HomeMy WebLinkAbout07-89 MARCH 27, 2007 07 -89 RESOLUTION (APPROVED 7 -0 LOST LAID OVER WITHDRAWN PURPOSE: INITIATED BY: GRANT CONDITIONAL USE PERMITS; APPROVE FINAL PLANNED DEVELOPMENT: A) WEST 6TH AVENUE, BETWEEN 510 AND 522 WEST 6TH B) 1000 PIONEER DRIVE C) INTERSECTION OF NORTH WASHBURN/STH 21/USH 41 A) O'NEILL ENTERPRISES INC, PETITIONER B) DECADE'S MONTHLY INCOME & APPRECIATION FUND C) LOWE'S COMPANIES, PETITIONER PLAN COMMISSION RECOMMENDATION: All found consistent with Standards set forth in Section 30-11 (0) of the Zoning Ordinance and approved w/conditions as noted BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and final development plans, per the attached exhibits, are hereby approved. A) West 6th Avenue; O'Neill Enterprises Inc., petitioner A conditional use permit for construction of a parking lot, per the attached "Exhibit A", with the following conditions: 1) The conditional use permit is revoked if the use of the property to the west is changed to residential. 2) No outdoor storage of equipment or materials. 3) A cross access agreement between the subject property and the property to the west is established, with approval by the Department of Community Development. 4) Setback requirements of the Zoning Ordinance are met or variances received. 5) Fencing style to be approved by the Department of Community Development. 6) Landscaping includes plantings between the parking lot and the right-of-way. 7) Drainage and grading plans are approved by the Department of Public Works. 8) A conditional use permit be approved. B) 1000 Pioneer Drive; Decade's Monthly Income & Appreciation Fund, owner A conditional use permit for a planned development for construction of a marina facility building, including, but not limited to, office space, a "ship store", lounge with kitchen, laundry facilities and restrooms, per the attached "Exhibit B", with the condition that a landscape plan be submitted focusing on foundation plantings with said plan to be approved by the Department of Community Development. Washburn St./STH 21/USH 41; Lowe's Companies, petitioner A conditional use permit for a planned commercial development for construction of a 171,000,:!: sq. ft. retail establishment with associated site improvements, per the attached "Exhibit C", with the following conditions: 1 ) Base standard modification to: -Reduce the number of parking spaces, as proposed. -Reduce the side yard setbacks, as proposed. -Allow a development pylon sign at the eastern entrance, as proposed -Allow the increased light levels at the east property line, as proposed. 2) Lane sizes at north drive entrance be one 14 ft. ingress & two 11 ft. egress with a 4 ft. "rumble strip"/textured mountable median. 3) Cross access easements/agreements between the subject lot and outlots be provided. 4) The group of parking stalls backing out into the northern drive aisle be removed and replaced with curbed island. 5) Parking lot landscape islands be a minimum of 7 ft. Memo ~ To: David Buck, City of Oshkosh From: Chris Perry Date: January 12, 2007 Subject: Lowe's of Oshkosh Conditional Use Permit Project Narrative Existin2 and Proposed Use of the Property: The proposed LoWe's development is located generally at the southwest comer of the intersection of US 41 and SR 21. The development is directly to the south and west of the . proposed Washburn Street relocation. The property is being rezoned from C2 to C2-PD to be consistent with the adjacent developments and to allow for base standard modifications. The properties to the east, west and south are currently zoned C2-PD. The property to the north is partially C2-PD and Ml. The property is mostly vacant open land with the exception of an auto dealership located in the northwest comer of the site that is planned to be demolished in the near future. There is also a small barn along the south side of the property that will be removed. The proposed Lowe's store consists of a 139,410 SF building with an adjacent 31,659 SF enclosed garden center. The Lowe's site is planned with appropriate parking to satisfy . Lowe's requirements and allows for safe and adequate car and truck circulation. The Lowe's site is 13.58 acres which includes the stormwater facilities for the overall 21.76 acre development. The remainder of the developable property will be retained by the current property owner for additional retail/commercial development. Proiected Number of Emvlovees: For a typical Lowe's store there are 175 employees (70% full time and 30% part time). Proposed Landscape Area and Parkin2 Area: The Lowe's site is 13.58 acres (591,545 SF). The building/garden center is approximately 3.93 acres (171,069 SF). The parking and access drives area approximately 6.51 acres (283,575 SF). The landscape areas, open space and detention facility are approximately 3.14 acres (136,778 SF). The adjacent properties are retaiVcommercial developments. The property is also located near US 41 which has over 60,000 cars per day. Substantial landscaping has been provided along the south and west property lines to help buffer the service areas for the Lowe's store. The light fixtures for the Lowe's parking areas are shoe-box style fixtures with downward lenses. The only upward lights are utilized to accent the main entrance into the building. The lights are dimmed in the evening after the store has closed. Surroundine Land Uses and Compatibility: Most of the property surrounding this development is zoned C2-PD and is developed with retail/commercial uses. The property to the north includes an auto sales store, a . gas/convenience store and vacant land. The property to the northwest and west includes a gas station/convenience store, an auto sales store, a hotel, a multi-tenant retail building and a Menard's store. The property to the south includes a book store, small residential type buildings and vacant land. The proposed Lowe's development and proposed retaiVcommercial uses fit well with the SUITotmding land uses and zoning classifications. Traffic Generation: The site development plan, access, utilities and grading have been evaluated and designed with the City's input with respect to coordination with the proposed Washburn Street relocation plans; The proposed access drives have been designed to accommodate the volume of car and truck traffic anticipated for this development. Brieflv eXDlain how the DroDosed conditional use will not have a neeative effect on the issues below. 1. Health, safety and general welfare of occupants of surrounding lands. The site has been designed in accordance with the adjacent surrounding property owners per the zoning and existing uses. The access to the property has been designed in connection with the Washburn Street improvements. 2. Pedestrian and vehicular circulation and safety. Pedestrian circulation has been provided for the development to connect the Washburn sidewalks with each of the proposed uses. Crosswalks and grass buffers will be provided for pedestrian safety. Appropriate car and truckcircu1atlon patterns have been provided. 3. Noise, air, water or other forms of environmental pollution. Landscape buffers have been provided along the south and west property lines to help with noise and aesthetics. Lowe's has a property services group that will maintain the parking facilities and trash collection. 4. The demand for and availability of public services and facilities. The access to the site is provided with the relocation of Washburn Street. Adequate sanitary facilities are provided by the Algoma Sanitary District. Adequate water facilities are provided by the City Public Works. Electric, telephone and gas utility services are available for the project. 5. Character and future development of the area. The proposed development of this property is consistent with the existing surrounding land uses.
