compliance, several of the violations noted in August of 1992
have not been corrected,
This week questions were raised by the owner about the front
steps. Apparently an attempt was made to repair/replace these
stairs, However, the risers to these stairs are not uniform. An
inspection revealed that one riser is 9 inches high, while the
yest are 7 1/2 inches high. This deviation does not comply with
the maximum deviation of 3/16 of an inch allowed by code, Also
noted in the inspection was that the handrails did not meet the
code requirements because they were not graspable.

1. ON OR ABOUT AUGUST 6.1 1992.1 A COMPLAINT WAS RECEIVED CONCERNING THE LOWER
DWELLING UNIT FROM FOUR FEMA.LE COLLEGE STUDENTS.
2. ON AUGUST 6.1 1992.1 AN INSPECTION WAS MADE AND ORDERS ISSUED TO AT THAT TIME
OWNER JOHN P. TERZYNSKI.
3. THE SECOND ,FLOOR REAR LIVING UNIT ,WHICH WAS VACMIT AT THE TIME OF INSPECTION
WAS ALSO POSTED AS UNFIT ,DUE TO LACK OF EXITING REQUIREMENTS AND BUILDING
PERMITS FOR THE ThO FAMILY USE. nns DWELLING WAS LISTED AS A SINGLE FAMILY.
4. ON AUGUST V.I 1992.1 JOHN TERZYNSKI CALLED AND INDICATED THAT THE DWELLING
WJULD BE G I YEN BACK TO THE LAND CONTRACTORJ BRUCE BAKER.
5. DURING THE PROCESS OF RETURNING THE PROPERTY TO BRUCE BAKER BY JOHN TERZINSKIJ
NO ORDERS OR ADDITIONAL NOTICES WERE ISSUED BY THIS DEPARTMENT. LIVING UNIT VACA~
6. ON OR ABOUT NOVEMBER 3.1 1992.1 THIS OFFICE WAS NOTIFIED THAT THE LOWER UNIT
LIVING WAS AGAIN OCCUPIED. AN INSPECTION ON NOVEMBER 3.1 1992 REVEALED THAT A ,
JAY SALTER AND FAMILY HAD tlQVED IN NOVEMBER L 1993. BAKER RENTED WITHOUT OWNER ~
KNOWLEDGE.
7. ON NOVEMBER 3.1 1992.1 A SECOND NOTICE WAS ISSUED TO BRUCE BAKER INDICATING THAT
THE UNIT WAS AGAIN OCCUPIED AND THAT THE CEILING IN THE REAR UPPER LIVING UNIT
HAD COLLAPSEI:' DUE TO RAINWATER INFILTRATION.
8. FOLLOWING THE SECOND NOTICEJ BRUCE BAKER CALLED THIS OFFICE AND I INDICATED
TO HIM THAT WE 'fK)ULD ACCEPT A SCHEDULE OF CORRECTIONS WITH COMPLIANCE DATES
IF REASONABLE AND APPROVED BY THIS OFFICE.
9. ON NOVEMBER 12.1 1992.1 I RECEIVED A FAXED SCHEDULE OF REPAIRS FROM BRUCE BAKER.
10. ON NOVEMBER 13.1 1992.1 I RECEIYED ANQTHER FAX FROM BRUCE BAKER WITH A FURTHER

22. ON AUGUST 2.1 1993.1 ANOTHER INSPECTION OF THE PREMISES REVEALED NO FURTHER
COMPLIANCE.
23. ON AUGUST 24.1 1993.1 BRUCE BAKER CALLED AND INDICATED HE NEEDED MORE TIME AS
CONTRACTORS WERE HARD TO FIND. I AGREED AND ALLOWED ANOTHER 28 DAYS.
24, ON SEPTEMBER 2t 1993.11 REINSPECTED THE PREMISES AFTER NOTING THE FRONT
STEPS APPEARED TO BE COMPLETED . THE . INSPECTION REVEALED THAT THE STEPS
AND HANDRAILS DID NOT MEET THE WISCONSIN STATE CODE. IT WAS ALSO NOTED
THAT THE REAR DETERIORATED STAIRS TO THE SECOND FLOOR ,HAD NOT BEEN TOUCHED
AND THE ROOFING APPEARS TO STILL BE IN POOR CONDITION. IN SPEAKING WITH
MR SALTERJ THE TENANTJ HE INDICATED TO ME THAT THE ROOF WAS STILL LEAKING.
IT WAS ALSO NOTED THAT A PERSON CAME FROM THE REAR UPPER LIVING UNIT AND RE-
TURNED VIA THE REAR EXTERIOR STAIRS WHICH INDICATED TOME THAT THE UPPER
SECOND FLOOR LIVING UNIT WAS STILL BEING USED SEPARATELYJ THEREBY CREATING
A TWO FAMILY USE.

THE REQUIREMENTS FOR STEPS AND HANDRAILS.

I am enclosing a copy of a Correction Notice that you issued to John Terzynski
around August 6, 1992.
Since that time, apparently the buyer and the seller got together and the
property was reconveyed back to the seller. There is now litigation involved
over this particular sale.
I represent the real estate broker who handled the real estate transaction.
We had a pretrial conference with Judge Haase, and Judge Haase was interested
in finding out what it would take to convert this property to a legal duplex.
I looked through your correction notice, and I am wondering if you have any notes
which would have indicated what would have had to be done to correct the problem.
I realize you have pressing things to do, and we have plenty of time to get
this information from you. I would appreciate a short: note from you explaining
to me what the parties would have had to do. If the explanation is so detailed
that it would take a lot of your time, I would be happy with a telephone call kind
of running down it with me so I have a better grasp on the situation.

I have reviewed your correspondence of May 28, 1993, to Mr. Luedtke
reaardinq thi s property. There are two directions the owner of
this property must look when converting to a duplex. One must
. obt.ain zoning code and bui Iding code compl iance. In convertina
this structure from a single family residence to a duplex all of
the current day zoning standards must be met. Without an accurate
site plan I can not tell you whether this site would be compliant.
Once zoning campi iance has been achieved then the owner must,
provide building code compliance. To de~ermine'complete compliance
arrangements should be made with our Residential Building Inspector
for an inspection. However, some of the life safety requirements
that must be met are code compl iant handrai Is, guardrai Is, two
exits from each dwelling unit, safe stairs, smoke detectors and
fire separation between the two units.
It 15 my understanding that both the Housing Inspector and
Residential Building Inspector have discussed these items with both
the current and past owners.

I am currently the tenant at 1215 Spruce Street in Oshkosh
Wisconsin and am stating that all repairs have not been completed
which were ordred when we moved in November 1, 1992.
The rear stairs has not been replaced, the ceilings still leak, the
front room ceiling has not been repaired, the back room ceiling has
not been repaired.
