HomeMy WebLinkAboutMinutes P C C ROCEEDINGS OF THE OMMON OUNCIL C O, W ITY OF SHKOSH ISCONSIN REGULAR MEETING held Tuesday, July 11, 2006 at 6:00 p.m. in the Council Chambers, City Hall. Mayor Castle presided. PRESENT: Council Members Burk Tower, Shirley Mattox, Meredith Scheuermann, Dennis McHugh, Bryan Bain, Paul Esslinger, and William Castle ALSO PRESENT: Richard Wollangk, City Manager, Pamela Ubrig, City Clerk, Warren Kraft, City Attorney and David Patek, Director of Public Works Council Member Tower read the Invocation. The Pledge of Allegiance was led by Council Member Tower. Dan Thompson, representing the League of Municipalities presented an award to Senator Carol Roessler for her services over the years. Senator Roessler expressed her appreciation. Consent Agenda The minutes of the June 27, 2006 meeting were presented as written. The Report of the City Manager was read. The bills were presented in the amount of $4,639,829.95. The Report of the City Clerk was read. Resolution 06-223Award Bid – Video Surveillance & Recording System / Oshkosh Transit System (Digital Recorders, North Carolina, $107,275.77) Tony Palmeri, 212 W. Parkway Avenue, explained part of the funds would be paid by a grant and the remaining cost would be from taxpayer dollars. He urged Council not to support the resolution. Council Member Bain questioned why surveillance cameras were being requested and if other communities used them. He questioned if there was a timeline for purchasing the equipment. Council Member Mattox questioned why there was only one company that bid the project. 1 Proceedings of the Common Council – July 11, 2006 Mr. Huddleston, Director of Transit, responded. Resolution 06-224Award Bid – Public Works Contract No. 06-02 / Pumping Station Upgrades (August Winter & Sons, Appleton, $757,835.00) Resolution 06-225Approve Proposal / Engineering Construction Service / Upgrades to Various Water Treatment Pumping Stations Council Member McHugh questioned if the City could hire a part-time engineer instead of paying a consulting firm. Council Member Tower questioned what the fee would cover. Mr. Patek responded. Resolution 06-226Approve Amended Agreement with AT&T / Anchorage Basin Project Council Member Mattox had various questions regarding the culvert on Harrison Street and how long the street would be closed. Mr. Patek responded. Resolution 06-227 Approve Final Resolution Vacating Portion of Marion Road at Jackson Street Resolution 06-228Approve Agreement with Winnebago County / Facilitate Purchase of Handicapped Accessible Voting Equipment Tony Palmeri, 212 W. Parkway Avenue, urged Council to lay over the agreement and have a public hearing on all the touch screen voting equipment certified by the state. Resolution 06-229Disallow Claim / Brzostowski Resolution 06-230Approve Miscellaneous Licenses MOTION:ADOPT CONSENT AGENDA (McHugh; second, Scheuermann) MOTION:AMEND CITY MANAGER’S REPORT – REQUEST #2 / BLOCK PARTY FROM MIDNIGHT TO 11:00 P.M. (Mattox; second, Bain) CARRIED:Ayes (5) Tower, Mattox, Scheuermann, McHugh, Bain; Noes (2) Esslinger, Castle Council Member Bain questioned if there was a time limit for block parties and if the city had a noise ordinance. 2 Council Member Tower explained there was a form available for block party requests and Council had the option to approve an extended time if requested. Proceedings of the Common Council – July 11, 2006 Council Member Mattox stated it was not appropriate to have a block party until midnight. Mr. Wollangk and Mr. Kraft responded. VOTE ON CONSENT AGENDA EXCLUDING RESOLUTIONS 06-223 AND 06-225 CARRIED:Ayes (7) Tower, Mattox, Scheuermann, McHugh, Bain, Esslinger, Castle Resolution 06-223Award Bid – Video Surveillance & Recording System / Oshkosh Transit System (Digital Recorders, North Carolina, $107,275.77) MOTION:ADOPT (McHugh; second, Bain) MOTION:LAYOVER UNTIL JULY 25, 2006 COUNCIL MEETING (Bain; no second) LOST:LACK OF SECOND VOTE ON MOTION TO ADOPT: CARRIED:Ayes (6) Tower, Mattox, Scheuermann, McHugh, Esslinger, Castle; Noes (1) Bain Council Member Bain explained the cameras were a good idea but he would like more information before making a decision. Council Member McHugh explained there were disobedient students and the cameras would help with behavior issues. Resolution 06-225Approve Proposal / Engineering Construction Service / Upgrades to Various Water Treatment Pumping Stations MOTION:ADOPT (Esslinger; second, Bain) CARRIED:Ayes (6) Tower, Mattox, Scheuermann, Bain, Esslinger, Castle; Noes (1) McHugh Council Member Bain questioned if the position was hired out what would be the cost for salary and benefits. Mayor Castle explained the position would be hard to fill knowing it was only a temporary position. Council Member McHugh stated he was confident the city could find someone to fill the position on a temporary basis. 3 Mr. Patek responded. Proceedings of the Common Council – July 11, 2006 Public Agenda Discussion Resolution 06-234Approve Fencing / Murdock Avenue Detention Pond Andy Dumke, 2030 Menominee Drive, explained there were other water areas in the community that should be looked at prior to the retention pond for fencing. Action Taken on Ordinances and Resolutions Ordinance 06-231 Approve Traffic Regulations MOTION:ADOPT (Esslinger; second, McHugh) CARRIED:Ayes (7) Tower, Mattox, Scheuermann, McHugh, Bain, Esslinger, Castle Ordinance 06-232 Amend Liability Insurance Provisions / Taxicab Licensing FIRST READING; LAID OVER UNDER THE RULES Resolution 06-233Award Bid / Roofing Work / Approve Change Order No. 1 / Riverside Cemetery (Various) MOTION:ADOPT (Esslinger; second, Bain) CARRIED:Ayes (6) Tower, Mattox, Scheuermann, Bain, Esslinger, Castle; Noes (1) McHugh Council Member McHugh stated the project would be expensive and questioned why repair the outside when the inside needed restoration. Council Member Bain asked staff various questions pertaining to the improvements. Council Member Esslinger asked various questions regarding the roof replacement. He stated the building was not currently used but had potential use in the future. He explained he would like the current tiles sold as a fundraiser. He questioned if there was a time frame to start the project. Council Member Scheuermann questioned when the roof was repaired would the chapel be ready for rental. She questioned if staff would perform the interior improvements and if there were grants available to help cover the cost. 4 Bill Sturm, City Forester, responded. Resolution 06-234Approve Fencing / Murdock Avenue Detention Pond MOTION:ADOPT (McHugh; second, Esslinger) LOST:Ayes (1) McHugh; Noes (6) Tower, Mattox, Scheuermann, Bain, Esslinger, Castle Proceedings of the Common Council – July 11, 2006 Council Member McHugh explained the retention pond was not the same as the lagoon, river, or lake. He expressed his concerns with safety during the winter. He questioned why swimming pools were required to have fencing. Mr. Wollangk responded. Council Member Tower stated he had not seen children in the area of the retention pond. He explained there were other locations in the near area that had safety concerns and there were no fences surrounding those proprerties. Council Member Esslinger explained there was a potential safety issue but stated a fence would not keep children out. Council Member Mattox questioned if there was a plan to landscape the area. She also questioned recent flooding in the area. Council Member Bain stated he was pleased there was future landscaping in the area. He questioned the sloping in the retention pond. He stated he would not support the resolution. Mr. Patek responded. Citizen Statements Ken Bender, 806 Oak Street, explained other communities had more handicap accessible ramps than Oshkosh. Dave Horst, 1022 Merritt Avenue, praised the Oshkosh Police department and urged Council to support the nuisance ordinance. Michelle Pennewell, N2079 Majestic Pine Circle, Wautoma, reminded Council about the upcoming election for District Attorney. Mayor Castle reminded the audience there was no electioneering at council meetings. Gordon Doule, 1225 Summit Avenue, expressed his various concerns in the community. Leon Schaffer, 865 Greenfield Trail, expressed his concerns with the Mayor’s actions towards individuals during citizen’s statements. 5 Council Member Statements Council Member Mattox stated the 2006-2007 season at the Grand would be previewed on th July 16 at the Grand Opera House Square with “The Grand Scoop”, featuring Culver’s th custard, and live entertainment. She explained on July 12Dan Fitzgerald, an actor from Oshkosh, would be at the library to meet the public and that the library was having a book th sale on July 25. She also stated at the library citizens could check out the exhibit for the Proceedings of the Common Council – July 11, 2006 th contest “Our Town, a photographic Journey”. She stated on July 20 the winners would be announced and the public would bid on the photos. She stated the event for girls during EAA rd th called Women SOAR, was July 23 and 24 and involved parents, teachers and women who had excelled in non-traditional careers. Council Member Tower stated he would like individuals to express ways to improve the community during citizen statements. He questioned if Council could approach the Business Improvement District about removing the chair restriction in Grand Opera House Square. Council Member McHugh questioned if chairs were restricted for specific events or all events at Grand Opera House Square. Council Member Bain explained he toured the Pollack Community Water Park and that it was a great impact on the community. Council Member Esslinger questioned if Council had the authority to allow chairs in the Grand Opera House Square or if it needed to be approved through the Business Improvement District. He questioned if it was appropriate for the Mayor to ask for more time for citizens during citizen statements. Council Member Scheuermann questioned if Council approved permission for a park facility did the rental groups rules supercedes the city rules. Mr. Kraft and Mr. Wollangk responded. Whatever Else is Pertinent or for the Good of the City Mr. Wollangk stated the Murdock and Harrison Street intersection was open but would be closed for a week in August to work on the railroad. He reminded citizens that the 2nd Citizen’s Academy would be in September. He stated there would be a public meeting on th July 19 to discuss the nuisance ordinance. He also informed the public about the summer reading program at the library and children could ride the bus free by showing their library card.
