This letter is in response to your concerns regarding the violations located at 31 7W 6th Ave. Upon receiving your
letter I did a review of the property file. The following facts pertain to this property:

Property Maintenance Violations were noted on this property and the City of Oshkosh
Inspection Services Division issued a correction notice to Baylake Bank. Among the
violations was a requirement to repair and/or reconstruct the porches/decks to meet
minimum code requirements.
An additional correction notice was sent to Baylake Bank after a review of open
property records.
Baylake Bank copied our office a letter that was sent to Victor Duket stating that he
was responsible to obtain permits and approvals for the decks/porches.
An additional letter was sent to Victor Duket from our office stating compliance was
required on the decks/porches.
A final correction notice was issued to the property trying to avoid the issuance of
citations.
A letter was sent to you regarding a voice mail message I received stating that you
now were the owner of this property. Information was also sent to you explaining
how to gain compliance with the open violations.
You called to request an extension in obtaining the required permits due to the fact
that you would be out of the State. The extension was granted.
The required permit was obtained.
An inspection request was received and the inspection was conducted of the
decks/porches.
A correction notice was sent due to numerous violations that were noted at the final
inspection of the decks/porches.
Was the compliance date for repairing the noted violations.
As you can see from the above time line our office has made numerous attempts to gain compliance from the
previous owners of this property prior to your involvement. It is unfortunate in your case but our office can only
pursue compliance from the current owner of the property. In this case it would appear from your comments that
you were sold this property without the previous owner informing you of the open violations. This is one of the
reasons our office has tried to work with you and has granted extensions. I would advise you to contact private

counsel to see if you would have any recourse from the previous owner for the violations.
It is correct that building permits are valid for one year provided work commences within the first six months.
However, The City of Oshkosh adopts the Uniform Dwelling Code for the State of Wisconsin, which states that all
violations shall be corrected within thirty-days after the written notification unless an extension is granted. This
thirty-day requirement was also noted in all of the orders that were sent to you.
According to our records the latest correspondence you received from this office was back on November 30, 2006
which stated that the violations were to be corrected and re-inspected by December 30,2006. It is extremely
disheartening that you feel you have been harassed and discriminated against after being given eight months to
comply. The decks/porches are not allowed to be constructed ina temporary manner thus avoiding the requirement
for them to be built to meet minimum code requirements established by the State of Wisconsin. In. saying this the
violations are required to be corrected and inspected no later than May 1, 2007 to avoid citations. This is the final
