HomeMy WebLinkAbout07-101 MARCH 27, 2007 FIRST READING 07-101 ORDINANCE (CARRIED LOST LAID OVER WITHDRAWN PURPOSE: AMEND FEES FOR WEIGHTS AND MEASURES, LATE FEES AND LICENSE FEES INITIATED BY: HEALTH DEPARTMENT A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND RECREATING SECTIONS 14-11,14-12,29-27 AND 6-19 PERTAINING TO FEES The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Section 14-11 of the Oshkosh Municipal Code pertaining to the Laboratory fees is hereby repealed and recreated to read as follows: Standard Bacteriology Test - shall be deleted. Colilert 24 hr. Bacterial Test - shal be changed to $20.00 Nitrate Screening, Fluoride, or Hardness Tests - shall be changed to $20.00 SECTION 2. That Section 14-12 of the Oshkosh Municipal Code pertaining to late fees is hereby repealed and recreated to read as follows: SECTION 14-12 LATE FEES The license year commences on July 1 and licenses shall expire on June 30th of the following year. If the annual renewal fee has not been paid as of July 1, an additional fee of One Hundred Twenty Five Dollars ($125.00) per establishment shall be required, except for locally licensed/permitted establishments where a Fifty Dollar ($50.00) per establishment shall be required. In addition to any late fee authorized by this section, establishments operating on July 1 without proper license or permit shall be subject to closure by the Health Director. Failure to comply shall result in the issuance of a uniform citation. SECTION 3. That Section 29-17 of the Oshkosh Municipal Code pertaining to Fees is hereby repealed and recreated to read as follows: MARCH 27, 2007 FIRST READING 07-101 ORDINANCE CONT'D SECTION 29-27 FEES Every person or establishment owning or having in their possession any weight, measure or instrument subject to the provisions of this Code is required to possess a valid license from the City Sealer. Fees for licenses required by this Article are due and payable before the issuance of a permit and annually before July 1 of each year, and shall be as follows. DESCRIPTION FEE Annual Base Fee Bundled Firewood Dealer Scales 1 to 30 LBS. Scales 31 TO 1,000 LBS. High Accuracy Scales Heavy Capacity Scale Pharmacy Weights (Per Set) Linear Meters Rules Timing Devices Computing Pumps HS Computing Pumps Vehicle Tank Meters POS Scanners Three or Less POS Scanners Four or Greater Package Checking $ 100.00 $ 40.00 $ 55.00 $ 55.00 $ 60.00 $ 75.00 $ 75.00 $ 40.00 $ 20.00 $ 25.00 $ 55.00 $ 65.00 $ 70.00 $150.00 $235.00 $ 75.00 SECTION 4. That Section 6-19 (A)-(C) of the Oshkosh Municipal Code pertaining to License fees is hereby repealed and recreated to read as follows: SECTION 6-19 LICENSE REQUIRED (A) Pet Store permit. No person or firm shall operate or maintain a pet store in the City without a license/operating permit issued by the Director of Health. The fee for issuance of such permit is Seventy Dollars ($70.00) annually and said permit expires on June 30 of each year. MARCH 27, 2007 FIRST READING 07-101 ORDINANCE CONT'D (B) Commercial Kennel License. The rules and regulations pertaining to licensing, specifically section 174.053, Wisconsin Statutes, together with any future additions, deletions or supplements thereto, are herewith incorporated as part of this Chapter and shall be enforced with the same force and effect as though set forth in full herein. Providing, however, that where such rules and regulations are less stringent than other provisions found in this Code, the provisions of this Code shall apply. The rules and regulations pertaining to licensing shall apply also to cats within the City of Oshkosh. The fee for issuance of such permit is Seventy Dollars ($70.00) annually and said permit expires on June 30 of each year. (C) Boardinq Kennel Permit. No person or firm shall operate or maintain a Boarding Kennel in the City without an operating permit issued by the Health Director. The fee for issuance of such permit is Seventy Dollars ($70.00) annually and said permit expires on June 30 of each year. SECTION 5. This ordinance shall be in full force and effect from and after its passage and publication.
