(you have described the opening as being filled with mineral wool! fire safeing tightly packed around the flue, which was typical for that time period) While current code only recognizes listed fire stop systems, since it was proven that former practices did not withstand testing, the original installation complied with the code at the time it was installed, there-for it is permitted to remain in place, as it was originally installed. The code is the minimum that is required, you as the designer of record are responsible to determine if greater precaution is needed to provide a safe building. So, you may determine that while the code previously allowed the installation, it has since been demonstrated that that system is ineffective in fire testing, so you may determine that additional measures should be taken to provide the protection that would meet current standards. In any event the required tenant space separation is required to be provided, so if only the outer surface of the chase has been rocked you need to maintain the required fire separation between units. Additionally if the material around the penetrating item in the chase is removed and ! or replaced it will need to be installed in compliance with today's standards. It is my interpretation that the previously approved plan did not identify the chase with a required fire rating and that the previous code did not require a fire- rated chase. We plan to modify the limits of the interior alteration so as to not include the chase. We will construct a 1 hr wall around the perimeter of the interior alteration.
