RE: Revision to Petition to Variance - Previous Transaction ill 1159788
The owner of this property has approached us about changing the occupancy of the 151 floor commercial space to a type M
mercantile occupancy. While the space is able to complywith the provisions of the building code, it would not comply with
the condition placed on the variance that was granted on August 12, 2005, in which the 1st floor occupancy was limited to a
type B occupancy.
At the time that variance was applied for we were concerned with the potential for a change of use on the 151 floor, which
might result in an increased frre risk, such as an assembly type occupancy with cooking facilities, etc. Since the 151 floor was
being used as a type B occupancy at the time the original petition for variance was submitted, we simply limited the use to the
existing use group, without considering every possible use that would be acceptable.
While a group M occupancy normally involves the display and sale oflarge quantities of combustible merchandise and the
fuel load can be relatively high, the size and occupant load of the proposed use is such that we are willing to allow this use.
We would propose to modifY our previous condition that the 151 floor space be limited to a "B" occupancy, to: the 1 5t floor
space be limited to a group "B" occupancy, or retail store with an occupant load of no more than 30, and that no greater
quantity of combustible / flammable material is contained within the 1 51 floor and basement than in the current proposed use.
This should allow for more flexibility in the use of this building, now and in the future, while reducing the potential frre risk
the 2nd floor apartments tenants may be exposed to.
