as defined in the above-cited statute. This notice is sellt because you have violated ~704.17(2)(b)
and (3)Wis. Stats. and other sections of said statutes, by violating provisions of the lea.c;e requiring
that you will not permit use of the premises for any unlawful purposes, engage in activities which
unduly disturb neighbors, and cause waste and damage to the property you are renting. A copy of
a list of problems and corrections to be accomplished is attached for your information.

RE: Lease violation
You have violated your lease by the following:
1. Allowing visitors and/or tenants to drive vehicles onto property owned by others, generating
complaints to me and police, on 1/1/05 and on a previous occasion.
2. Having large and frequent parties where others are invited to pay fbr beer on the premises,
contrary to law.
3. By f:ailing to take out garbage and recyclables, and storing the same, t.ogether with 5 half
barrels, in the garage.
4. By damaging property owned by landlord, as set forth on the list attached.
If you wish to stay, you need to take the following actions;
1. Apologize to your neighbors who you have offended.
2. Remove all garbage and debris from the basement so that it is empty and clean.
3. Remove aU recyelables~ garbage, junk., beer kegs, and furniture fl'Om the garage so that it is
empty except for items to be listed by tenant and approved by landlord.
4. Have damaged garage doors and transmitters repaired by a professional (Tri County Door
Service, 920/735-9981 repaired these doors and track 2/17/04).
5. Obtain estimates from Ruthannc's Interiors for removal and replacement of carpet that ha~
been damaged by cigarette bums in living room, rear main floor (dining) room, and upper
northwest bedroom; said carpet estimate to be for comparable materials; tenants wiII be
required to pay as an additional deposit the amount of the estimate or arrange for floors in
these rooms to be professionally sanded and varnished after carpet removal.
6. Ilave entire house cleaned to eliminate current filthy and unsanitary conditions.
7. Replace bent storm door closer on side door
8. Replace missing front door screen, and reinstall screens currently located in basement.
9. Replace damaged/missing ceiling tiles in living room
10. Pay maintenance person or professional painter to paint over scuffed and dirty areas,
including but not limited to front door, entry hallway walls, kitchen and stairway.

but not limited to Jeremy Fritz~ who claims to reside at 48 W. 12th, Oshkosh, WI 54902.
22. Provide to landlord a list of vehicles owned by tenants, together with license nurnbers, and
ensure that any vehicles on the premises have current and vali.d registrations
23. Discontinue removing screens from windows, and remove cigarette butts from window
ledges.
FROM THIS DATE FORWARD, NO BEER KEGS ARE ALLOWED UPON THE PREMISES.
CANS AND BOT'ILES AND OTHER RECVCLABLES ARE TO BE PROPERLY DISPOSED OF.
YOU HAVE BEEN WARNED SEVERAL TIMES BY MYSELF AND MAINTENANCE PEOPLE
ABOUT CANS AND BOTTLES IN THE YARD, AND NO FURTIIER VIOLATIONS WILL BE
TOLERATED. I WILL BE SENDING NOTICES TO YOUR NEIGHBORS ASKING THEM TO
CALL POLlCE IF THEY ARE DISTURBED OR IF THEIR LA WNS ARE DRIVEN OVER

Dear Angelo, Justin, Joshua & Mycal:
As you know, I inspected your house on Monday, November 22. I requested at the time I was there
that you empty out the basement, as that was done prior to your occupancy. Mattresses should be
properly disposed of, and the excess wood and other junk needs to be picked up. The pallets should
remain, and you should store any items that you plan to keep there on top of the pallets so they don't
get damp or wet. Things sitting on the Hoor are likely to get moldy, and we want to prevtmt that.
The carpets in the entire house are pretty gruesome. They were cleaned before you moved in. The
living room and other room on the main floor, as well as the steps to the upstairs are the worst. You
need to get the dirt out of the comers of the steps, and have everything well cleaned. If you continue
tracking in on top of the dirt that is there, they are never going to come clean, and you are going to
have a huge bill for carpet replacement at the end of your tenancy. I'm trying to prevent that by
encouraging you to get thom cleaned now, and then take st.cps to keep them clean.
J am going to have Mike re-do the batbroom walls using that white plastic board, which won't grow
mold or mildew. It would help if you run the fan when in the bathroom, and leave the door open a
little bit so air can flow through. This will cause less moisture to accumulate. After showering, the
door should be left open and the fan could be left running for awhile, again to get rid of the moisture
that is there. The bathroom was in good condition when you moved in.
I'm also concerned with the water leak in the lower bath. I could hear water dripping in the
basement underneath the bathroom when I was there, but you have removed all the light bulbs from
the basement, so I eouId not see anything. The floor was wet in the bathroom area. You need to
detennine where that water is coming from. If you wash the floor around the toilet, and put some
paper towels there, you will know whether there is any kind of a leak from the toilet where it seals
to the floor. I suspect it is the sink, and I will have Mike took at that as well.
1 also noticed that the glass panels in the door to the second Hoot have a problem. I do km)w that
one of those was smashed before you rnoved in, but 1 see noW that two of them are broken. I'm

going to have Mike take that door in for repair. and I will split the cost of that repair with you.
If all of you would spend a little bit of time cleaning and picking things up, your mother"s would be
more proud OfYOll should they come to visit.

Dear Mycal. Justin, Angelo, and Joshua:
Beer cans and other junk is being left on the lawn, on the porch, and along llie side of the house on
a regular basis. I stopped by one day when beer cans were scattered around. My maintenance person
has talked with someone at your property on at least two occa$ions. and on September 14, he again
had to remove garbage from the lawn and porch area. If this continues, your tenancy will be ended.
Garbage must be placed in appropriate containers, and kept at the back of the house. If you have
jmllc at the front or along the sides, neighbors are going to complain, and citations will be issued or
your tenancy will be ended. I also advised you that the upholstered piece that was located on the
front porch had to be removed, a.."i that is not allowed under city code. Please make sure that is done
promptly. Also. we have the five new storm windows which will be installed shortly to replace the
ones that were damaged. You can eall Mike at 2334660 to set up a time fOT him to do that. Finally,
please turn in your inspection sheet and smoke detector form promptly.
I'm sending a copy of this letter to the City of Oshkosh housing inspector for his information. You
need to follow the rules and be good neighbors. Please call if you have any questions.

Occupancy of the house can begin 8/31104- there will be some things that will still need to be
done, including installation of 5 new storm/screen combinations so that all storms and screens in
the building will then be in satisfactory condition. Please be advised that the carpets were cleaned
about 10 days ago) and will require regular vacuuming to keep them in good condition. We do
not expect to have to replace carpeting at the end of your tenancy. This is a large house, and the
cost of replacing carpet will likely exceed $2000, so please take care ont. If you have any
questions or concerns about maintenance or cleaning, please do not hesitate to call
We recommend that you obtain renter's insurance to protect your belongings. Also,' we suggest
that any items stored in the basement be kept on the wood sldds that are provided, as this
basement does seep some water.
I had the receptioPist recount your payment while we went next door to search 'for the
maintenance guy, and she confirmed that you have paid Sl()OOcash plus the $100 in cash paid last
week. Your total deposit is $1250, $850 9fwhich has been paid. Your rent is $850 per month if
paid on or before the first, and that has been paid for September. Thus, the balance due on your
deposit is $400, not the $300 that I wrote on the bottom of your receipt. I gave you credit twice
for the $100 deposit originally paid, and wanted to clear that up right away.

We would prefer that you not smoke inside the apartments. If we receive complaints From other
