PLAN COMMISSION RECOMMENDATION: All approved with conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property, and the Planned District
Overlay and final development plans, per the attached exhibits, are hereby approved.
A) 420 N. Main Street; D&M Rentals LLC, owner
A conditional use permit for a mixed commercial/residential use, per the attached
"Exhibit A", with the condition that the design and placement of the trash receptacle is
subject to staff approval.
B) 3285 S. Washburn Street; Bergstrom of the Fox Valley, Inc., owner
A conditional use permit for expansion of an existing planned commercial development
for construction of a new auto sales and service facility with display lot, construction of
an automobile wash facility, construction of automobile display "pods"/platforms, and
revision to site stormwater facilities, per the attached "Exhibit B", with the following
conditions:
1 ) A land division containing cross access easements be submitted.
2) The display "pod"/platform in the sanitary sewer easement be relocated outside
of the sanitary sewer easement area.
3) Submittal of a revised site plan meeting the requirements of the Zoning
Ordinance.
4) The driveway onto future McClone Drive not be constructed until the public street
is constructed.
5) Submittal of a revised landscape plan meeting the requirements of the Zoning
Ordinance and incorporating islands at drive aisle ends with said revised plan to
be approved by the Dept. of Community Development.
6) Base standard modification to allow a 10ft. setback on the interior side yard
setback of the northern lot.

PROJECT OVERVIEW
1. Proposed use of property: Refer to Conditional use permit.
2. Existing use of property: Refer to Conditional use permit
3. Identification of structures:
a. Hondaffoyota building (south of proposed new Toyota building)
b. Nissan building (south of proposed new Toyota building)
c. Used Import car building (on proposed new Toyota building) this building is to be
demolished
4. Compatibility ofadjacent properties: All new construction is happening in a developed area
where all buildings are used for the same purpose (automotive). Screening will be provided at
neighboring property lines, adjacent to vacant properties, to encourage outside future
development. The East property line is the frontage road and HWY 41.
5.. Traffic generation. The two (2) access points provided for the overall development should not
hinder vehicUlar or pedestrian circulation. One (1) additional access point has been provided for
when the future McClone road is developed The proposed site activity should not adversely
impact current traffic circulation.
6. Proposed site construction overview:
a. Construction of a new automotive dealership for the sales and service of Toyota vehicles.
b. Construction of a new carwash facility for use by the new and existing automotive
facilities only. The facility will not be open to the public.
c. Construction offive (5) vehicle display pods along South Washburn Street.
d. Construction of a new storm water detention pond capable of detaining all storm water
from the Honda, existing Toyota, Nissan and new Toyota facilities, including all paving
areas associated with these buildings. This would resUlt in the elimination of the two (2)
detention ponds along Washburn Streetand the drainage ditch along the north side of the
existing Toyota Facility.
e. Eliminate the existing storm water detention pond to the west (rear) of the Nissan facility
to create additional inventory parking stalls. This water would be diverted to the new
pond being provided.
7. Proposed overall site overview:
a. The existing site is one (1) individual property containing (4) automotive sales and service
facilities. The owner purchased vacant property to the north of the existing site and to the
west of the existing site. The site purchased to the north is not large enough in area to contain
the Toyota Image USA II program required by the Toyota franchise. We are proposing to
adjust property lines in order to create an area sufficient in size to construct the new Toyota
building. The Toyota franchise mandates that their new facilities are not on shared properties.
We are applying for a variance to the 15'-0" minimum side yard setback in order to
accomplish this.

15' SIDE YARD SETBACK
1. Currently there are four automotive related 8ale8 facilities operating on
one individual site. The Toyota franchise is requiring Berg8trom
Automotive to upgrade the existing facility to a new prototype building
which will house both Toyota and Scion vehicles. Toyota requires this
new facility to be independent of any other vehicle franchise, including
shared maintenance facilities and property. To provide for the new
facility, additional property was purcha8ed to the north of the exi8ting
dealer8hips. Bergstrom Automotive i8 requesting to create two
parcels, one that will accommodate the requirement8 8et forth by
Toyota and one which will accommodate the three existing brands.

2. Because Bergstrom Automotive will own all of the adjoining properties,
the approval of this variance will not adversely affect the surrounding
properties.
3. The new Toyota facility has a size and layout, which is dictated by
Toyota. These mandated standard8 require a set frontage dimension
and spacing module. In order to facilitate the required building size,
fire and transport vehicle access, and required property independence
from adjoining facilities, Bergstrom Automotive is requesting that a
separate property be created to the north of the existing Nissan
dealership. The new south property line will be set as close as legally
possible to the north side of the Nissan building. A 20' landscape
buffer with intermediate access drive will be provided to conform with
the 8ame principle8 behind the required 15' 8ide yard 8etback. Thi8
type of variance is consistent with a similar project in the area.
4. If Bergstrom Automotive is not granted the requested variance, the
new Toyota facility may not be constructed of adequate size to
support the customer demand for Toyota vehicles. Furthermore, if the
variance is not approved as requested and the facility size is
compromised or if the facility is forced to be on shared property,
Toyota has the option to take away the franchise rights. This would
directly affect the amount of employment in the area; which is a
hardship on the community.

DISPLAY POD VARIANCE
1.
Bergstrom Automotive plans to construct a new state-of-the-art
Toyota/Scion dealership north of the existing dealership complex at
3285 South Washburn. In an effort to improve the ae8thetics in front
of the exi8ting dealerships and facilitate improved Vi8ibility of each
franchise vehicle display, Bergstrom Automotive is requesting a
variance to allow encroachment of three vehicle display POd8 into the
25' front yard setback at the existing Toyota, Nissan and Honda
dealership sites. -,

Currently there is storm water detention in front of each existing
facility. The area i8 approximately 40' wide and runs the length of
the property. During most of the spring and summer sea8on, thi8
area is too wet to mow and keep well maintained. The deformation
for the pond also acts as a collection basin for debris. In order to
reconcile these issues, Bergstrom Automotive is having these
detention areas, as well as the remainder of the storm water system,
redesigned and relocated. This will allow for improved water flow
and permit this area to be properly maintained. Allowing the display
pods with integrated landscaping and the addition of landscaping
throughout this area will significantly improve the aesthetics of the
immediate area and 8urrounding properties, while providing for
improved vehicle display features. (Refer to attached photo's.)

The existing site does not provide sufficient area for the installation
of the requested display pods within the required setback area
without significantly affecting the vehicle inventory and customer
parking in the immediate area,

If the variance request to encroach into the required 25' front yard
setback is not granted, the aesthetics along Washburn Street will be
minimally enhanced. If thi8 variance is allowed, well designed
features and a significant amount of landscaping will be provided that
does not currently exist and is not required to be provided.

BERGSTROM AUTOMOTIVE, OSHKOSH
PYLON SIGN
1. Bergstrom Automotive anticipates the construction of a new state-of-
the;.art Toyota/Scion prototype dealership. The proposed dealership
will be constructed on a portion of an existing parcel currently
housing a used car facility and a new parcel purchased to the north.
It i8 required by Toyota that this new Toyota/Scion dealership facility
be on a separate and independent parcel of property. A reader
board, located on the northern boundary of the existing property in
front of the used car building, advertises all of the vehicle brands on
site. Once the separate parcel for Toyota. is created, this universal
advertising pylon sign may be considered off premise advertising.
To adequately advertise all of the existing vehicle brands, Bergstrom
Automotive is requesting a variance to keep the existing reader
board in its current location.
2. The immediate surrounding properties are owned by Bergstrom
Automotive. Granting this variance will not have an affect on these
properties or any other surrounding properties. There will be four
automotive vehicle brands being represented on this sign with the
actual buildings existing on two individual parcels. (Refer to attached
photo.)
3. There will be four separate businesses selling vehicles on two
parcels of property. This i8 a unique special connection that does
not exist on other surrounding properties.
4. If this variance is not granted, a hardship will be created by reducing
the necessary advertising to adequately sU8tain a customer base
that is necessary for the success of four automotive franchises.
