PLANNED DEVELOPMENT /764 & 770 ELMWOOD AVENUE
INITIATED BY:

PLAN COMMISSION RECOMMENDATION: Approved w/conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit for a planned development for construction of a ministry center,
to include worship space, student gathering area, offices and external gardens, per the
attached, is hereby approved with the following conditions:
1) Base code modification to permit parking to be located off-site with the
establishment of a parking agreement between the Newman Center and the
University.
2) Base code modifications to allow building setbacks of 15 ft. on Elmwood Avenue,
6.5 ft. on West Lincoln Avenue, 6 ft. on the east lot line and 5 ft. on the north lot
line.
3) Base code modification to allow the at-grade patio and walks to be placed at the
property line.
4) Curb cuts and terrace walks to the property be removed.
5) Mechanical equipment and refuse enclosure be fully screened from view and
located as to not detract from the aesthetics of the development with said plans
to be approved by the Department of Community Development.
6) Submittal of a landscape plan to be approved by the Department of Community
Development.
7) Submittal of a grading and drainage plan to be approved by the Department of
Public Works
8) Initiation of construction shall commence within 24 months of approval of the
conditional use permit.
BE IT FURTHER RESOLVED that the Common Council of the City of Oshkosh
hereby approves of the Planned District Overlay and final development plan per the
attached "Exhibit A".

Conditional Use Narrative for
Newman Center of Oshkosh Ministry Center
764-770 Elmwood Avenue

The primary use of the property is proposed to be worship and related
ministry services for the Roman Catholic student community attending the
University of Wisconsin - Oshkosh. The building will contain a chapel
seating up to 150 persons for Sunday evening liturgy and other occasional
special worship services, a gathering space and lounge for students with
seating for up to approximately 30 students, and offices for up to four full-
time staff. The site is also designed to feature a landscaped "prayer garden"
in the northeast corner that will be screened from the adjacent parking lots to
provide a place suitable for private meditation.
The existing use of the property is residential.
The existing buildings, formerly two single-family houses and a garage, all
constructed of wood frame and all of which had been converted to student
housing, will be demolished to allow construction of the new ministry center.
The new ministry center is designed to accommodate up to 150 persons for
weekly Sunday evening worship services during the school year
(approximately September - May), seating for about 30 students in a
"student lounge" atmosphere seven days a week except Sunday evenings,
and up to four full-time employees.
The building is planned to be one-story with partial basement for long-term
storage only. The gross area of the first floor will be about 5,670 square feet,
and the basement is planned to .measure' about 1,485 square feet. The
entire site measures about 11, 584 square feet (or 0.27 acre). The prayer
garden will be more than 1,800 square feet in area. Other landscaped areas
around the building will total an additional.1, 100 square feet, approximately.
No parking spaces are provided on the property. A parking agreement with
the University of Wisconsin-Oshkosh allows full use of the adjacent parking
lot on Sunday evenings and provides four (4) permanently designated
parking spaces for employees and (2) passes for visitors' parking during the
remainder of the week. Please see the attached e-mail describing terms of
this parking agreement.

There is anticipated to be no negative impacts of this use upon the adjacent
property, which is a dedicated parking lot for the university.
This proposed use is compatible with the immediate adjoining property (the
parking lot) and is designed to serve the needs of students living in nearby
campus dormitories.
Most of the students served are expected to arrive to the site from their
dorms or classrooms on foot. The only measurable vehicular traffic
anticipated will be generated on Sunday evenings before and after the
regularly scheduled worship services. The number' of vehicles in use at this
time is conservatively estimated not to exceed thirty (30).

The Newman Center shall have full use of the Premises (Parking Lot #34 at the corner of Elmwood
Avenue and West Lincoln Ave, Oshkosh, WI.) on Sunday evenings at which time the Newman Centl;:r
will be holding its Sunday mass.
The Newman Center shall also have four (4) permanently designated parking spots on the Premises at
the cost of $250 each per year and also the use of two (2) Visitor Passes for guests at the cost of $165
each per year. These rates are subject to changes in future years. The Visitor Passes will be used at ~my
available parking spot on the Premises that is not a reserved or restricted parking spot.
