Driveway Width Variance Hello Mr. Wicinsky, As discussed last week and on the telephone earlier today, the City of Oshkosh Dept. of Community Development is willing to grant a variance (under authority of Section 25-104.2: Unusual Conditions) from Section 25-104.1 (h) of the City of Oshkosh Access Control Ordinance. The variance is to allow a proposed driveway on the residential property located at 1256 Harney Avenue to be constructed at seven and a half (7.5) feet in width, whereas Section 25-104.1 (h) requires a minimum width of eight (8) feet with the condition that a six (6) inch setback be maintained. The situation is considered unusual in that the property is an extremely narrow lot (40 feet) currently developed with a primary structure but no drive or parking. It is our understanding that the structure is situated in such a way as to have only eight (8) feet between the structure and the side lot line, thereby eliminating the ability to provide the required eight (8) foot driveway and the required six (6) inch setback.
