YOU ARE HEREBY NOTIFIED that the two-story masonry/wood frame structure
situated on the following described property, to wit:
The East Fifty-two (52) feet of Lot Seven (7) of Block One (1) in WASHBURN'S
ADDITION, in the Tenth Ward, City of Oshkosh, Winnebago County, Wisconsin, per
Leach's Map of 1894, and now in the fifteenth Ward of said City.
The East Fifty-two (52) feet of the North Four (4) feet of Lot Six (6), and the East Fifty
(50) feet of Lot Six (6) excepting therefrom the North Four (4) feet thereof, in Block One
(1) in WASHBURN'S ADDITION, in the Tenth Ward, City of Oshkosh, Winnebago
County, Wisconsin.. per Leach's Map Of 1894 and now in the Fifteenth Ward of said City.
Which premises are owned by you and known as, 13 :East Custer Avenue, Oshkosh,
Wisconsin has become damaged to such an extent as to be dangerous, unsafe and
unsanitary; otherwise unfit for human habitation, occupancy or use; is in danger of
structural collapse; and is in a condition making it unreasonable to repair the same.
THEREFORE, you are hereby ordered to raze and remove this building within thirty (30)
days from the date of service of this order upon you.
YOU ARE FURTHER NOTIFIED that this order is served upon you pursuant to the
terms and provisions of Section 66.0413 Wisconsin State Statutes and in such case made
and provided. If you shall fail or refuse to comply within the time prescribed in this

notice, said building shall be razed and removed by the City of Oshkosh; and the cost of
such razing and removal shall be charged against the property, shall be a lien thereon, and
shall be assessed and collected as a special tax.
YOU ARE FURTHER ORDERED AND NOTIFIED that should you fail to comply with
this order to remove any personal property or fixtures in the above described structure(s)
in accordance with Sec. 66.0413(1)(i) and 66.0413(1)(j), Wis. State Stats., within 30 days
from the date of service of this order upon you the City of Oshkosh may store the same,
or may sell it, or if it has no appreciable value may destroy the same. In case the property
is stored and the amount paid for storage shall be a lien against such property and against
the real estate and shall be assessed and collected as a special tax against the real estate if
the real estate is owned by the owner of the personal. property and fixtures. If the
property is stored and not claimed by the owner it may be sold at the expiration of 6
months after it has been stored.

It has come to the City's attention that you have recently purchased the property at 13 E. Custer
Avenue. The purpose of this letter is to explain the current zoning status of the property, as welf as
assist you in outlining the permitted uses for the property should you desire to improve the property.
. . . The .subject property is zoned R-2 Two Family Residence District. The subject property previously was
occupied by a legal nonconforming use, a. use existing prior to the introduction of zoning standards that
would restrict use. Since this nonconforming use was discontinued anq the property sat vacant for a
period of time greater than 12 months, only uses permitted in the R-2 zoning district may be
reintroduced at the property. Due to lot size restrictions, a single family dwelling will be the only
permitted residential use of the property.
.. The structure on the subject property is nonconforming in terms of setback from property lines. The
City's Zoning Ordinance establishes guidelines for maintenance and repair of nonconforming structures,
which may. impact your plans to rehabilitate the structure. Specifically, any structural improvements
(modifications to supporting members of a'structure, such as bearing walls, columns, beams, girders, or
foundations) may not exceed the value cap of $7,200. Remodeling and routine repairs such as
windows, doors, drywall and insulation, electrical and plumbing upgrades, roof shingling are not
considered structural improvements, and therefore would not be counted against the structural value
cap.
Please contact our office in regard to any plans to introduce a use on the property, as I will be able to
assist you in obtaining zoning approval for use of the site. Be advised, cold storage or warehousing use
is not considered a permitted use in the R-2 district, the property may not be used for a cold
storagelwarehousing activity.

It has been over a year since we have had any contact with you regarding this property. The
purpose of this letter is to request that you contact us and advise us of how you intend to bring
this property into compliance with municipal code requirements.
As was indicated in a January 27, 2004 letter from Matt Tucker, this property is zoned R~2 Two
Family Residential District, and since the prior legal non-conforming use was discontinued, only
uses permitted in the R-2 zoning district may be reintroduced. Additionally due to the lot size
restrictions a single family dwelling will be the only permitted residential use of the property.
When you applied for a permit to replace drywall, and insulate on January 25,2005, we explained
that conversion of the commercial building to a single family residence, required the whole
structure to comply with current State of Wisconsin Uniform Dwelling Code requirements at the
time of conversion. We discussed some of those requirements, and the likelihood that you may
need to apply for variances for the requirements you may not be able to meet. In order to obtain a
permit to convert this building to a single-family residence, complete plans are required to be
submitted. A copy of the Plan Submittal Checklist for 1 and 2 family homes is enclosed for your
reference.
Since that time the exterior of the building has continued to deteriorate, and become a nuisance.
While I realize you are faced with a difficult decision, which may not be appealing, we can not
ignore the fact that the building is required to be brought into compliance with municipal codes.
Please contact me in the next 10 days to advise as to your schedule for bringing this building into
compliance. Without any contact from you, we will be forced to begin the abatement process,
which may result in a raze order being issued.
