THIS INDENTURE, made this 27th day of September ,2006,
by FOX CITIES CONSTRUCTION CORP., Grantor, and the CITY
OF OSHKOSH, a Wisconsin Municipal Corporation, Grantee,
WITNESSETH:
IN CONSIDERATION of the sum of One Dollar ($1.00) and
other good and valuable consideration paid by the Grantee, the receipt of
which is hereby aclmowledged, the Grantor does hereby give and grant unto
the Grantee, its successors and assigns, an easement in, under and over the
land hereinafter described, including the right to enter upon said land for
the purpose of construction, maintaining, and repairing a cuI de sac
upon certain tracts ofland situated in the City of Oshkosh, Winnebago County, 12-2580-0800
Wisconsin, and described as follows: Parcel Identification Number (PIN)

A part of Lot 1, Certified Survey Map No. 5907, Winnebago County Records in the SW ~ oftbe
SW 14 of Section 2, Township 18 North, Range 16 East, 12th Ward, City of Oshkosh, Winnebago
County, Wisconsin described as follows:

Commencing at the southwest corner of said Lot 1 being on the east line of Progress Drive; thence
N. 00032'34" E., 192.66 feet along the east line of Progress Drive to the true point of beginning; thence
northeasterly 118.38 feet along the arc of a curve concave to the left of 50 feet radius whose chord bears
N. 04003 '03" E., 92.61 feet; thence northwesterly 11.23 feet along the arc of a curve concave to the right of
10.00 feet radius whose chord bears N. 31037'03" W., 10.65 feet to a point on the east line of Progress Drive;
thence S. 00032'34" W., 101.44 feet along the east line of Progress Drive to the true point of beginning.
Said parcel contains approximately 2,362.27 sq. ft.
Note: This cul-de-sac easement to be released in writing at such time as Progress Drive is extended to the
South.
IT IS FURTHER MUTUALLY AGREED that no building or other substantial or permanent structure shall
be placed upon said property, and Grantor shall keep the premises completely free of all obstructions.
The Grantee releases the Grantor from all debts, claims, demands, damages, actions and causes of action
whatsoever which may result from said easement heretofore granted by Grantor, and further agrees to hold the
Grantor free and harmless from any claim for damages which may be made by reason of damages or injury to persons
or property connected therewith.
