YOU ARE FURTHER NOTIFIED that this order is served upon you pursuant to the
terms and provisions of Section 66.0413 Wisconsin State Statutes and in such case made
and provided. If you shall fail or refuse to comply within the time prescribed in this
notice, said building shall be razed and removed by the City of Oshkosh; and the cost of
such razing and removal shall be charged against the property, shall be a lien thereon, and
shall be assessed and collected as a special tax.
YOU ARE FURTHER ORDERED AND NOTIFIED that should you fail to comply with
this order to remove any personal property or fixtures in the above described structure ( s)
in accordance with Sec. 66.0413(1)(i) and 66.0413(1)0), Wis. State Stats., within 30 days
from the date of service of this order upon you the City of Oshkosh may store the same,
or may sell it, or if it has no appreciable value may destroy the same. In case the property
is stored and the amount paid for storage shall bea lien against such property and against
the real estate and shall be assessed and collected as a special tax against the real estate if
the real estate is owned by the owner of the personal property and fixtures. If the
property is stored and not claimed by the owner it may be sold at the expiration of 6
months after it has been stored.

Brief history review:
3/30/06 - Mike Lawless from ADVOCAP inspects property at 1035 Jefferson St. (See copy
of e-mail)
4/3/06 - After Mr. Lawless contacts this office, an inspection is arranged for April 4 with
the current tenants, who are moving out due to the conditions of the house.
4/4/06 - Contact is made with Ms Addis to inform her of the scheduled inspection of her
property later that afternoon.
4/4/06 - John Zarate, City of Oshkosh Building Systems Inspector, and I inspect the
property. Some of the violations/structural issues found:
. The crawl space was flooded with water. Possibly the water main or
lateral is broken.
. Two of the main support columns for thebouse are falling apart.
. One of the walls has pulled away from the floor system.
. The floor system is heaving and most likely rotting from the standing
water.
. The plumbing is leaking badly from the shower drain to the downstairs.
. The water heater is unable to remain lit due to a lack of combustible air.
. There is a mold problem in the attic and other areas of the house.
. See photos for specific problem locations.
4/6/06 - The house is posted unfit for human habitation.
City Ordinance and State Statues state that structures where the cost to make structural
repairs/corrections exceeds 50% of the current assessed value are deemed to be unreasonable to
repair. The current assessed value ofthe residence is $34,300 therefore only $17,150 could be
spent to fix the structure. It is the opinion and determination of this office that such repairs
would exceed this 50% value due to the many structural issues. Therefore, I am requesting
approval to have this structure razed.

on thursday march 30 I responded to a call our office received
regarding our rehab program
upon arrival at 1035 jefferson st I met with the tenant Cheryl
Coville, she
explained that the water service was broken and the crawl space was
flooded
I observed that water was up to the sill of the crawl space window, the
condition of the foundation and exterior wall at the south west corner
of the building was failing
this condition with a two story is not acceptable, and would raise
serious structural concerns ,also with the water in the crawl space for
two months mold would certainly be a concern ,the water quality also
would be a health and saftey concern
after reviewing her lease to own agreement it became evident that she
is not the owner of the property (in my view),therefore I informed her
that I could not help her with any rehab or repairs

Re: Code Issues; 1035 Jefferson St.
Dear Ms. Addis;
Per our recent phone conversation, here is a list of areas of needed repair our Inspectors were able to
identify what they inspected your property:
1) Foundation and beam support piers are crumbling apart, in need of replacement.
2) Repair the room where daylight is visible at the intersection of the wall and floor.
2) Water lateral to the building leaks into the crawlspace, needs repair/replacement.
3) The water lateral had a major leak, flooding the crawl space. Damage to building components
needs to be assessed and code compliant repairs made.
4) HV AC ductwork must be repaired/cleaned or replaced due to its proximity to the standing water
(mold/mildew concerns.)
5) Floor structure is deteriorated/decayed and is in need of repairs/replacement.
6) Install fire separation / fire blocking / fire stopping in all exposed areas.
7) Install compliant plumbing in all areas where accessible and where finish surfaces are opened for
repaIrs.
8) Install compliant electrical in all areas where accessible and where finish surfaces are opened for
repaIrs.
9) Remove water heater from upstairs closet and install in an approved location.
10) All appliance venting (furnace, water heater) shall be properly installed. Unknown where these
appliance vents terminate.
11) Clean and seal all areas where mold growth has occurred.
12) Replace/repair all water damaged areas.
13) Replace all moisture damaged insulation (in crawl space and other areas as discovered.)
14) Install vapor barrier over dirt/gravel floor in crawl space.
15) Install compliant roof venting.
16) Repair, provide compliance with any/all code violations discovered as finish surfaces are
removed. (headers, insulation, vapor barriers, electric, plumbing, etc.)
17) Deteriorated skirting on house needs to be replaced.
18) Regrade perimeter of building so storm water drains away from the building.
19) All areas where paint is chipping / peeling shall be repaired (scrape, prime and paint or covering
with maintenance free siding.)
20) Yard/grass maintenance has not been continually addressed since the house was posted "unfit".
This office recently sent a request to the Street Division to have the grass cut at this address
because it exceeded 8" in height. By policy, each property owner is given one warning per year
(this warning is inclusive of all properties owned by an entity) before the City of Oshkosh cuts
grass on private property. Since, you were given notice for yard maintenance at property you own
on Rosalia St., this office did not give formal notice for this property.

As discussed, this office generally will work with reasonable proposed schedules toward compliance.
However, should this property attract vandalism or rapidly deteriorate, this office would then be
obligated to reconsider such schedules.
Given the significant deterioration of the foundation and floor system, we have determined this
building to be unreasonable to repair. Keep in mind, the conditions noted are what is visible to the
naked eye. It is our experience that when attempts are made to repair structures exhibiting these
conditions, there is also a host of similar conditions that will be discovered as one progresses with
repairs. For example, it would not be unrealistic to find deteriorati.on of the wall studs given the
deterioration noted in the floor framing system. Many times this is a natural progression with
deterioration.
