HomeMy WebLinkAbout06-190.doc MAY 23, 2006 06-190 ORDINANCE FIRST READING (CARRIED________LOST________LAID OVER________WITHDRAWN________) PURPOSE:ZONE CHANGE / 449 MARION ROAD AND ADJACENT LOTS INITIATED BY:COMMUNITY DEVELOPMENT PLAN COMMISSION RECOMMENDATION: Approved A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-16 (B) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ZONING DISTRICTS. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30-16(B) of the Oshkosh Municipal Code pertaining to Zoning Districts and the map therein described is hereby amended by changing the district character of the following described properties from M-2 Central Industrial to C-3 Central Commercial with a Planned Development Overlay. (as described in the attached "Exhibit A") SECTION 2. This Ordinance shall be in full force and effect from and after its passage and publication. "EXHIBIT A" REZONING 449 MARION ROAD & ADJACENT VACANT LOTS That part of Lots 0 and 1 of Block ''D'' in the Plat of the WESTERN ADDITION to Oshkosh, in the First Ward, City of Oshkosh, Winnebago County, Wisconsin, described as follows, viz:- Commencing at the Northeasterly (most Easterly) corner of said Lot 1; thence northwesterly, along the Northeasterly line of said Lot 1 (being the Southwesterly line of Marion Road), 57.5 feet, to a point that is 80 feet southeasterly of, measured at right angles to, the center line of the former right of way of the Soo Line Railroad Company, the place of beginning; thence northwesterly, along the Northeasterly line of said Lot 1 (being the Southwesterly line of Marion Road), to a point that is 70 feet southeasterly of, measured at right angles to, the center line of the former right of way of said railroad company; thence southwesterly, and parallel with the center line of said former right of way, to the Northeasterly Bank of the Fox River; thence southeasterly, along the Northeasterly Bank of said River, to a point that is 80 feet southeasterly of, measured at right angles to, the center line of said former right of way; thence northeasterly, parallel with the center line of said former right of way, to the place of beginning, plus public right-of-way abutting said lot extending to the centerline of Marion Rd. (tax #901-0277-0000; WPS property) Also, that part of Lots 0 and 1 lying northwesterly of a line that is parallel with and a distance of 70 ft. from the centerline of the Soo Line Railroad main track, also the southeasterly one-half of vacated Dawes St. southerly of the southerly line of Marion Rd., all in Block D, Western Addition, plus public right-of-way abutting said lot extending to the centerline of Marion Rd., 1st Ward, City of Oshkosh, Winnebago County, Wisconsin. (tax #901-0226-0200; RDA property) Also, Lots 1 and 2, Block A, Lots 0 thru 14, Block D, also vacated Jay St. lying S of Marion Rd.; excluding that part of Lots 0 and 1, Block D, Wly of a line that is parallel and 80 ft. distance from the centerline of vacated Soo Line Railroad main track, Block D, Western Addn., plus public right-of-way abutting said lot extending to the centerline of Marion Rd., 1st Ward, City of Oshkosh, Winnebago County, Wisconsin.
