WITNESSETH:
IN CONSIDERATION of the sum of One Dollar ($1.00) and other good and
valuable consideration paid by Grantee, the receipt of which is hereby acknow-
ledged, the Grantor does hereby give and grant unto the Grantee, its successors
and assigns, an easement in, under and over the land hereinafter described, inclu-
ding the right to enter upon said land for the purpose of maintaining and conducting
tests of a monitoring well upon that certain tract of land situated in the City of
Oshkosh, Winnebago County, Wisconsin, and described as follows:

A twenty five foot, (25.00'), easement (lying generally 15 feet south and 10 feet north of the existing monitoring wells) for
the purpose of maintaining and conducting tests of monitoring well located in the northerly part of Certified Survey Map
Number 878, which is part of the Southwest Quarter of the Northeast Quarter of Section Two, Township Seventeen North,
Range Sixteen East, Fourteenth Ward, City of Oshkosh, Winnebago County, Wisconsin, which is bounded and described as
follows:
COMMENCING at the Northwest Comer of Said Certified Survey Map Number 878; thence S 1018'54" W, along the west
line of said C.S.M. No. 878, a distance of 27.24 feet, to the POINT OF BEGINNING; thence N 89030'45" E, a distance of
465.05 feet, to the east line of said C.S.M. No. 878; thence S 1035'26" W, along the east line of said C.S.M. No. 878, a distance
of25.02 feet; thence S 89030'45" W, a distance of 464.93 feet, to the west line of said C.S.M. No. 878; thence N 1018'54"
E, along the west line of said C.S.M. No. 878, a distance of25.0l feet to the POINT OF BEGINNING; said described tract
containing 11,625 Square Feet, more or less.
IT IS FURTHER MUTUALLY AGREED that no building, tree or other substantial or permanent structure shall be placed upon
said property by the Grantor.
Not withstanding any legal doctrine to the contrary, it is intended that this easement remain in full force and effect,
regardless of underlying ownership of the subject premises, until released by the CITY OF OSHKOSH through a subsequent
recorded instrument.
The Grantee hereby releases the Grantor from all debts, claims, demands, damages, actions and causes of action whatsoever
which may result from said easement heretofore granted by Grantor, and further agrees to hold the Grantor free and harmless
from any claim for damages which may be made by reason of damages or injury to persons or property connected therewith. .
IN WITNESS WHEREOF, said Grantor has hereunto set its hand and seal the day and year first above written.
