Dear Sam,
We are further refering to the situation that exists in Oshkosh regarding the
renewal of the liquor licensing and the fact that the toilet room does not comply
with the State requirements for the handicapped.
A review of the correspondence seems to indicate that there may be a misinterpre-
tation of the codes. As we understand the code, the water closet compartment
itself is the only item affected, not the doors to the toilet room, as such, except
for the width of the door. We do not believe that they require that the door open
out into the corridor. The code states as follows: (a) One toilet room for "each
sex in every public building or place of employment except those exempted in
section Ind 51.15 (7) (j) shall have at least one water closet compartment that is
not less than 36 inches in width and at least 54 inches in depth. (b) The door
shall be not less than 32 inches in width and shall be hung to swing outward. (c)
A grab bar or handrail 33 inche s high and parallel to the floor shall be provided on
each side of the compartment.
We believe that this applies to the toilet compartment only. Perhaps they are re-
questing that the door be wider than 21 6" from the corridor into the room. If this
. is the case, it may well be that these doors would have to be changed in the field.
We hope this will not have to be done. Inasmuch as we have numerous cases of
wheelchair use thru 2-1/2' doors I we feel that the best approach is to attempt to
comply with the State requirements having what work is necessary done at the local
level.

Subsequent to said letter, the Industria' CQmmlssion _de a final
inspection of said motel and commercial building' and in its memorandum,
dated May 20, 1966, poInted out that the saId doors were not acceptable.
Recently the building Inspector of the City of Oshkosh, Wisconsin
refused to approve the owners application for ,..."ewt.tI of its annual
liquor license for the period commencing July I , 1969 and ending June
30, 1970 on the basis that the owner had tal led to contply with the
memorandum of t hft Comm i ss ion, dated May 20 I 1966, perta in I ng to the

this matter with the but hUng inspector today an(t he is wi Illng to
conditlonelly approve the application for the renewal of the liquor

Dear Sir:
On December 15. 1965. an inspebtion was made of the
Holiday Inn Motel and Commercial BU,11ding. 500 So. Koeller
Street. Oshkosh. and the following conditions noted:
Ind. 51.15. Every required exit door shall swIng
outward towards the natural means of egress and shall
have such fasten1.ngs or hardware so that it can be opened
from the inside without using a key, by pushing against
a single bar or plate, or turning a single knob or
handle. It was noted that the majority of the exit doors
could not be opened from the inside and one door in the
Commercial Building swings in.
Ind. 57.20 and Ind. 54.13. Ce,ll1ng in boiler room
of Commercial building should be patched to complete
fire resistive enclosure of boilers. Boller room of
rental units shall have two hour la~eled fire resistive
doors with self closing hardware.
Ind. 52.57 and Ind. 52.64. Japltors closet shall
have the entire floor and the side walls to a height of
not less than 6" made waterproof with ceramic tile,

painted concrete or other approved material impervious
to water. Vinyl or rubber base mat\$rial is not accE9ptable.
Ind. 52.59. Water-closet compartments for the physi-
cally handicapped shall be not les~ than 36 inches wide
and at least 54 inches in depth. The doors to these
compartments shall be not less than, 32 inches wide and
shall be hung to swing outward. A igrab bar or handrail
33" high and parallel to the floor shall be provided on
each slde of the compsrtment.
Ind. 50.10. Plans and specifications shall not be
changed in any respect which may involve any provisions
of the building code, except with the written consent of
Industrial Commission of Wisconsin. The floor plan changes
in the Commercial Building shall be submitted in tripli-
cate to the Industrial Commission ~or their approval.
Ind. .51.15. At least one low~r unit in each of the
motel buildings shall h3ve provisions for the hand~capped.
At present, the door sill is approximately 3" above the
grade of the walk. Ramps that comply with the provisions
of Ind. 5l.1S. shall be provided.
The numbers indicated above iqentlfy the Wisconsin
Industrial COmmissio~ regulation to which reference is
made.
We also noted during our inspection that not all of
the exit lights had been connected,\ We assume this worR:
wl11 be completed soon if not alre~dy completed.
The Industrial Commission of Wisconsin must still
inspect these buildings and we auggestthat you notify
them for an inspection when you feel the above items
wl11 be in compliance with code. w~ have no objection
to occupancy of these buildings once the above items are
brought in compliance with code. '

Dear Sir:
In order for you to better administrate your permit problems at the subject
proposed motel site, we intend to keep you informed on our discussions regarding
this property.
The State Highway Commission has not and does not intend to issue any permits
for new entrances from USH 41 to this property. During our last discussion on
the subject, the motel interests informed us that they contemplated the use of
the public entrance located about 10 feet north of the north lot line of the
Gulf Oil property. The Gulf Oil property is located between the proposed motel
site and the existing Consolidated station. In order for the motel interests to
use this public highway entrance it will be necessary to provide a frontage road
across or in front of the Gulf Oil property and also to negotiate an agreement
to cross a corner of the Consolidated Oil station property. The right to construct
a frontage road at the Gulf Oil property has been acquired by the motel owners
and their attorney was going to acquire the necessary rights from the owners of
the Consolidated Oil station.
Up to this time we have no information as to what has transpired since our
meeting but will keep you abreast of any information we receive regarding this
subject.
It is assumed that your building plans are being approved in accordance with the
foregoing.

Dear Hr. Wedaman:
The above plans have been stamped, "Conditional y Approved - See
Correspondence" and additional copies are being returned to you under
separate cover. This letter refers to stamp on plans.
The following comments are in reference in the motel units:
Ind 52.57, Ind 57.14, Ind 52.50. We have granted a conditional approval
although your plans were not properly revised to meet our requirements
for location of washbowls in respect to toilet Xoom enclosing walls.
Unless the washbasin is placed within the enclosing walls of the toilet
room which now contains the water closet and bathtub, we shall require
the door opening into the typical bath be removed and placed in position
where present folding partition is indicated. the treatment of floor,
base, walls, and ceilings within this newly defined toilet r~~ area
would have to satisfy toilet room construction.' The use of vinyl tile
base and floor where present washbasin is indicated will not be
acceptable.
Ind 53.09. All required 12" masonry and bear

Ind 53.06, Ind 53.08. Concrete block shall be the standard approved
block by the Industrial Commission for current year laid in 1:1:6 lime
mortar or better to comply with above rules.
Ind 57.23. The plans did not indicate the required scuttle as required
by above rule. It shall be necessary to provide an approved scuttle
opening to roof and ladder leading thereto to satisfy this rule.
The following comments are in reference to the commercial building:

!nd 52.59. One water closet compartment in the men's and women's
toilet room shall be arranged and equipped for the handicapped as
required by above rule.
Ind 52.64. Our approval has been granted on basis the sheetrock to
be used in wall construction of janitors closet will be no less than
5/811 thick to satisfy construction of toilet rooms.
Ind 55.29. The proposed construction of roof system over boiler room
using 2 layers of 5/8 fire code sheetrock protecting underside of
steel joist cannot be accepted for meeting 2-hour fire-resistive
construction at this time. This office wi 11 not accept construction r~
meeting 2-hour fire-resistive construction unle~s substantiated by
Fire Underwriters test reports. Please note the fire'rating require-
ment involves the entire roof assembly in this area and not just the
protection of the underside of the steel joist.
Ind 55.32. According to the number of occupants possible in this
bui lding at one time, we shall requi re at least five water closets
and additional washbasins for the women, and at least four urinals
and additional washbasins for the men to satisfy paragraph (2) of
above rule. Please submit a revised toilet roo~ layout showing how
you in~end to satisfy facilities for the public.
Ind 58.42, Ind 58.41. This office did not receive the necessary
calculations as requested in our previous correspondence showing basis
for determination of ventilation requirements. According to our
figures, the amount of tempered fresh air to be introduced is below
minimum requirements, therefore, the above rules are being called to
you r a tt en t i on .
Ind 58.49. According to the plans, the exhaust equipment in kitchen
area has been left to the discretion of the supplier. Because the
kitchen exhaust equipment has a direct bearing on the design of the
heating equipment, it shall be necessary for the designer of the heating
system to confirm whether this equipment satisfies the intent of this
rule and its effect on the rest of thE! heating system.
