by RICHARD L. BRAASCH AND PAT BRAASCH, Grantor, and
CITY OF OSHKOSH, a municipal corporation, located in Winnebago
County, Wisconsin, Grantee,
WITNESSETH:
IN CONSIDERATION of the sum of One Dollar ($1.00) and
other good and valuable consideration paid by the Grantee, the receipt of
which is hereby acknowledged, the Grantor does hereby give and grant unto
the Grantee, its successors and assigns, an easement in, under and over the
land hereinafter described, including the right to enter upon said land for
the purpose of construction, maintaining, and repairing a sanitary sewer
and water main over, under and upon certain tracts of land situated in the City of
Oshkosh, Winnebago County, Wisconsin, and described as follows:

That part of Lot 2 in Certified Survey Map No. 5160 in the 15th Ward, City of
Oshkosh, Winnebago County, Wisconsin, bounded and described as follows: Commencing at the SE comer
of said Lot, thence North 89044'03" West along the South line of said Lot 150.90 ft. to the point of beginning of the
easement to be described, thence continuing North 89044'03" West along said line 20.00 ft., thence North
00002'08" West 169.72 ft., thence South 89058'12" West 21.01 ft., thence North 00002'08" West 30.00 ft.
to a point on the North line of said Lot, thence North 89058'12" East along said North line 60.00 ft., thence
South 00002'08" East 30.00 ft., thence South 89058'12" West 18.99 ft., thence South 00002'08" East
169.82 ft. to the point of beginning.

Upon exercising any of the rights herein granted, Grantee shall cause the property, soil and grass to be repaired and
replaced in a condition similar to its condition immediately prior thereto, and obligates itselfto pay to Grantor, it successors and
assigns, all actual damages caused by repair, installation, operation, repair or removal of said sanitary sewer and water main
through said property.
IT IS FURTHER MUTUALLY AGREED that no improvements by Grantor are allowed within areas reserved for
public utility easements. Improvements include, but are not limited to, building structures, driveways, parking areas, landscaping
or fences. Any improvement shall be allowed only by special exception of the Board of Public Works.
The Grantee releases the Grantor from all debts, claims, demands, damages, actions and causes of action whatsoever
which may result from said easement heretofore granted by Grantor, and further agrees to hold the Grantor free and harmless
from any claim for damages which may be made by reason of damages or injury to persons or property connected therewith.
