HomeMy WebLinkAbout06-356 DECEMBER 12, 2006 06-356 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN X PURPOSE: GRANT PRIVILEGE IN STREET; GRANT EASEMENT - 2551 WAUKAU AVENUE INITIATED BY: MI-TECH SERVICES AND AT&T, PETITIONERS PLAN COMMISSION RECOMMENDATION: Approved w/conditions WHEREAS, Mi-Tech Services on behalf of AT&T Wisconsin request the Common Council grant a privilege in street to AT&T Wisconsin for the installation of telecommunication facilities including underground cable and two above ground telecommunications cabinets, per the attached map; and WHEREAS, Section 66.0425, Wis. Stats., provides for the granting of a privilege in a right-of-way; and WHEREAS, the Plan Commission has approved of this request with conditions. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant AT&T Wisconsin a privilege in street for installation of telecommunication facilities, per the attached map, contingent upon the following: 1) Any items to be installed underground or placed on site be installed in a manner that is approved by the Dept. of Public Works with no modifications or changes in construction procedure without prior approval by the Dept. of Public Works. 2) If no longer needed all items to be properly abandoned and removed in accordance with City standards and under the direction of the Dept. of Public Works. 3) Any problem that may arise as a result of placement of the items be the responsibility of the petitioner/owner to correct in coordination with the Dept. of Public Works. 4) All appropriate permits be obtained prior to the start of placement of the items. 5) The items be modified or removed immediately upon the request of the City. 6) The petitioner/owner secures and submits to the City Clerk a separate insurance policy which names the City as an additional insured with a minimum coverage of $200,000 per person and $500,000 in general aggregate. DECEMBER 12, 2006 06-356 RESOLUTION CONT'D 7) It is the responsibility of the petitioner/owner to file in a timely manner a new insurance certificate with the City Clerk upon expiration of an existing certificate. Failure to do so will result in the revocation of the privilege in street within ten (10) days of notice. 8) The petitioner/owner execute a hold harmless agreement with the City. 9) No equipment that is to be used for video services can be installed and that no video can be offered under the City's cable television ordinance without AT&T first entering into a franchise agreement or similar agreement with the City of Oshkosh. 10) Additional landscaping be installed to act as a visual buffer of the masonry structure and above ground cabinets per the Department of Community Development. BE IT FURTHER RESOLVED that the Common Council hereby grants an easement to AT&T Wisconsin, per the attached map. October 24, 2006 Jeffrey Nau City of Oshkosh 215 Church Ave. Oshkosh, VV1 54903-1130 Subject: AT&T Eas.ement Request and In Street Privilege Request Dear Mr. Nau: AT &T Wisconsin is proposing to add additional telecommunications equipment next to an existing structure located at 2551 Waukau Ave. in the City of Oshkosh to provide service to the surrounding area. The existing brick structure is located panly within the southwesterly Right of Way ofWaukau Ave. as it exists today and partly on a parcel owned by the City of Oshkosh. Other than the existing telephone facility no other use is being made ofthis M-3 zoned parcel which is surrounded by Industrial to the North, Multi-Family to the South, a vacant area to the East and Offices to the West. AT&T is requesting an In Street Privilege for the portion of the building that is located in Waukau Ave. Right of Way, and an expanded easement to include the existing facilities as well as the proposed expansion cabinets to be placed southwesterly of the existing building located on the City owned parcel. A cabinet of approximately 70 inches tall and 70 inches long and 50 inches in depth would be placed as soon as possible, followed by a cabinet of about 63 inches tall and 43 inches wide. The location of the current facility as well as the proposed cabinets and proposed landscaping are shown on the attached site plan. The facility is typically unmanned and no sewer or water will be required and there will be no outside storage I have included with this letter, for review, the following: . Our firm represents AT&T Wisconsin, the applicant in connection with Resolution 06-356, which is scheduled for consideration by the Common Council at tonight's meeting. At this time, we respectfully request that AT&T be permitted to withdraw its application for a special privilege/easement in the vicinity of 2551 Waukau Avenue. AT&T believes that additional surveying and/or engineering work is necessary in order for the company to clarify its request before the application is considered by the Common Council. AT&T intends to re-submit an application at some point in the future, once this additional work is completed. As you suggested, we will notify staff at the Planning Services Division and the Public Works Department to inform them of AT&T's decision to withdraw its request. Based on our phone conversation, it is my understanding that no additional action is required in order for the request to be withdrawn and that, as a result of the withdrawal, the Common Council will not be discussing the item at tonight's meeting.
