1, CONDITION: A land division containing cross access easements needs to be recorded,
2, CONDITION: The driveway onto future McClone Drive shall not be constructed until the public street is
constructed.
3. CONDITION: The new entry drive for the southern property needs to be re-designed, The maximum
permitted width of entrance cannot exceed 30 feet, and the maximum permitted curb cut cannot exceed 40
feet.
4. NOTE: Signage is not part of this review, as it is not supplied, No signage shall be installed until a signage
plan is supplied and approved by the Department of Community Development.
5, CONDITION: No mechanical equipment shown on submitted plans. All rooftop and ground level
mechanical equipment and utilities must be screened in accordance with Municipal Code-Section 30-35
(1)(5).

PURPOSE:
INITIATED BY:
PLAN COMMISSION RECOMMENDATION: All approved with conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property, and the Planned District
Overlay and final development plans, per the attached exhibits, are hereby approved.
A) 420 N. Main Street; D&M Rentals LLC, owner
A conditional use permit for a mixed commercial/residential use, per the attached
"Exhibit A", with the condition that the design and placement of the trash receptacle is
subject to staff approval.
B) 3285 S. Washburn Street; Bergstrom of the Fox Valley, Inc., owner
A conditional use permit for expansion of an existing planned commercial development
for construction of a new auto sales and service facility with display lot, construction of
an automobile wash facility, construction of automobile display "pods"/platforms, and
revision to site stormwater facilities, per the attached "Exhibit B", with the following

The display "pod"/platform in the sanitary sewer easement be relocated outside
of the sanitary sewer easement area.
Submittal of a revised site plan meeting the requirements of the Zoning
Ordinance.
The driveway onto future McClone Drive not be constructed until the public street
is constructed.
Submittal of a revised landscape plan meeting the requirements of the Zoning
Ordinance and incorporating islands at drive aisle ends with said revised plan to
be approved by the Dept. of Community Development.
Base standard modification to allow a 10ft. setback on the interior side yard
setback of the northern lot.
