HomeMy WebLinkAbout06-276 SEPTEMBER 13, 2006 06-276 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN PURPOSE: SET REFERENDUM TO SET GARBAGE FEE FOR 2007 INITIATED BY: CITY ADMINISTRATION WHEREAS, the City Clerk received a petition on August 3, 2006 and on August 11, 2006, certified as to the sufficiency of the petition for direct legislation filed pursuant to section 9.20 of the Wisconsin Statutes and proposing to establish the fee for residential garbage service in the City of Oshkosh at $0 for calendar year 2007; and WHEREAS, section 9.20 of the Wisconsin Statutes requires that the Common Council of the City of Oshkosh either pass the proposed resolution without alteration or, in the alternative, to submit the resolution to the electors of the City of Oshkosh; and WHEREAS, the petition for direct legislation submitted to the City Clerk requests that the Council submit the resolution to the electors; and NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper city officials are hereby authorized and directed to place the question presented in said petition on a referendum ballot to be voted on at the time provided by statute for holding the general election, i.e. November 7, 2006. BE IT FURTHER RESOLVED that the question presented to the electorate shall be: Shall the City of Oshkosh establish a fee of ZERO DOLLARS per month per residential unit for collection by the City of Oshkosh of solid waste and recyclables? Yes No Section 9.20(6) of the Wisconsin Statutes does not require the entire text of the proposed ordinance or resolution to be printed on the ballot; rather "a concise statement of its nature shall be printed together with a question permitting the elector to indicate approval or disapproval of its adoption." The ballot contains a referendum question that, if adopted by the electors, would establish the fee for garbage services at $0 for 2007. A yes vote indicates approval for setting the fee at $0. A no vote indicates disapproval and would allow the common council to set the fee by resolution. If adopted by the electorate, the resolution would be effective for calendar year 2007.
