PLAN COMMISSION RECOMMENDATION: All found to be consistent w/standards set forth in
Section 30-11 (D) & approved w/conditions as noted
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property.
(A) 910 W. Murdock Avenue; 910 W. Murdock LLC, owner
A conditional use permit to establish a tire service facility with enclosed outdoor semi-
trailer storage, per the attached "Exhibit A", with the following conditions:
1) No outside storage of inventory, materials, truck parts or vehicles to be serviced.
2) No permanent outside storage of semi-trailers at the site.
B) S. Oakwood Road; Living Water Lutheran Church, owner
A conditional use permit to construct a 10,000+ sq. ft. church, and associated amenities,
with after school day care, per the attached "Exhibit B", with the following conditions:
1 ) Detention basin to be designed without riprap above the water line and native
plants to be planted on the side slopes of the basin and emergent plants on the
safety shelf with final design to be approved by the Dept. of Community
Development and Dept. of Public Works.
2) Attachment/annexation to the City of the Town of Algoma portion of the
development.

The following information is the written narrative for the conditional use permit and the
variance request for our non-standard driveway.
1. Proposed Use of the Property
The proposed use of the property will be for Living Water Lutheran Church. They
plan to have a sanctuary for 2l6'person capacity and a Sunday school operation.
They also will have some general administrative services as they relate to the
church and Sunday school functions.
2. Existing Use ofthe Property
The existing site is currently zoned Rl residential and is currently a vacant land site.
3. Identification of Structures on the Property and Relation to the Project
There are currently no structures on the property. We propose to build (1) main
church building with potential expansion options per the attached site plans. We
intend tol?uild a future garage at some point as shown on the site plan. The main
building will serve as our sanctuary, Sunday school, fellowship area, and
administrative office. The future garage will store our lawn mowers, athletic
equipment, yard tools, etc.

4. Projected Number of Employees or Parishioners
We anticipate a staff of 3-5 people consisting of 1 or 2 pastors, (1) office assistant,
1-2 Sunday school teachers, and (1) part time janitor. Currently we have about 140
members but hope to grow to 300 to 500 parishioners in the next 5-10 years. The
main use of the facility will be on Thursdays and Sundays for our worship services.
The other days of the week are sporadic based on smaller functions such as quilting.
groups, ladies aid, after scho'ol daycare, ~tc.
5. Proj ect Data
A. Proposed Floor Area: 10,300 Sq. Ft
B. Landscape Area: 6.89 Acres
C. Asphalt Paving for Parking and Driveways: 1.03 Acres
6. Effect on Adioinillg Properties
A. Noise: We are a: quiet operation, The only noise we would generate would be
minimal noise from kids on the playground.
B. Hours of Operation: Our main hours of operation are Sunday mornings and
Th~sday evenings for our church services. We may have an after school daycare
operation in the late afternoons on Monday through Friday. Sunday school is on
Sunday mornings as well. All other use is periodical as groups plan meetings.
C. Glare: There will me minimal glare due to berming and landscape buffer we
will be providing on the South side of our site. In addition our site lighting will
be directed to the interior of our site and all exterior light pole fixtures will have
adjustable cut-offs.
D. Odor: There will be no odor coming from our proposed development project.
E. Fumes: There will be no fumes corning from our development other than
normal car traffic.
F. Vibration: No vibration is to be expected after construction is complete.
7. Surrounding Land Uses
East: R3 Multi-family Dwellings
North: Town of Algoma - Planned for future R-1
South: R-l, Single family
West: R-1, Town of Algoma

8. Compatibility of Proposed use with Adjacent Properties in the Area.
The proposed use ofthis site as a neighborhood church should blend in nicely with
the adjacent properties. The building architecture and landscaping will compliment
the current neighborhood.
9. Traffic Generation
The traffic generated on this site should be fairly minimal. On Sundays and
Thursdays the most trarfic that should be generated would be 60-70 cars per
service. The remaining days are much less.

10. Other Pertinent Information
A. We have not submitted a formal landscape plan; however, we intend to
landscape this site as required by the City of Oshkosh Zoning Ordinance for
landscaping.
B. Per our discussions with the planning and engineering staff we hope you look
positively on our driveway entrance design. We believe onefocal driveway point
will be less. confusing for the surrounding traffic flow. Th~ left turn out and right
turll. out lanes should help reduce traffic congestion on our site and help the traffic
leave the site in a safe manner.
C. We hope you like our plans and see we have tried to make this an attractive
development for this area.
