The owner, as defined in Chapter 101.01(10), Wisconsin Statutes, is responsible for compliance with all code requirements Key Item(s) / Conditions: · IBe 711.3 Any penetrations of fire rated assemblies are required to be protected with a listed firestopping system that matches the rating of the wall assembly being penetrated. Copies of the firestopping systems are required to be provided at the time of inspection. . MUN - SECTION 14-1.2 SMOKING PROIDBITED INSIDE RESTAURANTS The separate ventilation must be effective so as to prevent smoke from at any time entering or being present in the non-smoking and smoke-free areas of the restaurant. /fall of the HVAC equipment is not operated as per the submitted design, additional review may be required to verify compliance with this ordinance. Additionally any changes in equipment are subject to review, and will require re-submittal · Comm 61.31(4) Revisions to approved plans. All proposed revisions and modifications which involve rules under this code and which are made to construction documents that have previously been granted approval by the department or its authorized representative, shall be submitted to the office that granted the approval. All revisions and modifications to plans shall be approved in writing by the department or its authorized representative prior to the work involved in the revision or modification being carried out. A revision or modification to a plan, drawing or specification shall be signed and sealed in accordance with Corom 61.31(1). MUN 30-35 (1)(5) All rooftop and ground level mechanical equipment and utilities shall be fully screened from view of any street or residential zoning district. Contact David Buck - Associate planner (920) 236- 5062 for additional information on screening requirements. All screening shall be properly anchored in place to resist wind loads. Balancing report required to be submitted prior to final occupancy being allowed. . MUN 14 When the system(s) has been properly balanced, the design professional must submit a letter stating that the system has been installed and balanced to be in compliance with the City of Oshkosh Smoking Ordinance. This document is in addition to the Compliance Statement required by the State Building and HV AC Code. . Comm 61.50 (4) Supervision. Prior to the initial occupancy of an alteration the supervising professional shall file a compliance statement form SBD-9720 with this office. A copy of the approved plans, specifications, and this letter shall be on-site during construction. All permits are required to be obtained prior to commencement of work. In granting this approval the City of Oshkosh Inspection Services Department reserves the right to require changes or additions should conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this review shall relieve the designer of the responsibility for designing a safe building, structure, or component. Design Requirements 1. The Smoking Room shall be separated from the rest of the building with solid walls of rigid construction extending from the floor to the ceiling. Question: Can the solid walls terminate at a suspended ceiling or must the walls extend to a more rigid surface such as a typical framed/drywall ceiling or the underside ofthe roof deck (as in a flat roof building? Answer: ConSIderable analysis must be used here. The intent of the ordinance is to prevent smoke contaminated air,in these rooms from entering Non-Smoking areas of a building. The ordinance requirements prohibit the mixing of air from the Smoking Room with the air of Non- Smoking Areas and require the Smoking Room to be maintained at a negative air pressure compared to the adjacent non-smoking rooms. Compliance with these requirements will prevent such mixing of smoke contaminated air with non-contaminated air. Example: When a Smoking Room is provided with an HV AC system where both the supply ducts and return air ducts prevent the mixing of air with air of Non-Smoking Areas, then the walls can terminate at the suspended ceiling. Reason being, since the Smoking Room must be at a negative air pressure (more air being exhausted from this room than being supplied,) air from the Smoking Room cannot mix with air from Non-Smoking Rooms. However, if an HV AC system is used where the Return Air System of the Smoking Room is not ducted (such as in a Plenum Return Air System) then a Smoking Room design must be employed that will separate the Return Air Plenum of the Smoking Room from the atmosphere of Non- Smoking Rooms. 2. The Smoking Room shall contain a separate entrance that has a solid self-closing, self-sealing door with gaskets. 3. The door must remain closed and sealed except when patrons or employees enter or leave the room. 4. The Smoking Room must be ventilated (provided with air movement, exhaust air and a supply of fresh air) in accordance with the standards provided in the State of Wisconsin Building and HVAC Code. 5. The Smoking Room Ventilation System shall be separate and distinct from the ventilation system for the nonsmoking area(s) of the building. '''6. The Smoking Room shall maintain a Negative air pressure relative to adjacent areas to ensure that air within the smoking room cannot mix with the air in the non-smoking areas of the building. The separate ventilation system must be effective so as to prevent smoke from entering or being present in the non-smoking and smoke-free areas of the restaurant at all times. 7. Particulate air cleaners or filtration systems do not satisfy this requirement. Procedures for Plan Review and Installation Approval Due to this office's familiarity with the State Building and HV AC Code, the Division offuspection Services will provide plan review and inspection services in assisting the Health Services Division in their efforts to determine compliance with this ordinance. The following guide lays out the necessary steps and information that any business owner will need to follow when pursuing approval of a Smoking Room. 1. Plans must be submitted for Review and Approval. Maintaining consistency with the Division's Plan Submittal procedures, four bound sets of plans must be submitted for review in addition to the required plan review fees. This is the same procedure used for plan review and approval of any major building or HV AC project. The following plans must be included in the submittal; -Scaled floor plan detailing how the room will be separated from the rest of the building. If needed, elevation drawings may be necessary to demonstrate how the enclosing walls will be built. -HV AC plans must be prepared, signed and sealed by a Wisconsin Registered HV AC Designer, Architect or Engineer. These plans must show how the system will comply with the requirements stated above. Additionally the plans must demonstrate compliance with the exhaust ventilation rates based on the number of occupants, air movement rates as well as the tempered fresh air requirements to offset the exhaust aIr. -Additional HV AC Plans may be necessary if the addition of a Smoking Room Ventilation System affects the building's existing HV AC System. In short, modification of the existing HV AC system to accommodate a separate system for the Smoking Room may lead to a requirement to modify the existing system(s). Any modification performed cannot lead to a non-compliance situation elsewhere in the building. 2. Once plans are approved, the necessary Building and HV AC Permits may be obtained to commence the described alterations, modifications. Instructions will be given at permit issuance advising when inspections are necessary. 3. When the installation is complete, it will be necessary to have the system balanced as required by the State Building and HV AC Code. 4. When the system(s) has been properly balanced, the design professional must submit a letter stating that the system has been installed and balanced to be in compliance with the City of Oshkosh Smoking Ordinance. This document is in addition to the Compliance Statement required by the State Building and HV AC Code. 5. Once the documents stated in four (4) have been provided to this office, a Final Inspection must be requested by the installing contractors. Any noted code violations associated with the installation of the elements for a smoking room will be required to be corrected before approving the installation. 6. Once this office has determined the Smoking Room enclosure and ventilation system appears to comply with the State and local codes, documentation of such will be forwarded to the Health Services Division. At that time the Health Services Division will implement their procedures to approve the use of the Smoking Room.
