of Occupancy has not been issued for the 11,622-sq. ft. addition, referenced
by Building Permit #93943. The file has been closed.
. A Final Electrical Inspection was not requested.
. A Final Plumbing Inspection was not requested.
Without a Certificate of Occupancy there may be delays with any future sale
or refinancing of the property. Additionally, occupancy with out a
Certificate of Occupancy is a violation of the Oshkosh Municipal Code.

1 have completed my review of the revised plans and calculations you. submitted to our office on
Wednesday, October 23, 2002 for the above-mentioned projects, I have made a few red-line
comments to these plans which I have enclosed to assist you in preparing final plans. Please see
that these issues and concerns are addressed and revis~d plans submitted so that final approval
can be obtained. Also, could you provide an explanation and additional calculations if necessary
for the following issues:
~ Why was the amount of storage provided reduced. by about 10,000 cubic feet on the revised
plan? .
~ Do revised fR.-55 run-off calculations need to be submitted to reflect this reduction in
storage?
~ Why were routing calculations updated because of the new pond contours?
~ How was the proportionate discharge from the common pond for each property determined?

As a follow up to our many recent telephone conversations and the deteonination of our Site Plan
Review Committee meeting held in late November) I am confuming in writing our understanding,
requests. and approval of the necessary variances needed to facili~ate your upcoming expansion at
your current location in our Southwest Industrial Park.
You) along with your neighbor to your east, Tower Mechanical Services. requested approval for a
land sale/purchase of 50' of land to combine with your present site on 20th Street. We supported this
request at a sale price of $18,000 per acre. lrelayed this approval to you verbally and believe this
sale/purchase has been completed to the satisfaction of both parties.

Chameo. Inc. understands the requests for variances were not your first choice. We realize that the
size of the addition is governed by product handling and that you can not expand in height or in the
north/south direction because of how the forklifts operate handling the product; therefore your only
choice being to your west. The purchase of land from Tower Mechanical will assist you in a small
way. We also realize you attempted to purchase the acreage needed to avoid the need for variances
from Bemis Flexible Packaging. It is our understanding from you and confirmed in writing by Dan
Albers, Senior Vice President of Purchasing at Bemis, that they have no interest in selling any portion
of their land nor any cuu:ent expansion plans of their own that would interfere with the area in
question. They did state in writing that they are pleased to hear of another business growing in our
community and have no objection to yOU{ plans for a setback of approximately lOt along your mutual
property line.
We understand you are specifically requesting two variances as they pertain to the setbacks per our
covenants. On the west side of your property, you are showing a 10' setback, on the east side of your
property, you are showing a 15'setback, thereby requesting a variance of IS' and 10' respectively. In
view of the circumstances, we grant this request for a variance from OUT protective covenants.
However, you also need to comply with the setbacks prescribed by the City Zoning Ordinance or
receive a variance from the City.

The Chamco Site Plan Review Committee requested a letter from Bemis confmning in writing their
agreement to your needed requests. I relayed this verbally to you shortly after our meeting and we
since have received such a statement as I indicated above. The Committee also asked that you move
your semis to the rear of your site. In talking with you, I understand why they need to be located in
the front and we accept your e;l[.planation. Landscaping in the northeast comer of your property was
also questioned, and you assured me that you would continue to landscape to a degree which far
exceeds our recommendations and City requirements. A detailed landscape plan will need to be

outdoor storage, in your case freezers and pallets, is screened.

The applicant i5 requesting a variance to const.ruct an addition onto the existing factory buildini. for
the purpose of manufacturing and storing ice cubes. and for a parkins &.rea in front. ofthe addition.
This request is part ofan overall land swap/expansion prosram between SERV.ICE and Tower
Mechanical Services, the property directly east ofSERV-ICE. A variance is needed because the
internal working space and .the equipment intended to be used in this area requires certain spact for
product handling and Itorinl space.
The proposed addition and parking area will address the growing needs of the business. while further
adding value to the city tax rolls. The proposed building addition will match the existing front setback
of the current strocture, approximately 220' from W. 201lt Avenue,lnd the propo$e4 driveway will
match the existing side yard setbaclc ofthe driveway, which tapers to 10' towards the front of the site.
Considering tbe loeation oflhc: proposed parking and new building, this variance request is the least
possible needed to remove the hardship. In addition. the eon&t1'Uction of the new building will solve

The submittal described above has been placed on HOLD and Three (3) sets of plans are being returned. The review and
approval is pending subject to receipt of the ADDITIONAL INFORMATION and resubmittal of a minimum of Four (4) sets
of revised plans as requested by this letter. Upon receipt of the additional information and the revised plans, the plans will be
reviewed for compliance to applicable Wisconsin Administrative Codes and Wisconsin Statutes.
The following must be corrected and revised plans must accompany the resubmittal:

. COMM 51.03(6)(a)2. The plans indicate the pipe access mezzanine structural framing is of combustible
materials. This construction class requires the combustible framework and supporting walls to retain a I-hour
fire-resistive rating.
. COMM 51.06(3) The foam plastic insulation is required to be separated from the interior of the building by a
tested 15-minute thermal barrier. The department will accept Y2-inch gypsum wallboard as a thermal barrier.
COMM 51.06(6)(a)2. Provide automatic sprinkler protection for the coolers and freezers and for the room in
which the coolers and freezers are located. Or a Insulated Panel system that carries a Wisconsin Approval
Number per Corom 51.06(7) that allows the panels to be installed without the 15-minute thermal barrier. The
Approval Number must be shown on the plans.
. COMM 54. 12(2)(b) 1. The occupancy of this building exceeds the limit of 10 employees or 25 patrons.
Separate toilet rooms are required for males and females.

A copy of the approved plans, specifications and this letter shall be on-site during construction and open to
inspection by authorized representatives of the Department, which may include local inspectors. All permits
required by the state or the local municipality shall be obtained prior to commencement of
construction!installation! operation.
In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should
conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this review
