An Occupancy Permit is hereby issued for the Auto Sales & Repair Building, as
described in Building Permit #114039.
This building is to be used auto sales and repaire and is located in the C-2 PD
General Commercial, Planned Development District.
LIMITATIONS:
Maximum number of persons: Per State Approved Plan
Note: All Parking Lot Lighting shall be maintained in compliance with the
applicable codes and lighting levels. Failure to maintain compliance can result in
revocation of the Occupancy Permit.
Certificate of Occupancy shall be required prior to occupancy, should additional
building(s) be erected, or should any buildings mentioned above be altered or
moved. The useof land, or buildings, shall not be changed until a Certificate of
Occupancy is issued for that occupancy. All conditions noted above must be
complied with in order for this certificate to be valid.

Dear Mr. Schroeder,
This letter is a follow-up to the meeting between Town & Country Electric (Contracted by Bergstrom) and
Planning staff at Bergstrom Chevrolet & Cadillac of Oshkosh on Wednesday, March 1, 2006 regarding
lighting compliance at the dealership.
As responses to previous notices sent to the dealership, a majority of the rear lot light fixtures have been
orientated at a 900 angle as well as the placement of shields on many of the fixtures to block the lighting
element from adjoining properties. Unfortunately, these efforts have been insufficient in correcting lighting
problems and the current orientation of lights both in the rear and in the front of the property continue to
generate complaints. As discussed last Wednesday, please orient all lighting fixtures (RUUD Lighting, Inc.
Series CF3-22 Full Cutoff Floodlight) at a 900 angle with the exception of the two fixtures discussed, as
these are orientated in such a way as to be blocked and not visible from any adjoining properties.
Following the reorientation of the lamps, light levels recorded in footCandles and adjusted for ambient light,
will be taken around the perimeter of the entire parking area and you will be notified of the results. Please
contact this office after the adjustments to the lights have been made to schedule said inspection.

I was instructed to not inspect until all of the work violations were corrected. I was driving by when I noticed the
electricians wiring the signs (which means the work was not done at the time of the reequest). I reviewed the
violations with the sign wiring to that point. At the time of the final inspection I made arrangements with the
electrician to call when he was scheduled to wire these signs and this did not happen, which makes me
question if the equipment in the CL 1 Div2 loc. is locked off!!!

C: ACCESS CONTROL VARIANCE TO ALLOW MORE THAN TWO
DRIVEWAYS ON A PARCEL - Carow Land Surveying, petitioner, Midwest Real
Estate, owners
Midwest Real Estate is currently developing a large multiple family development on the south
side ofWaukau Avenue, approximately ~ mile to the west of Washburn Street, that involves
two large parcels ofland. The attached site plans show the proposed development
configuration that meets Zoning Ordinance standards with regard to setbacks but is not in
compliance with the Access Control Ordinance that allows for a maximum of two driveway
approaches per property. Attached site plan A was previously issued an Access Control
Variance for the four northernmost driveways. Midwest is developing the balance of the
parcel to the south and has identified an additional 4 driveways to service the 64
condominium units that will be constructed. Attached site plan "B" shows that 79
condominium units will be constructed and served by a total of 8 driveways.

future for building development. Lot 1 is 6.7 acres and Lot 2 is .84 acres. The CSM contains
an area of right-of-way that will extend Eichstadt Road to the south and east. Attached is a
concept map from an industrial park study illustrating how the subject property is consistent
with the plan.
There was no discussion on the Consent Agenda.
Motion by Propp for approval of the Consent Agenda with the following findings
on Item C:
1) The variances will not adversely affect the adjacent property owners.
2) The variances are not against the public interest.
Seconded by Thorkildsen. Motion carried 5-0.

In March 2005 Bergstrom Automotive was granted a conditional use permit to operate an automobile
sales and service dealership on an 8-acre parcel located at 355 N. Washburn Street. During the initial
CUP review of the site plan, Bergstrom indicated a desire to decrease setbacks along the side lot lines
· to increase the area of the automobile sales display area. Staff indicated that a zone change to
Planned Development Overlay would allow the City to consider such requests through the CUPIPD
review process, which is the reason for the current CUPIPD, and zone change requests.

ill addition to the CUPIPD request for Bergstrom Automotive, Art Pommerening is requesting a
CUPIPD for his property located at 425 N. Washburn Street to allow area to be filled near the rear of
the property to prepare the site for future development and to update the previously approved site
plan. The CUP is required for the filling because the fill area is located in a Shoreland Zoning area
that places restrictions on development occurring within 300 feet of a navigable stream. Mr.
Pommerening was previously issued a CUP for the former automotive dealership located on the site.
Harris Kraase, 340 Westbrook Drive, stated his property is at the west end of the Bergstrom site, and
questioned what kind of fence or berm was proposed. Mr. Burich stated a 4-foot high berm with
evergreen trees and landscaping installed along the berm is proposed for the west end of the site. He
stated a chain link fence is proposed and the City is requesting that the fence be placed on the east
side of the berm to extend the entire length ofthe property.
Mr. Kraase questioned what was proposed for the Oshkosh Lanes site. Mr. Burich stated an error had
been made which included the Oshkosh Lanes site on the map sent out with the first meeting notice,
however, a revision was sent out and there are no plans for the Oshkosh Lanes site at this time.
Steve Gries, Gries Architectural Group, petitioner, 307 S. Commercial Street, Neenah, WI, stated he
was available to answer any questions the Plan Commission may have.
Mr. Gries referred to Mr. Kraase's question regarding the west lot line. He stated there would be 50'
"of landscaping, of which 25' would be used for drainage and 25' would consist of the berm and
: landscaping.
· Mr. Gehling questioned if there were any objections to the conditions of approval of their requests.
: Mr. Gries stated the only item of concern was the lighting. Mr. Gries passed around pictures that
. showed the proposed lighting structures and the proposed ponds for the site.
Chairman Dell' Antonia questioned if the design of the detention poIids would be similar to that of
other Bergstrom dealership properties north of Oshkosh. Mr. Gries stated they would be very similar.
. He explained that fountains would be included in the ponds, and the walls of the ponds would be
I constructed with stone, making the ponds a very attractive architectural enhancement to the property,
: even though it was a requirement for stormwater control. Chairman Dt;:ll' Antonia stated these ponds
would be a nice addition to the site.
Ms. Mattox questioned where trees would be located on the site, and if any attempt had been made to
combine the landscaping effort for both properties. Mr. Gries stated there would be 3 large trees
across the front of each pond, and the landscaping has been coordinated between the two properties.
!Mr. Burich stated the landscaping was consistent between both properties in this development.
,Ms. Mattox questioned if it was customary for chain link fences to be used at car dealerships. Mr.
jGries stated because of the close proximity to Highway 41, and the depth of the lot, they felt it is
ecessary for security reasons, as chain link fences are usually only used to secure service areas.
s. Mattox also questioned why the lighting fixtures were 24' high. Mr. Gries stated they do meet
e code requirements, and the cost for lighting was taken into' consideration. He stated by using
gher lights not as many lights would be needed, therefore saving cost as well as energy.

Mrs. Propp questioned if a minimum setback of 5 feet was adequate for a detention area. Mr. Gries
stated there is a 5 foot wide landscaped area to the edge of the pond. Mr. Burich stated this was
adequate.
Ms. Mattox questioned if any area has been allowed for a sidewalk or trail system. Mr. Burich stated
the area inside of the landscaping has been officially mapped for a sidewalk.
Mrs. Propp stated she is delighted to see the cooperation between the two dealerships to create this
attractive site.
Chairman Dell' Antonia stated he has visited the dealerships in the Appleton area and he is pleased to
have this attractive addition on Washbum Street.
Motion by Thorkildsen for approval of the zone change to add a Planned Development
Overlay District as required and for approval of the Bergstrom sales and service
CUPIPD to be found consistent with Section 30-11 (D) and 30-33 of the Zoning
Ordinance subject to the following conditions:
1) The fence identified encompassing the rear storage area be moved to the inside edge
of the landscape area with the final location approved by the Department of
Community Development.
2) The minimum setback of the front detention areas is 5 feet.
3) The east edge of the east detention areas along Washburn Street be enhanced to
include architectural treatments such as a masonry 'wall and fence with (mal
architectural details, approved by the Department of Community Development.
4) Landscape islands, minimum 6 feet in width, be added to the ends of the ~
parking/display aisles in the east display area. '
5) The landscape island closest to the principal structure be widened to a minimum of 6 l~
feet in width.
6) Full cutoff fixtures shall be used for parking lot lighting.
7) Cross Maintenance agreement be reviewed and approved by the Department of ~_
Community Development for the common landscape area along the north property
line.
S) Landscape plan be updated for the berm along the west property line with final
approval by the Department of Community Development;
along with approval of the Pommerening CUPIPD Request to permit filling within the
shoreland area and an update to the approved CUP with the following conditions:

Dear Allyn:
Per your request, I am writing in response to our phone conversation
regarding Item No. 1 on your correction notice issued 7-20-05. This item
regards the contractors use of pressure treated plywood in lieu of the fire
retardant plywood indicated on the drawings and approved by the state.
The discussion evolved around the fact the plywood had been installed
at the parapet (outside the building envelope) and if it should be removed
and replaced with the fire retardant plywood. It was agreed that if the
plywood was treated with an intumescent paint prior to be covered by the
finish materials, it would meet the intent of the code. The literature
provided by the contractor was reviewed and provides a Class "A" finish
and a 60-minute fire rating. Also discussed was the fact the parapet was
not a load bearing wall, the exterior wall has a "0" hour rating. The
parapet is outside the building envelope and the building is completely
sprinklered.
With these factors in place, it was agreed that the structure as built will
afford equivalent protection.

· IMC 304.4/IMC 304.5/IFGC 305.2 Where clearance to the floor cannot be provided for suspended units,
provisions must be made for maintaining clearances to combustibles, equipment visibility, collision protection,
and providing a minimum clearance of 18 inches from the floor.
· IMC 313/Comm 64.0313(3) All operating manuals concerning the HV AC equipment and its maintenance shall
be presented to the owner.

. IMC 606 Provide a duct smoke detection system in new duct systems, with appropriate controls, unless (1) the
return air rate is 2,000 cfm or less (See balancing report Comm 64.0313), OR (2) the air distribution system is
incapable of spreading smoke beyond the enclosing walls, floor and ceiling of the room or space in which the
smoke is generated. The smoke detection system shall shut down the air distribution system upon activation.
Smoke detectors shall be connected to a fire alarm system The activation of a smoke detector shall activate a
visible and audible supervisory signal at a constantly attended location unless exceptions are met. The detectors
shall be located in the return duct.
· IBC 1209.1 Provide toilet and bathing room floors with a smooth, hard, nonabsorbent surface extending a
minimwn of 6 inches along the wall, except when located within dwelling units. Electric Baseboard unit
locations.
A copy of the approved plans, specifications and this letter shall be on-site during construction and open to
inspection by authorized representatives of the Department, which may include local inspectors. If plan index sheets
were submitted in lieu of additional full plansets, a copy of this approval letter and index sheet shall be attached to
plans that correspond with the copy on file with the Department. All permits required by the state or the local
municipality shall be obtained prior to commencement of construction/installation/operation.
In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should
conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this review
shall relieve the designer of the responsibility for designing a safe building, structure, or component.

This letter is being sent to communicate the remaining issues preventing this office from issuing the
required Occupancy Permit. To date an Occupancy Permit has not been issued due to these items.
1. A Compliance Statement from the Supervising Professional (Gries Architectural Group, Inc.) has
not been received.
2. A re-inspection to verify compliance with the noted Electrical Violations has not been requested.
Please note that item 8 on the enclosed Correction Notice is viewed to be the responsibility of the
owner. It involves the use of equipment in the repair garage that is not approved for use in a
Class 1, Division210cation. Per the State of Wisconsin Electric Code, section Comm 16.392,
the exception in NEC 511.3(B)(1) (2002 version) does not apply in the State of Wisconsin. For
this reason all electrical equipment must be approved for use in a Class 1, Division 2 location or
be located outside of such location, 18" above fInish floor. For example electrical equipment can
be placed on platforms, 18" above the finish floor, so that all electric is out of the Class 1,
Division 2 location.
Please do not request a Re-Inspection until all items have been corrected, including item 8.
3. There are two Zoning Code issues that must be resolved: The location ofthe fence and the
parking lot illumination levels. Please address these issues with David Buck, Associate Planner,
236-5059.
Until these issues are resolved, this office cannot issue the required Occupancy Permit. Please
advise me of your schedule to comply. Please note that presently this facility is being occupied in
non-compliance with the City's Occupancy Permit requirements. It is this office's policy to work
with contractors and owners in allowing reasonable time for compliance. However, if compliance is
not provided in a timely fashion, this office will have no choice but to notify the owner to cease
Occupancy until compliance is provided and verified.

Dear Ms. Mashik,
Following several complaints and a Notice of Correction being issued, a formal light inspection of your site
at 355 N VVashburn Street was conducted on Tuesday, November 29, 2005. The ambient light levels
(Bergstom lights being off) were recorded in footcandles using a light meter and then readings were
recorded at full light levels (with the lights on). The inspection revealed lighting levels above those listed on
the photometric plan on file with the city as well as the 0.5 footcandles permissible by Section 30-35
(K)(4)(a) of the Municipal Code on the north property line, as shown on the attached site plan.
As a majority of the light levels are compliant and those light levels that are not may be attributable to the
freshness of the bulbs (which typically burn at lower levels after a period of use), the City has determined
that another inspection will need to take place within the next few weeks to identify if the noncompliant
lighting is due in part orinwhole to orientation or power of the light sources. If the light levels do not comply
at the next inspection, the City will require that the lights be repositioned and/or replaced as to conform to
the regulations of the Municipal Code.
A follow-up inspection will be conducted the week of Dee, 18th and you will be contacted several days prior
to said inspection, The City would like to thank you for the cooperation in meeting staff on-site and
extinguishing the lighting in order to get ambient light levels necessary to conduct a photometric level check

Thank you for your letter to me of January 4, 2006 in which you forwarded to me a copy of
your January 3, 2006 letter to Bergstrom Chevrolet and Cadillac of Oshkosh (copies enclosed), and
for your January 20, 2006 letter to me with your January 20,2006 letter to Bergstrom.
In your letter to me of January 20,2006 you wanted me to contact you in had any concerns
regarding the letter, My clients do have extremely serious concerns about the letter to Bergstrom and
have asked me to contact you to relate them.
In your letter to Bergstrom dated January 3,2006, you pointed out two violations of Section
30-35 (K)(4)(a) of the Municipal Code, The first was that the light levels were in excess of the code
limitations. My clients cannot tell whether or not that has been corrected because those levels are
a part of the second violation.
The second violation pointed out was that "the light fixtures installed are orientated in a way
that the lighting element is visible from adjacent property owners and/or are not full cutoff fixtures,
which is a condition placed on the Conditional Use Permit/Planned Development of the site." You
went on to say that "The City requires that the lights be repositioned arId/or replaced as to conform
to the regulations of the Municipal Code and your Conditional Use Permit/Planned Development
within thirty days of this letter."
My clients feel thatthatJanuary3, 2006 letter correctly informed Bergstrom oftheproblems.
My clients were, therefore, amazed and dismayed to read yourJanuary 20, 2006 letter to Bergstrom
which indicated that light levels were taken around the perimeter of the rear parking area. Your
letter to me of the same date says that letter to Bergstrom was a "confirmation of code compliance
letter related to lighting of the rear parking lot."
They are unable to understand why that compliance letter is only for the rear of the parking
lot. In my letter to you of December 21, 2005 (copy enclosed), I indicated that my clients were
concerned about "compliance with Sections K (2) & (4)(a) of the Exterior Lighting Standards

ordinance which prohibit spill-over or glare to an adjacent property or street." They felt that the City
had always enforced the ordinance diligently in the past and I asked ''why should this location not
be required to do the same?" The word" location" encompasses the entire property not just the rear
area.
The code is quite clear that "In no instance shall an exterior lighting fixture be oriented so
that the lighting element (or transparent shield) is visible from an adjacent property or street right-of-
way." In your January 20, 2006 letter to Bergstrom you say "it is understood that the elements
cannot be completely covered from a vertical standpoint due to the overall height of the light poles."
You further state that due to the height of the light poles it is "the City's opinion that the lights as
orientated meet the intent ofthe Exterior Lighting Code (Section 30-35 (K)(4)(a)." The City code
does not allow for "intent"! It clearly states that in "no instances" can there be a lighting element
visible to adjacent properties or a street right-of-way.
One of the purposes of the ordinance is to prevent lights from shining in the eyes of the
neighbors and passing motorists. If a light shines in the eyes of a passing motorist, it could and most
probably will result in serious accidents. I have been informed by my clients that since Bergstrom
opened for business, accidents have occurred on Highway 41 in front of the subject property. My
clients are certain that the City of Oshkosh and it 's insurance carriers do not wish to become a party
to causing traffic accidents, and hazards to motorists on Highway 41 and Washburn Street,
This condition cannot be allowed to exist just because the City feels nothing can be done
because the light poles are too high. If the light poles are too high they must, in accordance with the
code, be installed at a level that will permit compliance with the code. Why were they allowed to
be erected that high in the first place? However, my clients have consulted with parking lot lighting
experts who have informed them that the height of poles should not be an issue in matters such as
this, as it is always possible to shield and direct the lighting fixtures to prevent light spill over onto
adjoining properties and into the eyes of vulnerable passing motorists.
My clients feel that the City parking lot at the Safety Building is an example and model of
how the lighting of a parking lot should be implemented. This is because it is tilt-oriented so that
all lighting falls on the ground beneath the lights. If this is carried out on Washburn Street by
Bergstrom, it would not cause a nuisance or hazzard to residential neighbors, commercial neighbors,
and passing motorists.
Why should any part of the parking lot at 355 N. Washburn Street be permitted to have a
lesser standard than the City and other parking lot owners? It should not. Why shouldn't Bergstrom
comply completely with the code which is clear on it's face as to its purpose and will not allow any
other intent to be read in?
My clients request that the entire Bergstrom lot be forced to comply with the City exterior
lighting standards code and the conditional use permit passed on July 12, 2005, and that no

occupancy permit be granted until it does so comply. If compliance is not achieved the failure to do
so should be handled as any other City ordinance violation with appropriate citations being issued
as the City has in prior correspondence with Bergstrom indicated it would do. The case of lftlinski
v, Eggers 148 N. W. 2d 750, 34 Wis. 2d 85 states that "Zoning ordinances are enacted for the
benefit and welfare of the citizens of a municipality. Issuance of an occupancy or building permit
which violates such an ordinance not only is illegal per se, but is injurious to the interests of property
owners and residents of the neighborhood adversely affected by the violation."

This letter is oeing sent to communicate the remaining issues preventing this office from issuing the
required Occupancy Permit To date an Occupancy Permit has not been issued due to these items.
1. A Compliance Statement from the Supervising Professional (Gries Architectural Group, Inc.) has
not been received.
2. A re-inspection to verify compliance with the noted Electrical Violations has not been requested.
Please note that item 8 on the enclosed Correction Notice is viewed to be the responsibility of the
ovvner. It involves the use of equipment in the repair garage that is not approved for use in a
Class 1, Division 2 location. Per the State of Wisconsin Electric Code, section Comm 16.392,
the exception in NEC 511.3(B)(1) (2002 version) does not apply in the State of Wisconsin. For
this reason all electrical equipment must be approved for use in a Class 1, Division 2 location or
be located outside of such location, 18" above finish floor. For example electrical equipment can
be placed on platforms, 18" above the finish floor, so that all electric is out of the Class 1,
Division 2 location.
Please do not request a Re-Inspection until all items have been corrected, including item 8.
3. There are two Zoning Code issues that must be resolved: The location of the fence and the
parking lot illumination levels. Please address these issues with David Buck, Associate Planner,
236-5059.
Until these issues are resolved, this office cannot issue the required Occupancy Pennit. Please
advise me of your schedule to comply. Please note that presently this facility is being occupied in
non-cc:>mpliance with the City's Occupancy Permit requirements. It is this office's policy to work
with contractors and owners in allowing reasonable time for compliance. However, if compliance is
not,provided in a timely fashio~ this office will have no choice but to notify the owner to cease
Occupancy until compliance is provided and verified. -'

In our conversations the other day concerning the 355 N, Washburn Street lighting it seemed
that the City was concerned about candle power, While that is important, my clients an; very
concerned about compliance with Sections K (1) & (4) (a) of the Exterior Lighting Standards
ordinance which prohibit spill-over or glare to an adjacent property or street.
I am enclosing a highlighted copy of the ordinance so that you can see what I refer to. The
Bergstrom lights do not meet the required standard as you will see if you examine the light pol es and
observe the tilt of the lighting elements and the exposure of the lighting element. This situation is
not just a nuisance, it is the violation of an ordinance.
An examination of similar lighting at Pommerening Auto Village and Racette Ford, which
are nearby, and even Bergstrom on Jackson indicates proper orientation and shielding in compliance
with the ordinance, I was surprised to hear you indicate that just because those locations conform
to the law that might not be a concern in this instance. It is our understanding that the City has
always been diligent in enforcing the ordinance in the past. 'Why should this location not be required
to do the same?
Mr, Dannhorr s letter to the parties on November 1, 2005, indicates that if compliance with
the law is not done "in a timely fashion, this office will have no choice but to notify the owner to
cease Occupancy until compliance is provided and verified," A period of more than 50 days has now
passed and there has not been compliance. Would you please, within 10 days of the date of this
letter, let me know what the City now intends to do.

Permits.
Removal of Abandoned Antennas and Towers
An antenna or tower that is not operated for a continuous period of 12 months shall be
considered abandoned, and the owner of such antenna or tower shall remove same within
ninety (90) days of receipt of notice from the City notifYing the owner of such abandonment.

motor vehicles, pedestrians, and land uses in the vicinity of a light source in order to
promote traffic safety and to prevent the creation of nuisances.
(2) The requirements of this Section appty to all private exterior ftghting within the jUlisdiction
of this Chapter, except for righting of public right-of-way.
(3) Any and aD exterior lighting shall be depicted as to its iocation, orierrtatiOn, cOnfiguration,

Dear Mr. Schneider,
As a follow-up to the lighting inspection and violation letter dated December 5, 2005, a second formal tight
inspection of your site at 355 N Washburn Street was conducted on Tuesday, December 20,2005, This
second inspection was conducted to determine if the light levels of your parking lot lighting had been
adjusted to meet regulations for spillover light as well as to review the fixtures as they Telate to your
Conditional Use Permit/Planned Development.
The ambient tight levels (Bergstrom lights being off) were recorded in footcandles using a light meter and
then readings were recorded at full light levels (with the lights on) on November 29,2005, The inspection
revealed lighting levels above those listed on the photometric plan on file as well as the 0.5 footcandles
permissible by Section 30-35 (K)(4 )(a) of the Municipal Code, as shown on the attached site plan in black
lettering. The follow-up inspection conducted on December 20th used the same tight meter at the same
locations found that the light levels remain in excess of the limitations above, as shown on the attached site
plan in red lettering,
Additionally, the light fixtures installed are orientated in a way that the lighting element is visible from
adjacent property owners and/or are not full cutoff fixtures, which is a condition placed on the Conditional
Use Permit/Planned Development of the site. Attached please find a copy of the Resolution 05-212(0) with
conditions of approval from the July 12, 2005 Common Council meeting,
As the city continues to receive complaints' and the parking lot lights failed at both of the two lighting
inspections, the City requires that the lights be repositioned and/or replaced as to conform to the regulations
of the Municipal Code and your Conditional Use Permit/Planned Development within thirty days of this letter
(No later than February 2, 2006), Failure to comply may result in the issuance of Municipal Citations,
revocation of the Conditional Use Permit'Planned Development status of the site and notification to the
.owner to cease occupancy,

Dear Mr, Manske,
As we have discussed over the telephone, the City of Oshkosh is currently following up on complaint
regarding the lighting at Bergstrom Auto at 355 N Washburn Street. A date no later than February 2,2006
has been established for correction of lighting violations on-site, These violations were formally established
in late December and consist of light levels exceeding allowable footcandles in certain, but not all areas, as
well as the visibility of lighting elements that are observable from adjacent properties.
In an attempt to keep you better informed of the situation, I have enclosed copies of correspondence
between the City and the dealership regarding lighting inspections and compliance at the dealership, dated
12/05/05 and 01/03/06. Hopefully these documents help to explain inspections conducted at the site to date
as well as the timeline for compliance.
Finally, you had insinuated in your letter, dated 12/21/05 and received by this office on 12/27/05, that this
particular situation is being handled differently than others in regard to code enforcement. I want to take this
opportunity to rebuke said insinuation and make the statement that I have been working with the dealership
to gain compliance with the code since first receiving the complaint. As I am sure you understand,
complaints of this nature and corrective items of this magnitude are not correctable immediately as it is the
City's responsibility to make a determination of the validity of the complaint as well as allowing a reasonable
amount of time for corrective action to take place from the time of violation confirmation.
I hope this letter and attachments help to better explain the current situation and the City's actions regarding

Dear Mr. Schneider,
Following a telephone discussion with Mr. Schreider of Town & Country Electric in which it was indicated
that the lighting frxtures at 355 N Washbum Street had been adjusted and shielded, a lighting inspection
was conducted on 01/19/06, Said inspection indicated that light levels are within the limitations of the
Municipal Code and that the light fixtures have been adequately shielded.
Light levels, r:ecorded in footcandles, were taken around the perimeter of the rear parking area and adjusted
for ambient light levels, The light readings taken 1/19/05, as indicated on the attached plan, meet the 0.5
footcandle limitation (Section 30-35 (K)) at the lot lines and are substantially lower than the maximum
allowable illumination levels at the western portion of the site,
Additionally, the light fixtures have been orientated at much more of a 900 angle as to shield the lighting
element from adjoining properties as well as the inclusion of "shields" on many of the fixtures, It is
understood that the elements cannot be completely covered from a vertical standpoint due to the overall
height of the light poles and it is the City's opinion that the lights as orientated meet the intent of the Exterior
Lighting Code (Section 30-35 (K)(4 )(a)),
In regard to other issues listed in the letter from the Inspection Services Division (dated 11/1/05), they are
the purview of the Inspection Services Division and must be resolved through them. Thank you for your
