HomeMy WebLinkAbout06-196 JUNE 13, 2006 06-196 RESOLUTION (CARRIED__4-2P___LOST_______LAID OVER_______WITHDRAWN_______) PURPOSE: GRANT PRIVILEGE IN STREET / PEARL AVENUE AND OSCEOLA STREET INITIATED BY:UW-OSHKOSH, PETITIONER PLAN COMMISSION RECOMMENDATION: Approved w/conditions WHEREAS, the University of Wisconsin-Oshkosh requests the Common Council grant a privilege in street to C.D. Smith, general contractor; August Winter & Sons, mechanical contractor; and Thomas Electric, electrical contractor, and other contractors as may be required for the installation of private steam and condensate lines across Osceola Street and Pearl Avenue in conjunction with the utility connections required for construction of UW-Oshkosh's Student Recreation and Wellness Center; and WHEREAS, upon final construction of the Wellness Center, UW-Oshkosh will assume liability for the private steam and condensate lines within Pearl Avenue and Osceola Street; and WHEREAS, Section 66.0425, Wis. Stats., provides for the granting of a privilege in a right-of-way; and WHEREAS, the Plan Commission has approved of this request with conditions. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant C.D. Smith, August Winter & Sons, Thomas Electric and other contractors as may be required to complete said construction, a privilege in street for installation of private steam and condensate lines for UW-Oshkosh across Osceola St. and Pearl Ave., per the attached, and upon completion of said construction, UW-Oshkosh will assume liability of said private lines within Pearl Avenue and Osceola Street, contingent upon the following: 1)The utilities be installed in a manner that is approved by the Dept. of Public Works with no modifications or changes in construction procedure without prior approval by the Dept. of Public Works. 2) If no longer needed, the utilities be properly abandoned and removed in accordance with City standards and under the direction of the Dept. of Public Works. JUNE 13, 2006 06-196 RESOLUTION CONT'D 3) Any problem which may arise as a result of the placement of the utilities be the responsibility of the petitioner and contractors to correct in coordination with the Dept. of Public Works. 4) All appropriate permits be obtained prior to the start of placement of the utilities. 5) The utilities be modified or removed immediately upon the request of the City. 6) The petitioner and contractors secure and submit to the City Clerk a separate insurance policy which names the City as an additional insured with a minimum coverage of $200,000 per person and $500,000 in general aggregate. 7) It is the responsibility of the petitioner to file in a timely manner a new insurance certificate with the City Clerk upon expiration of an existing certificate. Failure to do so will result in the revocation of the privilege in street upon 10 days notice. 8) The petitioner and contractors execute hold harmless agreements with the City. 2 May 2006 Darryn Burich City of Oshkosh , Center of Community Development 217 Church Ave. Oshkosh, WI 54902 RE: Privilege Permit for Installation of Private Utilities in Street Right-Of-Way Dear Mr. Burich: I am writing to request authorization to proceed with installation of private steam and condensate lines across Osceola Street and Pearl Ave. In addition to the steam and condensate, an electrical and signal ductbank will also cross Pearl Ave. These utility connections are required for our Student Recreation and Wellness Center, which is currently under construction. The Student Rec center is located on the northwest comer of Pearl Ave and Osceola Street. The work in the right-of-way will be performed by CD Smith (general contractor), August Winter and Sons (mechanical), and Thomas Electric (electrical and signal). The State of Wisconsin has contracted with these companies for the construction phase ofthe project, for these specific areas of work. This work is part of their contract with the State. Due to our construction timeframe we are requesting approval to proceed prior to the Common Council acting upon the permit request. We do understand that we risk having to remove said utilities, should the Common Council not approve our request for the permit. Enclosed is the permit application and associated drawings showing the extent of work involved. Please let me know ifthere is anything else the University needs to provide in order for this work to proceed. The contractors need to start this work within approximately 3 weeks.
