The decision of the Board was filed in the Planning Services Division Office of the Department of Community Development on April 27, 2006. Per Section 30-6(C)(3) and (4) of the City of Oshkosh Zoning Ordinance, your variance will expire on October 26, 2006 unless you have started construction for the activity allowed by the variance. If you fail to begin construction by this date, you must reapply for a variance if you intend to go ahead with the activity allowed by the variance. Please be advised that any person or persons aggrieved by any decision of the Board of Appeals may commence action in Circuit Court within thirty (30) days after the filing of the decision. Permits may be issued on approval of the Board, but you should be aware that further action could take place until as much as 30 days after the date ofthe decision. IV. 448 CHURCH AVENUE John&Mary Reinders - applicants and owners, request a variance to reconstruct a uncovered parking area that will have a 6" side yard setback and not be screened,whereas Section 30-36(C)(5)(a) of the City of Oshkosh Zoning Ordinance: Off-Street parking and Loading Facilities requires a 7' 6" side yard setback for screened uncovered parking spaces. � € i 9G���� � , Board of Appeals Minutes -2- Apri126, 2006 o � wV?2`� � Mr. Cornell asked staff what are the setbacks of the other signs in the area. Mr. Buck stated they 4qTE ; range from 3-6 ft. � i Mr. Lang stated he is not swayed by issues that have taken place down the street, if someone E placed a sign with a 3-6 ft. setback, he feels no need to repeat that. If the signs are 3-6 ft. right now, surely going at least 6 ft. is not a big deal. Motion by Mr. Cornell for approval of a variance to construct a ground sign with a three(3) foot front yard setback as proposed with the following condition. a) The base of the sign is landscaped with low-level vegetation. Seconded by Carpenter. � Mr. Lang added an amendment that the setback would be at least 6 ft. and the sign � be moved closer to Central Street. Motion failed due to lack of Second. Motion for the original request carried 4-1,Nay Mr. Lang. Finding of Facts: Mr. Cornell stated he feels there is no adverse impact in the neighborhood, it is being consistent with what is in the area as far as signage is concerned. Ms. Hentz stated the property is very unique in shape and size. � € f- The Minority states they are currently setting the sign at the very minimum of the neighborhood, ` not at an average, and not at the most setback in the neighborhood. The structure is quite unique � ;; and by its uniqueness it would very easily lend its self to better placement of the sign with less � variance from the city requirements, which he believes where put there for a reason. Someone ; decided 25 ft. setbacks were in fact visible signs, therefore 3 ft setbacks with issues of readability were not part of the original zoning conditions. Mr. Buck stated the storm sewer easement is an element outside of the petitioner's control and if it were not present, would remove the need of the requested variance. Mr. Buck also stated the petitioner has screened their � other storage areas and also this specific area to the north, through the use of landscaping and to the south through the use of fencing but they can not screen it to the west. � Tom Karrels, Engineer working on the facility, 1934 Algoma Blvd. ,� Mr. Karrels stated Muza used to own the property the easement is located on and they sold it to the City of Oshkosh for $1.00. � � ' , ' , , ���^'HF, � � Board of Appeals Minutes -3- Apri126, 2006 ;NO'221�°; � Mr. Cornell asked what kind of refuse is going to be placed there and what is going to be �ATE ; � screened. Mr. Karrels stated dumpsters are going to be placed there and they will be screening � trucks emptying the dumpsters. Motion by Mr. Lang for approval of a variance to permit the development of a refuse disposal area without screening it from view as proposed. Seconded by Cornell. Ms. Hentz added she appreciated the letter from Doug Pearson at Chamco, very thorough and complete job as far as why this is important. Motion carried 5-0. Finding of Facts: Mr. Carpenter stated the City of Oshkosh created the hardship. Mr. Lang stated nature of the neighborhood and what is in the immediate proximity to the unscreened side are railroad tracks. Mr. Buck stated the Oshkosh Zoning Ordinance allows residential parking in very specific areas of a lot: garages; 1 open space adjacent a garage; screened open parking in the side and rear of the home; and on driveways leading to the aforementioned legal parking spaces. Jacquelynn Voss, Owner and Applicant, 906 Evans St. Ms. Voss stated in her neighborhood there are only a few properties that have two car garages. In those cases the garages are setback from the house and the driveway runs between lot line and the home its self. Ms. Voss also stated the uniqueness of their property is that they can expand the driveway uniformly. Ms. Voss also stated they understand the City of Oshkosh doesn't want people to install a slab of concrete in their front yard; the change would be uniform and look nice. The other thing she wanted to state was the neighbor next to their property has a very wide driveway and they can fit three cars across. Ms. Hentz commented from the colored pictures there are tire ruts located on the lawn and asked if that is where they were parking their vehicle. Ms. Voss stated on occasion; they weren't aware that parking wasn't allowed on the grass next to the driveway. � Mr. Lang asked if the light post was going to remain in that parking space. Ms. Voss stated that is a 6ft 6 inch area where the light post is they are proposing to put concrete there in addition to the other portion for the flow of it. The other plan would be to install landscaping 11/2 ft around the light post. � . Section 30-35 (n(4) of the Oshkosh Municipal Code: Additional Standards and Exceptions requires all refuse disposal areas to be screened on all four sides. The subject 5.76 acre property is zoned M-2: Central Industrial District and is developed with Muza Metal Products manufacturing. The parcel is bordered on the west by railroad right of way and bordered by manufacturing/warehouse uses to the east and west. The Humane Society exists to the north and warehousing and commercial exist to the south across East Murdock Ave. The entire area is zoned M-2: Central Industrial District with the exception of the Piggly Wiggly site, which is a C-2 Planned Development District. ANALYSIS In reviewing a variance request, the following questions should be addressed: When considering an area variance, the question of whether unnecessary hardship or practical difficulty exists is best explained as "whether compliance with the strict letter of the restrictions governing area, set backs, frontage, height, bulk or density would unreasonably prevent the owner from using the property for a permitted purpose or would render conformity with such restrictions unnecessarily burdensome." Are there any unusual or unique physical limitations of the property,which create a hardship? Will granting of a variance result in harm to the public interest? The applicant is requesting a variance from the Zoning Code to allow the creation of a refuse area at the northwest portion of their site without screening it from view. As mentioned, section 30-35 (I)(4) of the Oshkosh Municipal Code: Additional Standards and Exceptions requires all refuse disposal areas to be screened on all four sides. Muza Metal Products is expanding their operation and constructing a 36,000 square foot addition to their existing facility that requires the placement of dumpster and material storage areas at several locations on their lot. The location and placement of the dumpster and material storage areas are necessitated based on internal operations. In all cases but one the material storage and refuse areas are proposed to be screened from view as required by code. In one instance however the petitioner is unable to fully provide the required screening. ; The applicant contends that there is an unnecessary hardship/practical difficulty in providing the screening for this refuse area, as a City of oshkosh required 30-foot storm sewer easement is located along the west property line directly adjacent the building and subject refuse area. The City requires this easement area be left clear and does not allow landscaping or fencing to be place within it, thereby eliminating the petitioners ability to provide screening. Staff agrees that the continued development and operation of the business at the site would be practically difficult and potentially impossible if all code provisions had to be met. The storm sewer easement is an element outside of the petitioners control and ' if it were not present, would remove the need of the requested variance. f f Staff believes that the variance, if granted, would not present any harm to the public interest. Adjacent and nearby uses that would be unscreened are industrial in nature, several with outdoor storage, and not proposed to change within the 10 or 20 year comprehensive land use plan. Additionally, the petitioner has made every attempt to � screen the refuse/material storage area from view on all other sides and has used plant material on the north, fencing on the south and buildings on the east. There will be scrap material recycling dumpsters located along the west side of the building for scrap metals from the manufacturing processes. City ordinance requires that these dumpsters be screened from view. ;: Due to a 30'-0"wide storm sewer easement with the city, screening along the f west property line cannot be achieved. Because of the inability to meet the ` ordinance requirements for screening in this area, we aze requesring that a variance be granted to omit the screening along the west lot line as indicated on the site plan. 2. We do not believe this variance would have an adverse effect on the surrounding properties due to the nature of their current uses and likely future uses. Directly £ west of this site are existing railroad tracks with industrial,manufacturing, storage, and repair type businesses on the west side of the tracks. To the south and southwest we aze for the most part screening the majority of the effected area, � which would not affect properties in that direction. To the north we are screening as much as we can from that properiy so as to limit any effect in that direction. ` 3. The details of this variance request relating to screening and the problems created by the City's 30 ft. wide storm water easement are detailed in previous accounts in the formal application of Muza Metal Products for this variance. We at Chamco, Inc. are very appreciative of having Muza Metal Products in our community. Since it was founded in 1928 Muza Metal Products has steadily grown as an essential part of Oshkosh. The last five years have seen remarkable growth with this company as it has passed to the leadership of Tom Muza and his highly competent management team. The company has positioned itself for expediential growth and is realizing the benefits of that growth. To give an example, they have invested well over $5 million in new equipment within the last four years. They plan to spend an additional $1 million in new equipment in 2006. The commitment to expand their facility by 36,000 sq. ft. comes at an investment cost to them of$13 million dollazs. The significant growth that they have experienced from 90 employees to 150 employees in just three years was in part made possible by the company's commitment to Oshkosh and assistance from Chamco with their securing a number of C�stomized Labor Training Grants to facilitate this growth. As Muza contemplates its next expansion, Chamco was quite concerned about retaining them in our community. The latest expansion would add 42 new high paying manufacturing jobs in our community however; Muza Metal Products was essentially built out on their current site. They faced a critical issue,they needed to decide whether they were going to have the next expansion somehow, someway take place on their current site, or as they had been advised,relocate the entire facility to another community outside of Oshkosh. Chamco, Inc. — the Oshkosh Industrial Development Corporation not only wants to retain Muza Metal Products and its 150 jobs in our community but wants to realize the benefits of a$2.5 million increment to our tax base and the growth in employment base by the addition of 40 new jobs in the next year. With this in mind we argue the case that the City of Oshkosh could readily accommodate their needs for the latest expansion on its existing site. The City has made a number of wonderful accommodations for which we are very grateful. They have made accommodations on the storm water detention requirements that have been instrumental in facilitating this expansion and retaining Muza Metal Products in Oshkosh,Wisconsin. Advancing the Industrial Development of Oshkosh Since 1960 � ; � gGP��F� _ MAY �201� . �ATE;. However, one additional accommodation is desperately needed. It may sound like a trivial issue but the issue of fi screening for the recycling dumpsters as outlined in the variance request of Muza Metal Products is a lynch pin on whether they can make this 36,000 sq. ft. addition to their existing facility. We are very aware that our industries in Oshkosh are constantly being recruited by other communities. Muza Metal Products is considered a high growth company that would be very attractive for other communities to recruit. Our credibility in saying that they can readily expand here on their current site rests upon the City of $ Oshkosh's ability to accommodate them with the zoning ordinance variance for which they have applied. While it may seem like a trivial issue, the very capacity of Muza Metal Products to expand where they currently are in Oshkosh, Wisconsin is at stake should we not demonstrate that we can accommodate their growth needs in our community. The executive staff and key ownership which reside elsewhere in Wisconsin will readily consider, we fear,the relocation of the company to another more accommodating community. The special condition of this variance request that applies to this site is the 30 ft. wide utility easement that Muza Metal Products through its previous owner Leo Muza for $1.00 granted the City of Oshkosh. If the easement 3 were not present through the generosity and accommodation of Leo Muza to a previous City Administration, we would be able to provide the necessary screening to meet the ordinance on the west side of the property and provide the necessary equipment for the operation of this facility. In conclusion, we ask you to consider favorably the variance request of Muza Metal Products for an accommodation on their existing site.
