the circumstances we will continue to work
with you on this situation until the Building Permit expires or it becomes apparent the fence is not being
continually maintained or is not providing the protection intended by the city ordinance. The fencing
requirement was not intended to be a long term solution for providing security to an open excavation or
foundation. Our only goal is to eliminate the nuisance this open foundation poses and I was not aware of
what the status is for this property as far as continuing to proceed with the house.
You are encouraged to monitor this situation continually to ensure the fence is in sound condition. If it
is found the fence is not providing the security needed, whether due to a deteriorated condition of the
fence or the fence simply is not deterring entry into the area, this office will be obligated to pursue this
manner further.
Please keep me informed (236-5051) of your progress in regards to testing and securing approval to
build on these sites. Thank you for your response and your cooperation is appreciated.
