THIS INDENTURE, made this /-3 davof 2004 ~ ~ - -" by PLYMOUTH CON GREGA TIONAL CHURCH, Grantor, and CITY OF OSHKOSH, a municipal corporation, located in Winnebago County, Wisconsin, Grantee, WITNESSETH: IN CONSIDERATION of the sum of One Dollar ($1.00) and other good and valuable consideration paid by the Grantee, the receipt of which is hereby acknowledged, the Grantor does hereby give and grant unto the Grantee, its successors and assigns, an easement for stonn sewer over, upon and under certain tracts of land situated in the City of Oshkosh, Winnebago County, Wisconsin, and described as follows: Recording Area Name and Return Address cYtCt.l1-~ City Attorney's Office Oshkosh, WI 54903-1130 Pt. 1306980200 Parcel Identification Number (PIN) Part of the SW Y4 of the NW Y4 of Section 26, Township 18 North, Range 16 East, in the 13th Ward, City of Oshkosh, Winnebago County, Wisconsin, commencing at the northeast corner of Lot 2 Certified Survey Map No. 3680, also being the southwest corner of Georgia Street and Osborn Avenue; thence N. 89026'00" W., 10.00 feet along the south line of Osborn Avenue to the true point of beginning; thence S. 00034'00" W., 10.00 feet; thence N. 89026'00" W., 20.00 feet; thence N. 00034'00" E., 10.00 feet to a point on the south line of Osborn Avenue; thence S. 89026'00" E., 20.00 feet along said south line of Osborn A venue to the true point of beginning. Said parcel contains approximately 200 square feet. Upon exercising any of the rights herein granted, Grantee shall cause the property, soil and grass to be repaired and replaced in a condition similar to its condition immediately prior thereto, and obligates itself to pay to Grantor, its successors and assigns, all actual damages caused by construction of the stonn sewer over, under and upon said property. IT IS FURTHER MUTUALLY AGREED that no building or other substantial or permanent structure shall be placed upon said pi'opcrty by the Granto~'. The Grantee releases the Grantor from all debts, claims, demands, damages, actions and causes of action whatsoever which may result from said easement heretofore granted by Grantor, and further agrees to hold the Grantor free and harmless from any claim for damages which may be made by reason of damages or injury to persons or property connected therewith.
