This letter is pursuant to our conversation regarding requirements for a "Fire Ba r" wall
versus a "Fire Wall". Following is our code analysis for the above referenced project, w
we believe allows for the use of a "Fire Barrier" wall by reducing the "Fire Area".

Buildino Data:
The building Is single story, new construction, approximately 100'-6" x 63'-4". The Building
Area (building footprint) is approximately 5,600 s.f. and the total Fire Area (Interior area) is
approximately 5,500 sL The building height Is approximately 20'-0" high end the exterior
walls will be load-bearing, composite masonry, non-combustible walls. The roof is non-
combustible metal deck with a Class B roof covering. The construction type is 2B. The
occupancy will be A-2 - Assembly (ooffee shop) and M - Mercantile (future tenants). Each
tenant space shall have a minimum of two exits.
The coffee shop tenant (Starbucks Coffee) will lease approximately 1,800 s.f., leaving roughly
4,000 sJ. to be divided for future tenant spaces.
Code Data:
For future reference the following code analysis is based on the Wisconsin Enrolled
Commercial Building Code with the adoption of the 2000 International Building Code per
Chapter Comm 61; Subchapter 1; Comm 61.05.
Code Analvsis~
Per Table 503: Allowable Height and Building Areas, construction type 2B allows an A-2
occupancy to be two stories in height with a maximum Building Area of 9.500 s.f., and an M
occupancy to be four stories in height with a maximum BUilding Area of 12,500 sL Thus a
fire protection (sprinkler) system would not be required. based on the Buildina Area and height
limitations. The height and Bulllding Area of the new structure are well belowthe maximum
allowed requirements and an automatic sprinkler system is not reqUired.
Per Section 903; Automatic Sprinkler Systems, an automatic sprinkler system is required if the
Fire Area exceeds 5,000 sJ. for an A-2 occupancy (Sect. 903.2.1.2) or 12,500 sJ. for an M
occupancy (Sect. 903.2.6), or if the occupant load for any Fire Area is greater than 300 for an
A-2 occupancy.
Since the Fire Area of the new structure exceeds 5,000 sJ., an automatic sprinkler system
would be required. We propose to provide a YFire Barrier" wall, which would separate the
coffee shop from the future tenant{s), as described In Sect. 706.3.5: Separation of
occupancies, thereby reducing the Fire Area for anyone tenant to be less than 5,000 s.f..

The two Fire Areas would be approximately 1,800 s.f. and 4,000 s.f., satisfying the
requirements for maximum allowed Fire Areas without the installation of an automatic sprinkler
system.
Per Table 1003.2.2.2; Maximum Floor Area A1lowanC8$ Per Occupant, neither Fire Area would
exceed the maximum occupant load of 300 occupants (Sect. 903.2.1.2). [coffee shop:1,BOO
8.1./15 s.uoccupant .. 120 max. occupants and for worst cast scenario of (1) future tenant
being Group A-2 occupancy, 4,000 s.f.I15 sJ./occupant = 267 max. occupants). However, the
Landlord has Indicated that the future tenants will be Group M occupancy [4,000 s.f.l30
s.fJoccupant = 133 max. occupants).
Per Table 302.3.3; Required Separation of Occupancies; a (2)-hour fire rated "Fire Barrier"
wall (U.L. #411) shall be provided to separate occupancies A-2 and M. The "Fire Barrier" wall
shall extend from finish floor to the underside of metal deck roof structure above with
expansion track at metal deck for roof deflection.
In short, our Interpretation of the code is that an automatic sprinkler system is not required if
the maximum Fire Area limits for each use group are not exceeded. And that the code would
allow the use of a "Fire Barrier" wall as opposed to a "Fire Wall" construction to reduce the
square footage or Fire Areas.
Also, per correspondence with the OShkosh Fire Department, it is our understanding that if an
automatic sprinkler system is not required, a new on-site fire hydrant nor a fire department
hose connection onto the building will be required.
Your response regarding code compliance for the above issues would be greatly appreciated.
