Jack Michler 1471 McMahn Dr. Neen.ah, Wisconsin 54956 Re: 3815 Oregon Street Dear Mr. Michler: On June 14,2006 the Board of Appeals made judgement for your zoning variance request as follows: (a) The Board of Appeals approved your request to permit the placement of a driveway 2.26' within the required side yard setback, as requested. (b) The Board of Appeals denied your request to reduce the amount of landscaping required on-site. (c) The Board of Appeals approved your request to eliminate screening of rooftop mechanical equipment. The decision of the Board was filed in the Planning Services Division Office of the Department of Community Development on June 15, 2006. Per Section 30-6(C)(3) and (42 of the City of Oshkosh Zoning Ordinance, the approved portions of the variance request will expire on December 14, 2006 unless you have started construction for the activity allowed by the variance. If you fail to begin construction by this date, you must reapply for variance if you intend to go ahead with the activity. . Per Section 30-6(C)(l) and (2) of the City of Oshkosh Zoning Ordinance, the denied portions of the variance , request may be reapplied for 3 times in any 12 month period. If this is the first or second time you have requested this variance within 12 months, you may re-apply if you wish. If your variance request has been denied 3 times within a 12 month period, but you feel there has been a change in the circumstances affecting your request, you may submit a request for an additional hearing stating the changes which have occurred. The Board will review this request, and if three Board members feel there is sufficient change in circumstances to warrant an additional hearing, then you may re-submit your variance request through the normal procedure. Be advised that any person or persons aggrieved by any decision of the Board of Appeals may commence action in Circuit Court within thirty (30) days after the filing of the decision. Permits may be issued on approval of the Board, but be aware that further action could take place until as much as 30 days after the date of the decision. Doug Pearson, Executive Director, Chamco, 2445 HearthstoJ?-e Drive, stated he was present to lend support to Baldor Generators. He stated Oshkosh is fortunate to have Baldor Generators located here and they are planning for future growth in Oshkosh with an expansion of a 143,000 square foot addition, which would add 15 more 'positions at this time, and 7 more with future expansions. Mr. Pearson stated three driveway accesses were needed for internal maneuvering of semi-trailers which would come in through the westernmost driveway and maneuver into the new docking facilities on the west side of the existing building and exit straight out of the loading dock onto W. Ripple Avenue. Mr. Pearson stated Ripple Road ends in this area and the extra width is needed to accommodate larger trucks on site rather than in the right-of-way. Motion by Fojtik for approval ofthe consentagenda with , conditions for Items A and D as follows: Item A: 1. A note placed on the face of the CSM stating that Lot 2 is to be used for a maximum of a twofamHydweHi:qg. 2. A deed restriction be recorded for Lot 2 limiting the parcel to a maximum two family dwelling. Item D: 1) The utilities be installed in a manner that is approved by the Department of Public Works with no modifications or changes in construction procedure without prior approval by the Department of Public Works. 2) If no longer needed the utilities be properly abandoned and removed in accordance with City standards and under the direction of the Department of Public Works. 3) Any problem that may arise as a result of placement of the utilities be the responsibility of the petitioner/owner to correct in coordination with the Department of Public Works. 4) . All appropriate permits be obtained prior to the start of placement of the utilities. 5) The utilities be modified ,or removed immediately upon the request of the City. 6) The petitioner/owner secures and submits to the City Clerk a separate insurance policy which names the City as an additional insured with a minimum coverage of $200,000 per person and $500,000 in general aggregate.
