PLANNED DEVELOPMENTS:
A) BOWEN STREET, NORTH OF 1601 BOWEN STREET
B) SOUTHEAST CORNER STH 91 AND STH 44

PLAN COMMISSION RECOMMENDATION: All found consistent with Standards set forth in
Section 30-11 (D) of the Zoning Ordinance and approved w/conditions as noted
BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional
use permits are hereby granted for the following properties under Section 30-11 of the
Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as
noted for each respective property, and the Planned District Overlay and final development
plans, per the attached exhibits, are hereby approved.
A) Bowen St., North of 1601 Bowen Street; James Lang, owner
A conditional use permit for a planned commercial development for construction of a gas
station/convenience store and open lease space, and associated amenities, per the
attached "Exhibit A", with the following conditions:
1) Base code modification to allow the placement of a monument sign, no greater than
8 ft. tall, with a 13 ft. front yard (Bowen Street) setback.
2) Vegetation at the entrances within 15 ft. of the right-of-way be limited to a maximum
height of 30 inches.
3) The height of the light poles be limited to 24 ft. and the fixtures be angled no greater
than 90 degrees with illumination levels at all lot lines meeting code.
4) Plans related to storm water management be reviewed and approved by the
Engineering Division.
5) Access routes not used be closed off.
6) Ingress/egress lanes be marked with painted arrows on the pavement indicating turn
movement.
B) Southeast Corner STH 91 and STH 44; Lenn & Elizabeth Rohde, owners
A conditional use permit for a planned development to permit placement of nursery stock on
an undeveloped parcel, per the attached "Exhibit B", with the following conditions:
1 ) No ingress/egress access to STH 44.
2) Parking area to be hard surfaced per Zoning Ordinance specifications.
3) No open storage of any materials, other than nursery stock, on site.
4) No open storage of vehicles or agricultural equipment and/or implements.
5) Nursery stock to be placed in organized rows on the site per the submitted site plan.

Dear Mr. Buc:k,
I have been in the nursery business for over 40 years. At this time we grow trees ai'
our present location, approximately 2 miles south of Neshkoro. We also perform all
outdoor landscaping services to residential & commercial customers in an approximate
60 mile radius of Neshkoro. Last year we opened a retail plant center on State Hwy.
73, south of Neshkoro at our present location.
We own approximately 2.5 acres on Hwy. 44 at the SE corner of 9Ist & 44
intersection, City of Oshkosh parcel #1329370000. At present,it is vacant land with
no buildings. Balled & burlaped or potted trees would be set on the ground in rows &
mulch placed around the trees until planted on customer's property. I would like to
have this property re-c1assified as a plant or holding center to mulch in plant material
until use in our projects. Your immediate attention on this matter would be greatly
appreciated.
