YOU ARE HEREBY NOTIFIED that the two-story wood frame house situated on the
following described property, to wit:
Lot Twelve (12) of Block Eighty (80) in the Plat of the Original Third Ward, in the Sixth
Ward, City of Oshkosh, Winnebago County, Wisconsin, per Leach's Map of 1894 and
now in the Ninth Ward of said City.
Which premises are owned by you and known as, 403 W. 6th Avenue, Oshkosh,
Wisconsin has become damaged to such an extent as to be dangerous, unsafe and
unsanitary; otherwise unfit forhuman habitation, occupancy or use; is in danger of
structural collapse; and is in a condition making it unreasonable to repair the same.
THEREFORE, you are hereby ordered to raze and remove this building within thirty (30)
days from the date of service of this order upon you.
YOU ARE FURTHER NOTIFIED that this order is served upon you pursuant to the
terms and provisions of Section 66.0413 Wisconsin State Statutes and in such case made
and provided. If you shall fail or refuse to comply within the time prescribed in this
notice, said building shall be razed and removed by the City of Oshkosh; and the cost of

such razing and removal shall be charged against the property, shall be a lien thereon, and
shall be assessed and collected as a special tax.
YOU ARE FURTHER ORDERED AND NOTIFIED that should you fail to comply with
this order to remove any personal property or fixtures in the above described structure(s)
in accordance with Sec. 66.0413(1)(i) and 66.0413(1)0), Wis. State Stats., within 30 days
from the date of service of this order upon you the City of Oshkosh may store the same,
or may sell it, or ifit has no appreciable value may destroy the same. In case the property
is stored and the amount paid for storage shall be a lien against such property and against
the real estate and shall be assessed and collected as a special tax against the real estate if
the real estate is owned by the owner of the personal property and fixtures. If the
property is stored and not claimed by the owner it may be sold at the expiration of 6
months after it has been stored.

A correction notice was sent to the previous owner stating that the building was to be razed due to
fire damage. The notice also stated that if the owner was intending to try and repair the structure
that an interior inspection would need to be conducted to assess the damage and determine if the
structure was capable of being repaired. This structure is non-conforming in relation to setbacks
established in the City Zoning Ordinance. City Ordinance and State Statues state that structures
where the cost to make structural repairs/corrections exceeds 50% of the current assessed value are
deemed to be unreasonable to repair.
An interior inspection was conducted upon the request of the new owner's property maintenance
supervisor, James Dobbins.
A letter was sent to Mr. Cech detailing the violations noted at the inspection. The letter noted that a
written statement was required to be submitted detailing his intentions for the property. It is the
determination ofthis office that the structure is damaged more than the allowed 50% ofthe current
assessed value.
No contact from the owner on this property.

Dear Mr. Cech,
An interior and exterior inspection of your property was conducted on 6/22/06 per a request from James Dobbins
your property maintenance supervisor. In reviewing the property file it appears that a correction notice for razing
and/or repairing the structure was issued back on 1/19/06. To date no work has been done on this structure. The
following items will need to be repaired/replaced in order to avoid razing this property.
1. The house is to be gutted down to the studs. All insulation and plaster would be required to be
removed and replaced.
2. All damaged wood requires replacement. This would include but not be limited to the roof
sheathing, rafters, 1st floor joists (due to plumbing cuts), wood board siding, rim joists, stair
treads, stair risers, fascia boards, soffit areas, possible stair stringers, etc. Please note that the
stairway will need to meet MUN 7-34 Stairways can be rebuilt in the same opening
provided.. ..
a) The dimension of the riser shall not exceed the dimension of the tread
b) The max. dimension of the riser shall not exceed 9 inches.
c) A min. of 6' headroom is required.
d) The treads and risers shall not vary in uniformity by more than 3/16 of an inch for
the entire length of the stairway.
e) Code compliant handrails are required.
3. Replace the furnace, venting and the water heater due to the appliances getting wet. The
manufacturer will not warranty appliances that are submersed for any amount of time.
4. Two code compliant exits will be required.
5. All the electrical is to be replaced in addition but not limited to the service pane1.
6. All plumbing is to be replaced including fixtures.
7. The roof will be required to be re-roofed. All venting shall comply with minimum code
requirements. Please note that all the rafters may need to be replaced once an inspection is
conducted.
8. The siding is to be replaced and is required to match.
9. All deteriorated windows will require replacement.
10. The basement beam will need additional support due to the beam sagging. The second floor
system will require an inspection due to the 2nd floor system sagging. Additional support will
be required if the floor joists are undersized or deteriorated.

If it is your intention to repair this structure, bids must be submitted to our office detailing the cost of the above
noted repairs. In addition to the bids, a detailed time line will be required. Please note that should you elect to
repair this structure, additional violations may be found during future inspections.
The City of Oshkosh Municipal Code adopts Section 66.0413 of the State Statues regarding the razing of old
buildings. It is the determination of this office that this building has deteriorated to a point where it may be
unreasonable to repair. It would appear that repairs to the building would exceed 50% of the current assessed
value. The current assessed value for this structure is $8,700 therefore a maximum of $4,350 could be used to
repair this structure. Even if you would petition to use the old assessed value of the structure which was $62,300,
that would only leave $31,150 to be applied to the structure for the remaining life of the structure.
Please note that a written statement will be required stating whether you plan on razing or repairing the structure.
When submitting this statement also include a detailed itemized list of items that will be repaired, the costs to make
such repairs and the time frames for repairing the violations. Once our office receives this information we can make
a determination as to whether the structure can be repaired or if it has to be razed. Compliance would need to be
secured in timely manner due to the structure sitting like this for the last six months. Please also note that a stop
work order has been posted on site and no work is to be done until it is determined if the structure is capable of
being repaired.
