PLAN COMMISSION RECOMMENDATION: Both approved
PURPOSE:
INITIATED BY:
WHEREAS, the City previously approved the final plat known as Edgewood
Village Subdivision which plat included utility, drainage/green space, sidewalk and
public walking trail easements, as shown on the attached "Exhibit A"; and
WHEREAS, due to minor modifications in lot boundaries, GF Holdings LLC,
owner, is requesting that a portion of the drainage/green space easement that is a part
of Outlot 3, sidewalks, and the public walking trail be vacated and new easements be
accepted per the attached "Exhibit B"; and
WHEREAS, Convenience Store Investments (a/k1a Kwik Trip Inc) is requesting
the relocation of utility and access easements, per the attached "Exhibit C", at the
intersection of South Washburn Street and STH 44.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the City hereby vacates a portion of the drainage/green space easement
on Outlot 3, as shown on the attached "Exhibit B", and vacates sidewalk and public
walking trail easements, as shown on the attached "Exhibit A".
BE IT FURTHER RESOLVED that the City hereby accepts sidewalk and public
walking trail easements within the Edgewood Village Subdivision from GF Holdings
LLC, per the attached "Exhibit B", with the following conditions:
1) All public walking trail easements be labeled and identified as "public" trail
easements.
2) Maintenance of the public walking trail easement areas is the responsibility of the
property owner or related condo and homeowner association.
BE IT FURTHER RESOLVED that the City hereby accepts utility and access
easements from Convenience Store Investments at the intersection of South Washburn
Street and STH 44, per the attached "Exhibit C".
BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to execute any and all documents necessary for purposes of same.
